I just drove by your property today, twice. Once I observed a dump truck leaving the property and the second time I saw freshly deposited dirt. As you are aware, your property is subject to a STOP WORK notice; and the city has NOT authorized ANY work to proceed. You do not have a permit to conduct grading activities. I will remind you that on December 30, 2016 a stop work order was posted and to-date you have not completed our requirements for the after-the-fact permit. A City Inspector visited the site and noted today's grading and hydro seeding was completed. Please be aware,this work may not be approved as it has been completed/finished. A revised plan must be submitted before Friday,June 9, 2017 to finalize our review of the after-the-fact permit. Failure to respond as requested by June 9, 2017 will result in this matter being forwarded to the City Attorney for prosecution and/or issuance of a citation. Timeline of events: December 30, 2016 Stop Work Order Issued February 10, 2017 Zoning Permit application submitted February 16, 2017 Incomplete letter sent April 13, 2017 City Staff noticed additional grading April 14, 2017 City Staff contacted MCWD. MCWD waiting for information. April 19, 2017 Email sent reminding property owner of stop work order and the need for revised plans June 1, 2017 City Staff observed additional grading and hydro seeding and a site visit was made. Staff conducted a preliminary review based on the information provided and recommends the following items be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Wetland. Based on our available information, it appears there is a wetland within the subject property. This wetland appears to be located within 150 feet of the project area/disturbance. Orono City Code Section 78- 1605 (copy attached) requires a wetland delineation for any proposed work within 150 of a wetland. Level 2 Delineation is required. A Level 2 delineation must include the exact surveyed boundary of the wetland shown on the certificate of survey. 2. Certificate of Survey. A survey dated 2010 was submitted with hand-drawn annotations. After a wetland delineation has been completed a report should be submitted to the MCWD for their approval. Once the MCWD has approved the delineation, have the survey updated to show the delineated wetland edge along the location of the fill and with how many cubic yards of fill was brought to the site. On Monday, I reviewed the information you emailed. Based on this review, we have a number of concerns. It appears, based on a 2010 wetland delineation (attached image), your grading project filled in wetlands on your property, in violation of both City of Orono and MCWD regulations. You have not received a permit to perform grading operations; the"permit"you forwarded from the MCWD is an application for an erosion control permit. We require permits and specific information for grading projects to avoid costly mitigation and corrective action. Had you submitted the required information and received a permit prior to conducting the work in December, you may have avoided unnecessary time and expense. A new wetland delineation should be conducted and submitted to the MCWD for approval prior to the City and the MCWD approving any permits for filling/grading in the general areas you propose. At this time the fill placed on the property must be removed. A permit application must include: • Wetland delineation • Existing topography of the property; • Proposed grading, proposed topography; • Current wetland delineation areas shown; • Quantities of fill material. Once the filled areas are restored and the City has the information requested we can review your proposal. Please note, the MCWD generally does not allow fill in wetlands for any reason that could be considered"esthetic"or just because the yard is wet. The fill must be removed and the areas re-graded and re-seeded by or before June 22nd. Failure to respond as requested by June 22, 2017 will result in this matter being forwarded to the City Attorney for prosecution and/or issuance of a citation.
