Per recent discussions with your sewer contractor, Pat Snllfvan,
ccncerning the municipal Aewer manhole located approximately five
fcet from the west side of your tennis court, the City will zequire
that the manhole remain uncovered and not buried under thz berming
as before. Sullivan advises that the final landscape plan for the
property will include the finished contours for the area surrounding
the manhole.
2're City has asked for a copy of the tinal landscape p2an for staff
review and future reference.

This letter is written aa a follow up to our June 21, 1985,
meeting regarding the above referenced matter. It is the City's �
position in this mattez that having reviewed thQ case the City
has no liability in the matter nnd that any liability rests
between you and the Noel's who sold you the property. Reviewing
the record this determination is based on the following items:
- Preliminary plat approval was given for this propezty in
July of 1983 with you becoming the property ownec in
Septembec of 1983 (as indicated in youc most recent
application for fence per�*it) and the final plat being
granted for this propezty ia October of 19R3.
- While these may have been an indication to the Noel's at ��
time of platting together with othec ti�nes prior to that,
the specific requirement to exoose the manhole is not
zefecenced in any other resolutions regardir►g conditions for
the plat nor in any of the minutes relevant theceto.
- The solution which you had done by your landscaper was one
of a number available and was the one that provided the
nicest landscaping for your pcopecty, hovever was not
necessdrily the most economical one.
- It is not an unusual practice for a sewec manhole cone to
be cemented into place. This is done in many cases foz a
variety cE reasons, principal of which in this case may have r��+.
bc;en to prevent infiltration of the surro,:nding ground water "4`
into the manhole.

- At sometimc in the platting process there was discussion
indicating that the entire tennis court might be removed
thereby allowing the manhole to be exposed in a manner
different than the one that you fina�ly directed. "
- Had the Noel's accomplished Nxposure of the manhole pcios
to sellinq the property to you it wou;d have probably been
either a cost added into the selling price Which would have
been paid by the buyer of the property or one that would have
been absorbed by the Noel's in their sa:e.
- A resolution rega[ding the conditions of the plat s+ece that
any damage to the tennis court as a result of the City's need
to accomplish repair �nd/or maintenance was tha �r'

While this is not the reEult you were probably hoping to hear �.Y
it is the City's position that the ultimate cost should be bocne �„t�;
