HomeMy WebLinkAboutD-583-A-8103 Order ApprovingOAH 84-0331-34937 STATE OF MINNESOTA OFFICE OF ADMINISTRATIVE HEARINGS In the Matter of the Concurrent Detachment and Annexation of Certain Real Property from the City of Orono to the City of Wayzata (MBAU Docket D-583/A-8103) ORDER APPROVING CONCURRENT DETACHMENT AND ANNEXATION On September 25, 2017, the City of Orono (Orono) adopted Resolution Number 6792; and on November 21, 2017, the City of Wayzata (Wayzata) adopted Resolution Number 56-2017 (Resolutions). The Resolutions request the concurrent detachment from Orono and annexation to Wayzata of certain real property (Property) legally described as follows: Hennepin County Tax Parcel 02-117-23-44-0003: That part of Lot 102 lying Northerly of a line drawn from the Northwest corner of said Lot to a point on the East line of said lot distant 350 feet South of the Northeast corner of said lot in Auditor’s Subdivision No. 184, Hennepin County, Minnesota. Hennepin County Tax Parcel 01-117-23-33-0015: All of Lot 95, Auditor’s Subdivision No. 184, Hennepin County, Minnesota, except that part or parcel of said Lot 95 described as follows: Beginning at a point on the Easterly line of said Lot 95, distance 83.5 feet Northerly of the Southeast corner of said Lot 95; thence West parallel with the South line of said Lot 95, a distance of 93.5 feet; thence North parallel with the West line of said Lot 95 a distance of 150 feet; thence East parallel with the South line of said Lot 95 a distance of 40 feet to the Easterly line thereof; thence Southeasterly along said Easterly line to the point of beginning. Based upon a review of the Resolutions, the Chief Administrative Law Judge makes the following: ORDER 1. Pursuant to Minn. Stat. § 414.061 (2016), the Resolutions are deemed adequate in all legal respects and properly support this O rder. 2 2. Pursuant to the terms of the Resolutions and this Order, the Property is concurrently DETACHED from Orono and ANNEXED to Wayzata. Dated: January 3, 2018 ____________________________________ TAMMY L. PUST Chief Administrative Law Judge NOTICE This Order is the final administrative order in this case under Minn. Stat. §§ 414.061, .07, .09, .12 (2016). Pursuant to Minn. Stat. § 414.07, subd. 2, any person aggrieved by this Order may appeal to Hennepin County District Court by filing an Application for Review with the Court Administrator within 30 days of this Order. An appeal does not stay the effect of this Order. Any party may submit a written request for an amendment of this Order within seven days from the date of the mailing of the Order pursuant to Minn. R. 6000.3100 (2017). However, no request for amendment shall extend the time of appeal from this Order.
