Re: Building Permit Application#2014-01287
This letter is to follow up the November 13, 2014 letter sent pertaining to unpermitted construction on your property
from 2013. An after-the-fact building permit application was submitted for the deck which was converted into a
screened porch without permits. Staff conducted a preliminary review of the permit application and based on the
information provided we determined the application to be incomplete. To-date we have not received the requested
information. In order to review your application we need the following:
1. Certificate of Survey. A survey was submitted, however it does not meet all of the City's survey standards
(enclosed), specifically the average lakeshore setback is not shown. Please add additional details to the
survey and show the average lakeshore setback line.
2. Hot Tub. The new hot tub shown on the survey does not meet the 10' side yard setback'; a 10' setback from
the deck/porch and appears to be located within the average lakeshore setback. The hot tub must be moved
to a conforming location. See enclosed Swimming Pools and Hot Tubs information packet.
3. Setbacks. The existing deck is shown set back 7'-8" from the property line, where a 10' setback is required.
If it is determined that the porch is not located within the average lakeshore setback, the porch must be
altered to meet the 10' setback on the North side. Please note, if the porch is located within the average
lakeshore setback the porch must be completely removed.
4. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District and is
permitted up to 25% hardcover. Hardcover calculations are shown on the survey; however, please have the
surveyor prepare hardcover calculations, using the City's Hardcover Calculation Worksheet. Attached is a
copy of our hardcover information packet which includes the worksheet.
Please be aware, the property remains in violation of City Code Section 86-37 & 86-66 (copies attached) requiring
permits for construction. Please submit the requested information by Wednesday,July 8, 2015 to avoid this matter
being forward to the City attorney for an enforcement action. Please feel free to contact me at 952.249.4620 or by
email at cmattson@ci.orono.mn.us if you have any questions on the above requirements.
Sincerely,

SEPTIC SYSTEM
All parts of the pool, including the apron or deck and equipment must be at least 20 feet from the drainfield and
10 feet from other parts of the septic system.
WETLANDS
Investigation into possible wetlands should be done early in the planning process as it will take several months
for a wetland delineation to be completed.
The City of Orono requires a 35 foot setback from a delineated wetland edge for all structures and hardcover.
All wetlands within 150 feet of a proposed project will require a wetland delineation. For assistance in
determining if there may be a wetland on the property, contact the Planning Department at 952-249-4620.
MINNEHAHA CREEK WATERSHED DISTRICT(MCWD) PERMITS
Your project may or may not trigger the Minnehaha Creek Watershed District's (MCWD) permitting
requirements. Contact the MCWD directly at 952-471-0590 to discuss their permitting requirements.
FENCES AND DECKS
The City of Orono does not require a fence around a pool or hot tub. If you choose to erect a fence it must
comply with the height requirements. (See the Fences information sheets.) A deck or patio is not required
around a pool.
ACCESSORY BUILDINGS
Pool houses and pool equipment buildings must comply with setbacks for accessory buildings and require a
separate building permit. A toilet and sink may be installed in a pool house but a shower/bathtub and/or guest
house require a conditional use permit.

l'kEsHO``
The hardcover allowance for an individual property is identified on Orono's Stormwater Quality Overlay (SQO)
District map on page 5. Each property within the SQO District has been assigned to one of five 'Tiers' within
which a defined percentage of the entire property is allowed to be hardcovered. The percentage of hardcover
allowed within each Tier is shown in the following table:
Assigned Tier Allowed Hardcover Percentage
Tier 1 25% of gross lot area
Tier 2 30% of gross lot area
Tier 3 35% of gross lot area
Tier 4 (properties zoned RPUD) 50% of gross lot area
Tier 5 (properties zoned Industrial) 85% of gross lot area
HARDCOVER IS DEFINED AS FOLLOWS:
Hardcover means a hard surface that prevents or retards entry of water into the soil and causes water to
run off the surface in greater quantities and at an increased rate of flow than prior to development.
Hardcover shall include but not be limited to the following: all building footprints, driveways, sidewalks,
stepping stones, retaining walls, patios, courts (sport, tennis, etc), decks, pools, areas used for the
extended outdoor storage of vehicles or equipment, and all other similar features or surfaces as determined
by the City Engineer or City Planner.
HARDCOVER INCLUDES:
• Roofs • Porous or pervious pavement
• Sidewalks, steps, and patios • Tennis or Sport Courts
• Decks, including decks on play • Building Footprints
equipment(even if there are gaps • Any other vehicle, material,
between the boards) equipment, or structure that
• Driveways, regardless of surface prevents absorption of rainfall and is
material maintained in the same location
• Tops of retaining walls, including long enough that no vegetation
boulder walls, and isolated boulders grows under it.
• Swimming Pools
SURVEYS AND HARDCOVER CALCULATIONS
When a permit is requested for expansion or construction of a structure or hardcover an updated survey and
hardcover calculation worksheet will be required to demonstrate compliance with hardcover regulations.
VARIANCES

added to the overall hardcover counting against the subject lot;
b. The land area upon which the encroachment rests shall count towards the overall lot area for the
subject lot.
(3) Retaining walls;
(4) Handicapped ramps with a pervious surface below; and
(5) The first 100 square feet of pervious paver patios/walkways or the first 100 square feet of deck with a
