On August 10, 1992 the Orono City Council adopted Resolution No. 3168
determining that sanitary sewer service will not be provided to your
vacant property described as Lot 1, Block 4, Bayside Addition to Lake
Minnetonka. The reasons for denying sewer service to that property
are noted in the attached resolution.

A RESOLUTION DETERMINING THAT SANITARY SEWER SERVICE
WILL NOT BE PROVIDED TO VACANT PROPERTY LOCATED AT
"305" TONKA AVENUE KNOWN AS LOT 1, BLOCK 4,
BAYSIDE ADDITION TO LAKE MINNETONKA
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and
WHEREAS, the Stubbs Bay Sewer Project was initiated by
the City to solve existing on-site sewage treatment problems in
the Stubbs Bay area, within which Lot 1, Block 4, Bayside
Addition to Lake Minnetonka, is located; and
WHEREAS, the adjacent half of vacated Hill Street has
been combined for tax purposes with said Lot 4 into a single
parcel legally described as: PINS number 05-117-23 13 0029; Lot
1, Block 4 including the adjacent half of vacated Hill Street,
Minnetonka Bluffs; and
WHEREAS, said parcel is under single separate ownership
not owned in common with any other adjacent property; and
WHEREAS, all adjacent lots are occupied; and
WHEREAS, said parcel is located in the LR-1A Single
Family Lakeshore Residential Zoning District, requiring 2.0 acres
per buildable site; and
WHEREAS, the total dry land area of the parcel is
approximately 0.20 acres, not meeting the 2.0 acre requirement;
and
WHEREAS, said parcel is not buildable without many
variances from the existing zoning code; and
WHEREAS, construction of a single family residence on
the parcel could not be done according to all zoning performance
standards, and would be contrary to the intent of the Community
Management Plan; and

• , THEREFORE, BE IT RESOLVED by the City Council of
the City of Orono, Minnesota that sewer service will not be
provided to the property known as PINS number 05-117-23 13 0029,
because said parcel is too substandard in area to be considered
as buildable without a substantial number of variances.
Adopted by the City Council of the City of Orono,
Minnesota on this 10th day of August, 1992.

RE: 305 Tonka Avenue
This letter will attempt to summarize the zoning issues regarding your property, PIN 05-117-23-13-0029,
a.k.a. 305 Tonka Avenue in Orono. According to Hennepin County property records, the property
contains approximately 8,900 square feet in area and has 70 feet in width along Tonka Avenue. This
property is located within the LR-1A zoning district, requiring a minimum of 2.0 acres and 200-feet in
width. Building on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot
area or width standards) will require variance approval by the City Council, and such approval is neither
automatic nor guaranteed but requires that a hardship be demonstrated.
Additionally, all current zoning standards will have to be met by the new principal dwelling including
setbacks, lot coverage by structures, hardcover (impervious surface), height limits, etc. the property line
setback requirements of the LR-1A district are as follows:
• Front yard = 50 feet
• Side yard = 30 feet
• Rear yard = 50 feet
Municipal sewer is available. However, based on the size of the property and the number of variances
necessary to build on the property, the City Council decided to specifically exclude it from the 1992
Stubbs Bay Sewer project. Resolution 3168 was adopted (attached) which states 305 Tonka Avenue will
be excluded from the sewer project due to the substandard size, or"unbuildable" nature, of the lot.
As with all undeveloped properties, the City will accept an application for variances to develop the
property. The Planning Commission and City Council will review all aspects of the proposal which should
include a property survey, building plans, a grading plan, hardcover calculations, etc and make a
determination as to the feasibility of developing this property. Your application will also include a request
to connect to sanitary sewer. Based on the 2010 Fee Schedule, a City sewer connection fee of
$19,750.00 would be due at the time of the issuance of a building permit.
