Attached is a petition for vacation approved July 16, 1951 which vacated Baldur Park Road west of Lot 20, and "also that road or cartway now existing insofar as the same may be public extending northwesterly along the easterly portion of Lots 21 - 30 ..." Also attached are photographs of Harry Wingerd attempting to remove my surveyed lot cornerpost with a hacksaw. It's my understanding that this is an illegal act and I ask that you forward this to the City Prosecutor for review. Also attached is a copy of a letter I sent to Ms. Benson 10 months ago. I have tried my best to accommodate my neighbors. Now, I will be proceeding with the lot line delineation and landscaping and would appreciate it if you would notify the police department that I have every right to proceed with my work. Thank you. I advised her that this is purely a civil matter between the two parties, and that she should contact her attorney immediately. I don't disagree that it could be a safety issue, but at the moment is not life-threatening. We are aware of the easement over Wingerd's property in favor of Puzak. We are aware of a non-exclusive easement for driveway purposes over a 12' strip that extends from Wingerds property to Puzak's house lot, but that specific easement appears to not be congruent with Wingerd's driveway, hence there is a gap between the 12' easement and Wingerd's property that her driveway must cross in order to be functional. There may be other easements that we are not aware of. This issue has been going on for some time now. It does not involve the City directly, and the Zoning Department cannot solve the issue for the two parties. Apparently Puzak has attempted to get the phone number of the City Attorney— it was refused him. Wingerd has told me in past conversations that Puzak wants her to buy a portion of his property, and this may be another ploy on his part. These people need to work it out. I was glad to hear that the City had not given the Benson- Wingerd group permission to park on my property. Furthermore, the "12' strip" you refer to does not benefit the Benson-Wingerd property. It was reserved for Lot 30 by Gladys Olson when she sold Lots 21-29 and 31-33. The term "non-exclusive" benefits only those lots sold by Mrs. Olson. Having said that, I'm not sure what you mean by "another ploy on his (Puzak's) part". It is no secret that I have offered to sell or rent some property to them. What I don't understand is how the City allowed them to build a new garage without adequate approach access. Regardless, that portion of Lot 21 which is not owned by the Benson-Wingerds is Torrens Property with all the limitation to perscriptive easement which that may imply.
