on September 6, 1989, and recommended aooroval of the
proposed variances based upon the following findinqs:
A) No lot width variance is required since the 125'
iot width mee'.s 802 or more of the 140' requirement.
B) A number of inethods can be used in determining the
actual percentages of hardcovez on the property.
i. Based un crediting only the land at the
buiJ.ding site, the 0-75' hardcover proposed is
2,96U squarP feet or 15.85 and in the �5-250' zone
' is 3,360 square feet oz 30.08.
ii. Based on also crediting the northerly
portions of the orooerty for the hardcover
calculations, 0-75' hardcover is 2,960 square feet
or 10.58 and in the 75-250' zone is 3,380 square
feet or 10.28.
iii. Based on calculating 0-75' and 75-190' from
the lagoon, only creditinq the building site, and
with drainage all directed to the iagoon, 0-75'
lagoon setback hardcover is 14.98 (all existing
driveway), in the 75-190' lagoon setback is 34.48,
and in the lakeshore 0-50' setbacY is OB.
C) Applicant should not be penalized fo� the existing
driveway hardcover in the lagoon 0-75' zone, and in
fact his driv�way proposal minimizes the additional
driveway hardcover required.

and aversge setback variances to allow fcr the least
disruptive sightlines, to maintain uniformity, and the
capability to direct all drainage over 100' o:
relatively flat lawn area, justify the granting of a
varia�ce to the lakeshore setback.
E) The unique characteristics of the property, i.e.
the proposed build�ng site separa�ed from the rest of
the property by a lagoon, constitutes a valid hardship
to the property.
F) Th� variances can be granted without permanezt
crediting of the lot area north of the lagoon.
5. The City Council in reviewing tnis parcel finds that the
property tal:en in its entirety, inclu�'.ng area north of the
lagoon, meets or exceeds the 1 acre lot area requirements
for the LR-1B Zoning District.
6. The Ci�y Council has considered this application
including the findings and recommendatior.- of the Pianning
Commission, reports by City staff, comments by the applir_ant
and the efrect of the proposed variance on the health,
safety and welfare of the community.
7. The City Council finds tt.at the conditions existing on
this property are peculiar tc it and do not apply generally
to other property in this zor.ing district; that granting the
variance would not adversely affect tr�ffic conditions,
light, air nor pose a fire hazard or other danger to
neighborir.g property; would not merely serve as a
convenience to the applicant, but is ❑ecessary to alleviate
a demonstr-�ble hardship or difficulty; is necessary to
preserve a substantial property right of the applicant; and
would be in keeping with the soirit and intent of the Zoning
Code and Co*�.prehensive Pian of the City.

Based upon one or more of the findinas noted above, the
Orone City Council h�reby grants a va-iance to Municipsl Zoning
Code Section 1.0.22, Subdiv.ision 1 and Section 10.55, Subdivision
8 to alZow the cor.structioii of a new home located pzrtially

allowed, and grants a variance to Section 10.22, Subdivision 2 to
