AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.
The applicant is responsible for assuring all required inspections are
requested in conformance with the State Building Code.This permit may be
revoked at any time for due cause.

AGREEMENT made this I6 day of JGU 2013, by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City")^77MO a �� j L!k /" ('Owners").
Recitals
1. Demolition and.building permit applications have been filed for demolition of the existing home
and a permit to construct a new single family residence located at 1565 Fairview Cottage Lane (f.k.a. 4199 North
Shore Drive), the ("Subject Property"), legally described as Lots 4 and 5, Orchard Beach and Lot 29,
Highwood Lake Minnetonka, Hennepin County Minnesota.
2. Owners request the City to review the applications.
3. The City will commence its review of the applications and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with Demolition Permit# c c)i 3 -DO 03D
Building Permit#2013-00572 if compliance with the approved permits is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Good morning, Tim. There will be no need for a City Council appearance. I wanted to get in touch with you to let you
know that after much double-checking in our Code we determined that the addresses can be reassigned at a staff level. I
apologize for the confusion on this issue, we don't handle requests like this very often.
There was some further clarification needed from our Code regarding address number assignment and the assignment of
a City street name, which does require City Council approval, and the fact that previously no homes were addressed off of
Fairview Cottage Ln. We have resolved this in-house and have processed your address change, see the attached memo
to the Clerk. There is no Council approval requirement.
Our Clerk sent out the request to Hennepin County this week and it should not be long before the change is made. You
(&the Houcks) should also be receiving a notification of this in the mail. If you have questions upon receipt of the letter
you should contact our Clerk, Rachel Dodge at 952.249.4603.

Here is an update on your request for an address change/naming of the street. The property
owners at 4201 North Shore Drive have responded in favor of the address change. However
the property owner at 4203 NSD was not clear in their desire to make the change citing the
amount of private leg-work necessary to change their address. Since Staff requires
participation by all parties we cannot simply process your request.
If you would continue to pursue the address change, I recommend that you write a letter to me
detailing your request. This letter will be presented to the City Council at an upcoming meeting
for their consideration of the address change and naming of the street. This is a meeting that
you and your neighbors should attend. The City Council meets the second and fourth Mondays
of each month. Your request should be received by me at least one week prior to the desired
Council meeting date.

\ ZONING DISCLOSURE & DECLARATION
.tt To the property owner: Demolition of the principal dwelling structure on a property may
\`eq �� automatically terminate certain rights which may have accrued to the property by virtue of the
kfsk{O� continued existence of that building. This means you may give up some or all of the zoning rights
currently associated with the principal structure (setbacks, hardcover, size of building, etc) with its removal.
• Rebuilding on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot area or width
standards) may, with few exceptions, require variance approval by the City Council, and such approval is neither
automatic nor guaranteed but requires that a practical difficulty be demonstrated.
• Additionally, all current zoning standards will have to be met by the new principal dwelling including setbacks, and
building footprint, hardcover(impervious surface), &height limitations, etc.
• Where municipal sewer is not available, provision of two (2) conforming on-site septic treatment sites is mandatory
for a new dwelling.
• Unless specifically approved by the City, all accessory structures must be removed at the time of principal
dwelling demolition. This also applies to seasonal and permanent docks, which may not be re-installed until a new
principal dwelling has reached the framing stage.
