Box 175 Mound, MN 55364 Re: Denial of Request for Sewer Connection Permit Dear Mr. Coddon: On March 9, 2007 the City of Orono received your application for a permit to construct sanitary sewers to serve"Block 1, Baldur Park", accompanied by a set of construction plans prepared by Schoell Madson. After reviewing the permit application with the City Engineer and the City Attorney, I have concluded that it would be premature and inappropriate to issue such a permit at this time. The reasons for denial are.iricorporated into the comments below. YOUR SEWER CONNECTION PERMIT IS HEREBY DENIED. Do not commence work on this project. I would offer the following brief comments, observations and recommendations as you proceed forward in your effort to develop the Baldur Park properties: 1. Each individual dwelling unit must have a separate sewer service connection to the municipal system. Any sewer system you construct that serves more than one residence will be required to be part of the municipal sewer system owned and operated by the City. 2. The City will not entertain construction of an addition to the municipal system until a development plan for the property to be served has been approved by the City. Your suggested disclaimer that the construction of a sewer system before development has been approved will not guarantee a specific number of lots, does not justify allowing construction prior to development approval. 3. Absent an approved development plan, it is unreasonable to establish the location of a sewer line where it could potentially interfere with future development plans. • 'If`..1,...0......... /0=11 110 i4645 I01% 140_,1414 www.ci.orono.mn.us r a Steve Coddon April 26,2007 Page 2 4. Your proposed location for the sewer is generally following the existing driveway serving the Puzak residence on Lot 30. It is the City's understanding that that driveway exists on an easement that does not include the right to install and maintain a municipal sewer line nor a private connection. New easements would have to be granted to the City. Private construction of a sewer line in that location will require variances for work within 75' of the lake. Construction of the sewer as proposed may require an open cut as much as 20' or more in width, as well as dewatering. 5. Based on the survey you provided and surveys for neighboring properties appearing in City files, it is questionable whether your properties abut a public road. Future development of your properties to create one or more building sites will have to include the extension of a public or private road meeting City of Orono standards. This may necessitate the acquisition of easements or land from neighboring properties, a process in which the City will likely not participate. 6. As we have discussed, the mere legal combination of existing lots of record to create new parcels exceeding 0.5 gross acres does not in any way guarantee the buildability of those newly created lots. The City's requirements for lakeshore setbacks and the non-buildability of wetlands, have been in place for many decades and have had a clear limiting impact on the development of these properties by past potential developers, as can be witnessed in the various development application files on record. The more recent wetland ordinances that require wetland buffers and structure setbacks from those buffers, will have a further limiting impact. The above comments merely touch on the variety of issues that surround development of the Baldur Park properties. That is why we have recommended that you begin the development process via a sketch plan application, which will begin a more comprehensive review of these and additional issues. .
