A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-330 and 78-1288 FILE NO. 09-3435 ev ° =Af - CITY of ORONO 4,t � iM : kESI % ,,�G RESOLUTION OF THE CITY COUNCIL � i � � I�� NO. 5391E A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-330 and 78-1288 FILE NO. 09-3435 WHEREAS, Loren Schoenzeit and Stacey Schoenzeit, husband and wife (hereinafter "the applicants") are the owners of the property located at 4480 Forest Lake Landing within the City of Orono (hereinafter the "City") and legally described as follows: Attached as Exhibit A, (hereinafter the "property"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-330 (B) to allow redevelopment on a lot 0.34 acre in area where 1.0 acre is normally required, and contains 56 feet in width at the OHWL and 45 feet in width at the 75 foot setback where 140 feet is normally required; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-330 (B) to allow a 9.7' setback from the south side lot line where a 10' setback is nornnally required; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-330 (B) to allow an 8' yard setback from the rear lot line where a 30' setback is normally required; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1288 to allow 67.3% hardcover within the 250'-500' zone where 30% is normally allowed in order to construct a new residence. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 09-3435. The property is located in the LR-1B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acre and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on November 16, 2009 and recommended approval of variances based on the following findings: a. The property contains 14,669 s.f. in area and has 56 feet in width at the OHWL and 45 feet in width at the 75 foot setback. b. The lot is substandard in area and a residence has existed on the property for many years. c. There is an existing public sanitary sewer line crossing through the property at an angle. d. There is no additional land available to bring the lot width or lot area into conformity. e. The hardcover variances as requested are in line with the levels of hardcover variances approved on rebuild applications with similar lot conditions. The proposed residence meets the structural lot coverage limitation of 15%. f. The proposed structure complies with the lake yard, side yard and average lakeshore setback requirements. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Page 2 of 5 v. 0.41- ' 0 0CITY of ORONO ,, OA G RESOLUTION OF THE CITY COUNCIL `1kEstIO NO. 5 8 9 5 applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-330 (B) to allow redevelopment on a lot 0.34 acre in area where 1.0 acre is normally required, and contains 56 feet in width at the OHWL and 45 feet in width at the 75 foot setback where 140 feet is normally required; and a variance to Section 78-330 (B) to allow a 9.7' setback from the south side lot line where a 10' setback is normally required; and a variance to Section 78-330 (B) to allow an 8' yard setback from the rear lot line where a 30' setback is normally required; and a variance to Section 78-1288 to allow 67.3% hardcover within the 250'-500' zone where 30% is normally allowed in order to construct a new residence, subject to the following conditions: 1. Council approval is based on the site plan/survey and building plans submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit B & C. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover in the 0-75' zone shall not increase above the level of 0 s.f. or 0%. Hardcover in the 75-250' zone shall be limited to 1,962 s.f. or 25%; and hardcover within the 250'- 500' zone shall be limited to 1,753 s.f. or 67.3% per the proposed plan and hardcover allowance summary as depicted on Exhibit B. Applicants are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. ADDITIONAL SURVEYS REQUIRED: a. Per City Code Section 86-68, a foundation survey is required to be submitted prior to commencement of framing; and b. An as-built grading plan verifying compliance with the building permit, stormwater management, grading and drainage plans shall be submitted prior to the issuance of a Certificate of Occupancy for the residence. 4. The building plans submitted for building permit will be reviewed to ensure compliance with the City's building height and number of stories regulations. Applicants shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their permeability as non-hardcover surfaces. 6. Required removals of structure and hardcover to be removed shall be completed prior to the framing inspection. 7. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (December 14, 2010). 8. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 9. The undersigned applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
