RESOLUTION OF THE CITY COUNCIL

A RESOLUTION ACCEPTING THE ROADWAY IMPROVEMENTS WITHIN
THE SOUTHWAYS DEVELOPMENT AS PUBLIC FACILITIES
WHEREAS, on June 11th , 2018 the City of Orono and James and Mary Jundt entered
into Development Contract Southways, 18-3998, (the "Contract") which documented the terms
and conditions under which the development known as Southways was approved; and
WHEREAS, the terms and conditions of the Agreement state that final acceptance of the
improvements to be publicly owned, including, sanitary sewer, storm water and the roadway,
shall take the form of a Resolution passed by the Orono City Council, on the advice of the City
Engineer; and
WHEREAS, the City Engineer has recommended that the City formally accept the
roadway improvements; and
NOW, THEREFORE BE IT RESOLVED that the City Council of Orono does hereby
formally accept the public roadway improvements associated with Southways and shall assume
ownership and maintenance of said facilities.
