He is having difficulty with his email at this time so I will forward you his response. Mike's response: We have in our files the same documents you included in your email. We didn't previously have any indication that the two LMCD documents had been filed, so that is a new piece of information for us. First off, note that I am not an attorney, and this is not something the City Attorney will get involved in. You should have an attorney review this situation. That being said, my understanding based on a reading of the documents is that 2691 has an easement of record to use part of 2697 for driveway purposes and for (presumably shared) use of 2697's lakeshore for "private bathing and dock". Because of converging extended lot lines,the standard dock use area defined by the LMCD codes for 2691 would not accommodate a dock of reasonable length, according to the LMCD Board, so the Board in 1994 (see the Order) granted a variance to allow for a single shared dock for 2691-2697. At the same time, the Board apparently agreed to an "adjustment" of the dock use area by angling the outer shared lot lines (with Runkle on the north and Kauffman on the south) by 25 degrees. The Board limited the shared dock to 40' in length and it must be set back at least 5' from the adjusted extended lot lines. The second LMCD document (the Memorandum) describes the Board's reasoning for doing this, but does not address whether Runkle or Kauffman find this acceptable, and doesn't make a judgment as to whether Runkle's or Kauffman's property rights are violated by this Board action. The question remains: do the properties at 2691-2697 have the right to extend a dock past Runkle's or Kauffman's original extended lot lines? There is no action the City can or will take to resolve this issue. The City generally defers to the LMCD with regards to dock locations on Lake Minnetonka. Ultimately, I suspect it's up to the 3 or 4 affected property owners to work it out. I have a potential client looking to purchase the property at 2697 Ethel Avenue, Orono. It looks as if this property has 19ft of lake shore and an easement as the house sits up on the other side of another property but has a long narrow piece of land leading down to the lake. I am looking to find out as much information as I can in regards to the easement, as well as the use of the 19ft(assuming not enough room for a dock?). I also have some documentation of an application with the Neighbor Michael D Revier dated January 26 1994 document information CLL63201 LK110-4 and was filed with Hennepin County: 4849775, 4849776 with the LMCD (I am also including them in this e-mail). I was told by Michael that this was never cleared and does not have any merit at this point(regarding a shared dock and a variance and affected a couple additional lake shore properties). I am attaching the information and application back from 1994 that I have received from the listing agent. Mr. Runkle asserts that the applicant acquired his property after the LMCD code was in effect and therefore the hardship is self created. The Runkle and Kauffmann Sites each have ; approximately 100 feet of shoreline. Therefore, adding storage for two boats at the combined Revier and Amundson Sites will not create unreasonable congestion in the t area. G. Mr. Runkle asserts that a variance may not be granted to Mr. Revier which • allows him to install a dock or store boats on the Runkle side of the extended line between the Runkle and Revier Sites. This question is more fully addressed in the attached memorandum. For the reasons explained in the memorandum, the board makes no finding as to the respective real property interests of the owners of the Runkle and Revier Sites. Mr. Runkle stated that he would agree to a dock plan which would not involve sl; • crossing the extended lot line between the Runkle and the Revier Sites. He argues '{ ,, • that there is no hardship which justifies a variance adjusting this lot line because a dock has been in place in the past which did not extend over the extended lot line. It appears to be true that a dock has been constructed in the past at the Revier or Amundson Site which did not extend beyond the extended lot line between the , Runkle and Revier Sites. However, this dock was not in compliance with the requirements of the LMCD code and extended substantially into the dock use area of the Kauffmann Site. Likewise, Mr. Runkle urges the board to adopt a plan agreed upon by Mr. q, ,;s Revier and Mr. Runkle in an attempt to resolve this issue through mediation. That ,, ' agreement, however, also avoided crossing Mr. Runkle's extended lot line at the i„`....14,4, t'° ,, } `n° expense of the Kauffman Site, and Mr. Kauffmann apparently declined to approve " r the proposed settlement. Finally, the board finds that the variances granted by this order do not T'` adversely affect the purposes of the LMCD code of ordinances, the public health, j safety, and welfare, or reasonable access to or use of the lake by the public or other f,! riparian owners. ON THE BASIS OF THE FOREGOING, IT IS ORDERED that the dock use areas be determined by reference to lot lines adjusted from the point at which the lot lines reach elevation 929.4 feet NGVD as follows: the lot line between the Runkle and Revier Sites is adjusted 25 degrees to the north; and the lot line between the Amundson and Kauffmann Sites is adjusted 25 degrees to the south. The variance hereby ordered is subject to the following conditions: 11 r 1. The board has chosen to address two of these 1 "• issues in this memorandum, The first of these arguments raised by Mr. Runkle is „�; 1 ' , i , '‘' that the applicant does not have the legal right to construct the docks over the ,,-, extended lot line between the Revier and the Runkle properties on land which is , under water below the ordinary high water mark. Although land between the ordinary high water mark(OHWM)and the ordinary 'i t low water mark (OLWM) may be privately owned, the board is not aware that the y0 , OLWM has ever been determined for Lake Minnetonka. Without such a determination, q; k , ASS. it woulu.,tet be possible to evaluate the merits of Mr. Runkle's claim because the.land -. below the OLWM is owned by the state of Minnesota and cannot be privately owned.
