Marguerite M. McCarron I am writing this letter as a follow up to our conversation regarding the
Also c;«<, �r in W7,cans,n structure located on the above-described lot. You have inquired as to whether the
City must issue building permits for this structure based on its legal non-conforming
status. As you are aware, a legal non-conforming structure may be repaired or
restored pursuant to Minnesota statute 462.357, subd. le., and Orono City Code
section 78-71. However, a property owner does not enjoy the rights to repair or
restore a non-conforming structure pursuant to these provisions if the non-conformity
or occupancy of the structure is discontinued for a period of more than a year. In
addition, the statutory provision governing non-conformities and City Code section
78-1136 prohibits the alteration and addition to a non-conforming structure if it
results in an increase in the flood damage potential or increases the degree of
obstruction to the flood flow in the floodway. It appears that due to the state of the
existing structure that any replacement of the floor or installation of a slab would in
fact obstruct the flood flows within this floodway area.
