Item Description : Mn/DOT Property Acq sition Settlement
In late 2003, Mn/DOT acquired property west of Old Crystal Bay Road and south of the
BNSFRR (the Carlson property) from the City as right-of-way for the New Highway 12 Project.
The property was acquired through a quick-take condemnation process, because the City and
Mn/DOT could not reach agreement regarding the value of the property. The condemnation
commissioners determined the value to be $231,000.
The City appealed the condemnation commissioners' award to District Court. The District Court
judge required the City and Mn/DOT to attempt to reach a settlement through a mediation
process. The mediation process was held on Thursday, December 14. The City and Mn/DOT
did reach a settlement through the mediation process. The settlement established the value of the
property as $340,000. It is recommended that the Council approve the settlement.
COUNCIL ACTION REQUESTED:
Motion to approve the settlement regarding the Mn/DOT acquisition of the Carlson property at a
value of$340,000.
