I submitted this Boathouse building permit application last Friday, October 30, 2015. The City of Orono has accepted this building permit application, along with the advanced plan review fees paid, and the required land use application escrow agreement. It is also my understanding that the City of Orono is in need of additional structural engineering work at this time in order to consider this building permit application complete. This structural engineering work is being completed by Mr. Lowell E. Wenzel, P.E. of Wenzel Engineering located at 10100 Morgan Ave., S., Bloomington, Mn 55431. On October 31, 2014 the City sent its contractor to your property to finish removing all debris associated with the original demolition. At this point the City considers this project complete; you have 1 year to apply for a permit and rebuild your boathouse. Our November 3, 2014 letter(attached) specified the City Code and statutorily allowed timeline of a one year window for receiving a building permit to rebuild your boathouse. City Code Section 78-71(c) states that if no permit is applied for within the allowed 12 month time period any construction shall be in full compliance with the zoning code. (Link to City Code Section 78-71). You therefore must submit a complete building permit application regarding the reconstruction of the boathouse for our review by or before November 3, 2015 or the proposed structure must comply with all City of Orono zoning requirements. The current zoning ordinance would not allow the construction of the boat house in the current location. If you have questions in this matter please let us know. This letter also states that I have 1 year to apply for a permit and rebuild my Boathouse. I respectfully am requesting some additional time to apply and rebuild my Boathouse for the following reasons: 1. This Boathouse is going to be susceptible to damage from the ice. 1 2. These types of structures have been built and are still being built with the homeowners understanding this is an ice maintenance situation. 3. There are ways to isolate the pilings somewhat from the ice. 4. The engineering needs to be proven in order to submit a complete and comprehensive building permit application. 5. The building site also needs soil testing, foundation tests, and grading prior to construction. I have also contacted all the various agencies that may have an interest in this structure or if I may need additional permits. I have contacted the LMCD, MCWD, and the DNR due to the Ordinary High Water Level (OHWL) involved at the construction site, along with their Hydrologist. If the City of Orono would consider this additional time in order to submit a full and complete building permit application, how much time would be considered in light of all of the above issues? I wish to build a structurally sound Boathouse that will withhold the ice movement and to also meet the City of Orono's high standards and municipal codes. We received an application towards the end of last week that is proposing to rebuild a boathouse below the OHW of Lake Minnetonka (see attached). From the documentation provided it appears the building was deemed hazardous and removed by the City of Orono, allowing the applicant to rebuild on the exiting footprint within a year. Since the footings will need to be installed directly into the bed of a public water, would that require a DNR permit? While it may not be dredging in the strictest sense, MCWD staff has required Dredging permits in the past for projects that are removing footings from the lake bed. Any clarification you could offer would be greatly appreciated. This includes: • The construction of boat houses on Lake Minnetonka is prohibited by Lake Minnetonka Conservation District (LMCD) Code Section 2.12, Subd. 2a. However,the interpretation of this could vary because the boat house in question was appears to have been legally in existence prior to its removal last fall. • Based on what I understand,the City of Orono is seeking approval from the LMCD on reconstruction of the boat house. Without further construction details on what is being proposed,the LMCD is unable to determine whether the reconstructed boat house would comply with the LMCD Code. When you submit your building permit application to the City of Orono, please make sure the LMCD is copied on it. This should give the LMCD a better idea of whether the proposed structure would be built at the previously approved dimensions or would be an expanded structure. • In our conversation, you made reference to the Minnehaha Creek Watershed District(MCWD) requesting some level of approval from the LMCD. At first glance, it does not seem that this would be for the boat house. If you have another permit application into the MCWD and they are seeking approval by LMCD, please forward me a copy of the completed application. • With regards to reconstruction of the boat house, it seems that Kate Drewry, the Area Hydrologist for the Minnesota Department of Natural Resources, should be consulted.
