Pursuant to Minnesota Statutes Chapter 103D, and on the basis of sta�teii4nts and
information contained in the permit application, correspondence, plans, maps, and
all other supporting data submitted by the applicant, all of which are made a
part hereof by reference, PERMISSION IS HEREBY GRANTED to the applicant named
below for use and development of land in the Minnehaha Creek Watershed District.
It is recommended that the following condition be placed on the permit:
1. A licensed shoreline contractor shall be used if any shoreline work is
performed below elevation 931.5.

This permit is not transferable, and is valid to the date of expiration. No
activity is authorized beyond the expiration date. If the permittee requires
more time to complete the project, and application for renewal of the permit is
required.
The applicant is responsible for compliance with all District rules and for the
actions of their representatives, contractors, and employees.
(Statement concerning fees for inspections, violations, etc. on back of permit. )
Inspection/Analysis/Monitoring Fees
A site inspection and monitoring by District staff will be
performed where the activity involves:
• a commercial/ industrial/multi-family
residential development.
• a single family residential development
greater than 5 acres or of any size if within
the Minnehaha Creek subwatershed.
• any alteration of a floodplain or wetland.
• dredging within the beds, banks or shores of
any protected water or wetland.
• a violation.
• any project which in the judgement of District
staff should be inspected due to project
location, scope, or construction techniques.
In these cases, the applicant shall pay to the District a fee
equal to the actual costs of field inspection of the work,
including investigation of the area affected by the work, analysis
of the work, and any subsequent monitoring of the work, which in
the case of a violation shall be at least $35.

Dear Mr. Spartz,
As we discussed earlier, the proposed connection of MIRAGRID to
the steel pipe anchorage is better achieved by wrapping the
MLRAGRID under and around the pipe 180 degrees and then Pack
toward the face of the slope a minimum of 3-4 feet. A minimum 2-
3 inch compacted soil layer should be placed between the two grid
surfaces.
Secondary reinforcement (intermediate layers of MIRAGRID) should
be placed between the primary layers of reinforcement to prevent
slouching of the slope surface and to act as compaction aide at
the face of the slope. The secondary MIRAGRID 'layers should
extend a minimum of 3-4 feet into the embankment from the slope
face
Additionally, Mirafi recommends that a permanent erosion control
mat similar to Miramat 1000 be used to protect the slope face,
since t 111 clop angio will be tfiffl(•uit to Vegetate properly.
The example design has not been checked by Mirafi for external .
internal or global stability. Mirafi recommends that An engineer
eeegi terod in the state of Minnesota and familiar with reinforced
soil design review this design prior to installation_

Landview Landscaping has used the American Excelsior Erosion Control blanket in the past and is
pleased with the results. We have compared it to just installing sod and have made the following
comments about the comparison.
On steeper slopes where it is very difficult to lay sod we prefer to use the American excelsior Turf
Reinforcement For the following reasons.
1. Sod comes in smaller units 1.5'X 6'whereas American excelsior comes in Larger units 8'X
100'.
A. Usually if one unit of sod comes loose it leaves the others less secure because of
undermining.
B. Because of the larger units it leaves less room for error.
C. It provides a great environment for all types of low vegetations spreading turf Reinforcements
such as crow vetch. Wearers the sod would mainly stay as sod and slow down the growth rate of
the better Crown Vetch(low profile good&root base).
D. American Excelsior cost less and is easier to install.
We just completed a project last week with the American excelsior Turf Reinforcement and were
amazed at how much faster the seed grew where we used the Fabric then where we did not. I
highly recommend the American Excelsior Fabric for the Susan Sumey Project.

I, Stephen Spartz, am confident that the American Excelsior Control Blanket will prevent erosion
into the lake. I am less confident that pegged sod will hold up as well as the American Excelsior
Control Blanket in the case of a downpour. The American Excelsior Control Blanket was created
for stabilizing steeper slopes were sod is less likely to do its job. According to my experience the
American Excelsior Erosion Control Blanket has done better than pegged sod both in cost and
erosion control. I have totally gone away from sod in cases such as the Susan Sumey project.
Pegged sod can simply not do as good of job in erosion control as the American Excelsior Erosion
Control Blanket. I can Guarantee the American Excelsior Erosion Control Blanket will outperform
Pegged sod in the case of a downpour.

Described below is Matter of Maintenance According to the United States Department of
Agriculture Soil Conservation Service St. Paul Minnesota. Slope Protection for Dams and
Lakeshores Minnesota Technical Release 2 April 1988.
From their Advice I have put together a contract that states it is the responsibility of the
Homeowner(Susan Sumey)to get the necessary groundcover to grow on the 1:1 slope. The
home owner has the responsibility to decide with the advice of Landview Landscaping and others
involved which ground cover is best suited for the Susan Surrey project Once the groundcover is
in place and stabilized the project can be considered a low maintenance project that involves
Susan Sumey to have the responsibility to keep over 90%of the project covered with lowgrowth
ground cover such as Crown Vetch or Sod.
The Soil Conservation Service policy in Minnesota requires that all maintenance is the
responsibility of the landowner(s). Before any assistance is provided,the landowner(s)must sign
an agreement stating that they are responsible for the maintenance of the installed practice. The
SCS may assist with suggestions for maintenance only. Lakeshore protection or slope protection
may be disturbed by ice action or by water runoff larger than those used in design. These
conditions can only be addressed by designing flexible protection and that is easy to repair or
replace with a moderate maintenance effort. The design and installation will be done to the best of
the designers ability and knowledge, and maintenance is totally the responsibility of the
landowner(s).
There are unpredictable sources of problems for Lakeshore and slope protection-ice jacking and
Waterlogging. Ice Jacking is a phenomena that involves the freezing and thawing of the lake
surface. When the ice expands in freezing, it pushes up and outward against the shores of the
lake with very large pressure which can move almost any type of protection measure. Flexible
measure such as riprap can be pushed up and out of place leaving holes in the protective layer.
These holes can allow undermining of the protective layer and loss of its effectiveness. Semi-ridgid
measures, such as precast concrete blocks, can start to unravel, and rigid measures, such as a
concrete wall, can be cracked beyond repair.
Waterlogging is a phenomena that occurs when the internal strength of soils can decrease when it
becomes saturated by groundwater and seepage flows within the bluff. The added weight of
buildings and other structures can increase stresses on the soil and contribute to slope failure.
Erosion problems are common along bluff shorelines where a variety of forces and processes act
together. The most prevalent causes of bluff erosion and recession are occur at the toe(base)by
waves and instability of the bluff materials themselves. A typical bluff often consist of layers of
different soils, which do not stand permanently at a vertical face. Failure of the slope depends on
the nature of the material. A cohesive material (clay)will move as large blocks either by toppling
due to undercutting or by sliding out in a curved arc. Granular material (sand or gravel)will erode
easily by flowing water and wave action. Vertical sided blocks will drop due to and undercutting of
the slope or the soil will suddenly flow down an inclined plane. Height is a factor because high
bluffs (over 20 feet) impose greater stresses and are likely to have more severe stability problems
than low bluffs.
The Design for the Susan Sumey project does not try to design against these unpredictable forces.
The Landowner(Susan Sumey)should be told of these phenomenas, and instructed on
maintenance of their measure should they occur.
The Soil Conservation Service policy in Minnesota does not allow installation of high-maintenance
protection for a single landowner without proven means to maintain the installation. An example of
a high-maintenance measure is artificial nourishment.
The technician, conservationist, or engineer involved in the project should discuss maintenance
with the landowner prior to design of the measure. A maintenance plan should be prepared by the
designer for the specific job. It should be discussed with the landowner. The Landowner must be
aware of their responsibility in this area, and sign a maintenance agreement prior to the installation
of the measure. The plan must be attached to the O&M agreement signed by the landowner.

Landview Recommendations for Design and Maintenance.
DESIGN. (recommendation)See Attached Diagram.
1. Fill Material(Clay with a Mixture of Granular)
a. Clay will provide the necessary Cohesive characteristics for a(1.1)slope.
b. Granular will provide the necessary Drainage Characteristics to help prevent Waterlogging.
2. Anchors, Pipes and Miragrid 5T.
a. Anchors create stability of fill to existing dirt plane.
b. Pipes provide for attachment of Miragrid 5t to the Anchors.
c. Miragird 5t. provides soil stabilization and internal Strength.
d. Topsoil promotes lowgrowth erosion control vegetation such as Crown Vetch.
Maintenance. (recommendation.)
1. Ground Cover(Crown Vetch& Bird Foot Tree Foil.) Homeowner must keep supplied necessary
seed incase of dyeout. Recommended keep 2-5 pounds in storage. Water every two days until
ground cover has taken root.
2. American Excelsior Erosion Control Blanket. Installed after project is completed and home
owner must keep in stock 2 rolls(8'X 90')in case of washout or erosion due to large downpour
after installation. If erosion occurs call contractor fix erosion and reseed and cover with erosion
control blanket.
3. Homeowner must immediately contact contractor incase of problems after installation.
4. The silt fence must be kept up and well maintained until 90%of project is well rooted and
vegetated.
5. The Homeowner has the responsibility to keep over 90%of the project covered with lowgrowth
ground cover such as Crown Vetch.
We recommend the Crown Vetch and American Excelsior Erosion control blanket for the following
reasons. Recommended Maintenance.
Crown Vetch is used by the DOT along side roadways where there are slopes such as 1:1 and
through experience have had better success than sod for erosion control.
American Excelsior Erosion control Blanket.
A.Interlocking Curlex(Curled, Barbed)Wood fiber Mat.
1. Conforms to the soil to prevent erosion by holding soil and seed in place during revegetation.
Protects form water flow, wind, and rain drop erosion.
2. no need for bottom net, sewing, or gluing to hold fibers.
3. Controls temperature fluctuation of the soil.
B. Documentation-Curlex has been hydraulically tested and design parameters are listed in
#FHWA-Ip-87-7 Hydraulic engineering circular#15"Design of roadside channels with flexible
linings
1. Engineers can justify their design based on documented research.
C. Absorbs up to five times its weight in moisture and swells as it absorbs.
1. Fibers become very active as they swell and cling to the soil and vegetation to lock into place.
2. Swelling action increases height profile to provide a rough surface which will slow water flows
down.
3. Does not require costly follow-through watering.
D. Hygorscopic
1. Gives moisture back to plants as needed during germination.
E. Neutral PH •
1. Will not heat up and burn up seed during decomposition.
F. No Weed Seeds
1. Establishes vegetation free of unwanted weeds (This is very important in the growing market of
residential development.).
G. NO Pitch,tar, or resin
1. No Harmful substances to leach out and hamper revegetation (as pine and poplar blankets do).
H. Smolder resistant
1. Will not burn or smoke from lit cigarettes.
I. 50 Square yard
1. Easily handled and installed by one person.
J. 8'width(X90' length)
1. Wide width is a natural for short. Wide slopes, extra wide ditch lining's or may other
applications.
American Excelsior VS Sod
1.Curlex is cost effective as compared to sod, usually no more than 50°%of the installed cost.
2. Curlex does not require costly watering follow though.
3. Watered sod tends to trap moisture in itself and promotes lateral root growth which leads to sun
burnout of sod. Common on Steep slopes.
4. Curlex can be stored on site as used as needed. Great for emergencies.
5. Sod is more labor intensive, one truckload of curlex equals 24 truckloads of sod !!
Contract Terms of Responsibility for Project Design and Maintenance.
The Maintenance of the above project is the responsibility of the landowner. Susan Sumey is
responsible for the maintenance of the installed project. Landview Landscaping will assist with
suggestions for maintenance only. Lakeshore Protection or slope protection may be disturbed by
ice action or by water runoff larger than those used in design. The Landowner, Susan Sumey has
been notified of the unpredictable sources of problems for lakeshore and slope protection such as
ice jacking and waterlogging. These Conditions can only be addressed by designing flexible
protection and that is easy to repair or replace with a moderate maintenance effort. The above
design and installation has been done to the best of the Designer's (Stephen Spartz's),
knowledge, and maintenance is totally the responsibility of the Landowner(s) (Susan Sumey).
I, Susan Sumey, hereby understand that the above project does not try to design against the
unpredictable forces such as Icejaking and Waterlogging. I have been told of these phenomena's,
and was instructed on maintenance of their measures should they occur. Stephen Spartz has
discussed the above maintenance plan and has made me aware of my responsibility in this area

without proven measures to maintain the installation. The design and installation will be done to
the best of my knowledge and ability, and does not try to design against the unpredictable forces
