We have not received an after-the fact building permit application nor has the porch been
removed as required by our letter dated November 15, 2013. As you are aware, a porch was
constructed over an existing deck at the above address without proper City permits.
Construction without a City permit is a violation of City Code Section 86-66.
This letter will serve as your notice that the property must be brought into compliance
before Monday, December 30, 2013. In order to bring the property into compliance the porch
must be removed or an after-the-fact building permit submitted, with all the necessary
requirements, including an updated survey meeting all the survey requirements and specifically
indicating the average lakeshore setback. Please be aware if the porch encroaches into the
average lakeshore setback, staff will be unable to approve it administratively.
If you are interested in applying for an after-the-fact building permit, the City's Building Permit
Application packet is enclosed. Building permit fees are based on the estimated construction
value. After-the-fact permits are subject to double the permit fee.
Please be advised, if you fail to comply with this notice, this matter will be sent to the
City Attorney for review and may result in criminal prosecution. I have attached the
pertinent City Code for your reference. If you have any questions, please don't hesitate to call

or demolish any building or structure, or any part or portion, including but not limited to the general
construction, plumbing, water well, on-site sewage treatment system, wood stoves and fireplaces,

BUILDING PERMIT APPLICATION SUBMISSION REQUIREMENTS
A. PROPOSED BUILDING PLANS
Two (2) copies of building plans, drawn to scale and one reduced copy (8 h/2" x 11" or 11" x 17")
containing the specifications listed below. One set will remain on file with the City and one set will be
returned to the applicant to be kept on-site during construction.
Floor Plans
Each floor or level including basement or foundation, decks, porches, garage or carport require a floor
plan.
Include:
• size, spacing and direction of floor, ceiling framing members, girders, beams, columns and piers
• location and size of all windows and doors including manufacturers identification and
documentation of window and door infiltration test data
• location and size of all permanent installed cabinets, plumbing fixtures, heating, ventilation and
air conditioning equipment
Exterior Elevations
Show exterior elevations on all sides of building, including windows, doors, finished grades, exterior
finish, depth of footings, foundation walls, piers, finished floor elevations and type of materials.
Details and Sections
A minimum of one section detail through the exterior wall for each type of construction proposed, showing
materials and dimensions of each member from footing to the highest point of the roof.
If a half-story is proposed, additional cross-section drawings are required for evaluation. See Building
Height handout for more information.
Details including:
• Calculations and stress diagrams, together with manufacturer's specifications are required for all
trusses.
• Fireplaces, if proposed, must be detailed in the plan and include a cross section.
• Details and calculations are required for each critical construction detail including beams,
overhanging or cantilevered joists, stairways, balconies, or other unique structural features.
• Provide window or door schedules, shop drawings of sky-lights and manufactured stairways.

B. MINNESOTA STATE ENERGY CODE CALCULATIONS AND MECHANICAL CODE REQUIREMENTS

D. STORMWATER POLLUTION PREVENTION PLAN (SWPPP)

E. PLAN REVIEW FEE
An estimated plan review fee is due at the time of application. This non-refundable fee will be credited
toward the building permit fees. This fee is based on the estimated job cost. The 2013 Building Permit
Fees can be found on the City's website (www.ci.orono.mn.us) or call 952-249-4600 and request an
estimate of the plan review fees.
F. HARDCOVER INFORMATION AND HARDCOVER CALCULATION WORKSHEET
Hardcover calculations are required for properties identified as Tier 1 through Tier 5 on the Stormwater
Quality Overlay District map or within 1,000 feet of a lake or 300 feet of a creek. See Hardcover
Information starting on page 7.
G. SEPTIC SYSTEMS -
Septic system site evaluation report for proposed new residences within unsewered, rural areas is
required.
New On-site Installation or Addition Required
• For all new construction outside districts served by municipal sewer.
• Any time the existing system is classified non-conforming or when the addition of bedrooms,
installation of mechanical or plumbing equipment, or other factors are likely to affect the system.
Procedure for On-site Installation or Repair
• A State Licensed Designer must perform soil testing and the system design.
• Submit design to City for approval.
• Distribute report to contractors for bidding.

General Information
When planning new home construction or additions to an existing home, both primary and future
drainfield sites must be preserved for the long term use of the property. All setbacks and property lines
must be verified prior to the issuance of a septic system permit.
Once drainfield sites have been verified, snow fencing must be placed, surrounding the sites, to prevent
them from damage. Vehicular traffic, such as cars, trucks, earth moving equipment, etc. could compact
drainfield sites, rendering them unusable, prohibiting the timely completion of the project and/or limit the
long term use of the property. Snow fencing must be in place prior to the issuance of a building permit.
H. ACCESS PERMIT
All applications for structures which require a new driveway access or involve a change in use of an
existing access to a County highway, must be accompanied by an access permit issued by the Hennepin
County Highway Department.
I. WETLAND DELINEATION,WETLAND BUFFER EVALUATION AND BUFFER IMPROVEMENT PLAN
A Minnehaha Creek Watershed District(MCWD) approved wetland delineation is required to be submitted
if there is a wetland on the property. The approved wetland delineation must be shown on the survey
along with the appropriate buffer width and 20' setback from the buffer. Please refer to the City's official
Wetland Overlay District map for buffer width requirements.

J. MINNEHAHA CREEK WATERSHED DISTRICT PERMITS
You are required to contact the Minnehaha Creek Watershed District (MCWD) regarding your proposed
project to determine if your project triggers any of the MCWD permitting requirements. The City of Orono
will not issue a building permit without a copy of the permit from the MCWD or written documentation
stating the proposed project does not trigger any MCWD permitting requirements.
K. COSTS OTHER THAN BUILDING PERMIT FEES
1. Orono Code provides that directly assignable consultants' costs for review of building permit
applications must be paid by the applicant or property owner:
a. City Engineer's costs in excess of$500
b. City Attorney's costs for review of legal questions and documents
c. Other unusual charges for outside consulting services of appraisers, other engineers and
unusual technical reports after notification to the applicant and property owner that such
services are necessary for review of the application.
In making an application, the applicant and/or property owner agrees to pay these costs as they
occur. Failure to make payment may results in the withholding of the permit inspections or certificate
of occupancy and certification to the property taxes of the unpaid balance.
2. An escrow of$2,500 is required. Escrows are required for:
a. New Home Construction
b. Additions
c. New Buildings (Garages, Accessory Structures)
d. Grading Projects
3. An escrow for wetland buffer improvements may be required. The amount will be determined by the
scope of the project.
4. Once a building application is received, the appropriate escrow agreement will be prepared by staff
and sent to the property owner for their signature(s).
K. PERMIT APPLICATION; INFORMATION REQUIRED
1. The application for a construction permit shall include such information as may be required by the
city, which may vary between types of construction projects.
2. Surveys required:
a. Initial survey. The certificate of survey shall conform to the standards on file in the office of
the building official.
b. Foundation survey. The foundation survey will certify lot dimensions; front, side, rear,
lakeshore, and wetland setbacks; and foundation elevation. A foundation survey must be
submitted before proceeding with framing or further construction. In lieu of a survey a letter
prepared by a Minnesota Registered Land Surveyor containing the same information as a
foundation survey may be submitted.
c. As-built survey. The as-built survey shall certify the final topography of the site; verify
drainage patterns; and provide hardcover calculations for lots in the Shoreland Overlay
District. An as-built survey must be approved before the issuance of a certificate of
occupancy. In the event that weather or other conditions prevent the completion of an
as-built survey at the time the Certificate of Occupancy is requested, a temporary
Certificate of Occupancy may be issued upon receipt of a $10,000 financial guarantee
and establish an escrow agreement to ensure completion of the as-built survey and all
site improvements.

The following is required for land use or permit applications: three(3)original, scaled copies of a certificate of survey,
meeting all of the following requirements and a digital copy(or one (1)81/2"x 11"or 11"x 17")for reproduction.
1. All surveys shall be certified by a Minnesota Registered Land Surveyor. Civil engineers may certify topographic
surveys.
2. Permanent iron monuments must be in place at each property corner.
3. Provide a written legal description including all existing easements.
4. Primary and alternate drainfield area corners shall be staked and shown per septic design and tank location
shown.
5. Indicate all proposed buildings with dimensions for each building. Reference dimensions are measured
perpendicular from the front, side and rear lot lines to the nearest point of each building.
6. Indicate the location of all existing and proposed decks, porches, driveways, curb cuts and other accessory
structures.
7. Indicate the total lot area in square feet.
8. Indicate elevations to sea level datum of the top of curb, or if no curb, the edge of the pavement of the street at
points where the side lot lines of the property intersect said street.
9. Indicate proposed elevations to sea level datum of the top of foundation, garage floor, the first floor and lowest
floor at all structure corners. Indicate top and bottom elevations for all walls.
10. Indicate location and elevation of any structures on adjacent properties within 50' of lot lines. For lakeshore
lots, the principal structure on each adjacent lakeshore lot must be shown.
11. Indicate all drainageways, sewer and water mains and services, storm sewers and wetlands within the property
and within 50'of the property.
12. Proposed grading plans should be indicated with directional arrows of proposed surface drainage (1' contours
on lakeshore properties, 2' on all others). The source for all topography must be indicated on the survey.
Provide additional contour intervals as needed in flat areas to show drainage patterns.
13. Existing topographic contours must extend 50' outside of lot lines on all lots.
14. Identify top of bluff and provide bluff analysis with cross-sections.
15. Identify all steep slopes over 12%.
16. Indicate all trees over 6"diameter within proposed disturbance area(s)and within 75'of the OHWL.
17. Reference the Stormwater Quality Overlay District Map and indicate the appropriate Stormwater Quality
Overlay District Tier for the subject property; hardcover calculations required.
18. Indicate wetland boundaries as well as required buffer and buffer setback lines. See: Wetlands & Drainage
Districts map.
19. For property adjacent to lakes, ponds, streams or wetlands, indicate the established high water elevation as

The hardcover allowance for an individual property is identified on Orono's Stormwater Quality Overlay (SQO)
District map on page 5. Each property within the SQO District has been assigned to one of five 'Tiers' within
which a defined percentage of the entire property is allowed to be hardcovered. The percentage of hardcover
allowed within each Tier is shown in the following table:

HARDCOVER IS DEFINED AS FOLLOWS:
Hardcover means a hard surface that prevents or retards entry of water into the soil and causes water to
run off the surface in greater quantities and at an increased rate of flow than prior to development.
Hardcover shall include but not be limited to the following: all building footprints, driveways, sidewalks,
stepping stones, retaining walls, patios, courts (sport, tennis, etc), decks, pools, areas used for the
extended outdoor storage of vehicles or equipment, and all other similar features or surfaces as determined
by the City Engineer or City Planner.
HARDCOVER INCLUDES:
• Roofs • Swimming Pools
• Sidewalks, steps, and patios • Porous or pervious pavement
• Decks, including decks on play • Tennis or Sport Courts
equipment(even if there are gaps • Building Footprints
between the boards) • Any other vehicle, material,
• Driveways, regardless of surface equipment, or structure that
material prevents absorption of rainfall and is
• Tops of retaining walls, including maintained in the same location
boulder walls, and isolated boulders long enough that no vegetation
grows under it.
SURVEYS AND HARDCOVER CALCULATIONS
When a permit is requested for expansion or construction of a structure or hardcover an updated
survey and hardcover calculation worksheet will be required to demonstrate compliance with
hardcover regulations.
VARIANCES
Variances to hardcover standards may be subject to mitigation measures deemed appropriate by
the City Council to offset the impacts generated by the proposed additional hardcover.

HARDCOVER COMPLIANCE
Illegal hardcover may be required to be removed before a building permit is issued. Illegal hardcover is
hardcover in excess of that allowed by a hardcover variance or hardcover in excess of that allowed by the Code
that was added to the property after 1975 or 1992.
OTHER DEFINITIONS
Building Footprint means the outline of the total area covered by a building's perimeter at the ground level (to the
block/foundation).
(1) Carports, covered porches and other similar building features which have no exterior walls shall be
included as part of a building footprint by drawing a straight line between the outer edges of all support
structures (and the main building if applicable).
(2) The outer edge of building protrusions, bay windows or other similar features that extend outward from a
building and are less than four feet from the ground shall be considered as part of the building footprint.
Permeable Lining (landscaping fabric) means a porous material used for weed prevention that allows storm water
to permeate into the ground.
Pervious Paver means concrete, asphalt or similar blocks with holes of some kind that allow water to go through
the surface into a specialized aggregate base—consistent of an open-graded aggregate—and into the soils
below.
Pervious Surface means naturally occurring groundcover or a variety of types of pavement, pavers and other
devices that provide stormwater infiltration while serving as a structural surface.
ASSUMED(INCLUDED)HARDCOVER(CITY CODE SECTION 78-1683)
The following items must be included in hardcover calculations regardless of whether or not they are proposed to
be constructed at the time of a building permit application:
(1) Proof of a two car garage (detached or attached).
(2) A driveway for all garages, a minimum of 12 feet in width subject to the driveway standards listed below.
(3) Minimum dimensions for driveways (see Minimum Driveway Standards illustration herein)
(4) 24 inch wide sidewalk connecting the front door to the driveway
(5) The minimum stairway/landing at all exterior doors as required by the building code
(6) Existing hardcover which encroaches (legally or illegally) onto an adjacent parcel or parcels.
a. In such cases of encroachment, the square footage of all encroaching hardcover shall be added to
the overall hardcover on the subject lot;
b. No credit shall be given towards the overall lot size of the subject lot.
STANDARD HARDCOVER EXCLUSIONS(CITY CODE SECTION 78-1684)
Landscaping with permeable lining shall not be considered hardcover. Additionally, the following hardcover items
shall be excluded from hardcover calculations:
(1) Roads, trails, sidewalks, utilities and other hardcover encroachments intended for the public's benefit;
(2) Hardcover encroachments created by improvements on adjacent property not owned by the subject
landowner;
a. In such cases of encroachment, the square footage of all encroaching hardcover shall not be added
to the overall hardcover counting against the subject lot;
b. The land area upon which the encroachment rests shall count towards the overall lot area for the
subject lot.
(3) Retaining walls;
(4) Handicapped ramps with a pervious surface below; and
(5) The first 100 square feet of pervious paver patios/walkways or the first 100 square feet of deck with a
minimum 1/4 inch spacing between boards and a pervious surface below the decking.

HARDCOVER RESTRICTED WITHIN 75 FEET OF LAKESHORE
Within 75 feet of the Ordinary High Water Level (OHWL) of any lake or tributary, and within any bluff or shore
impact zone, no hardcover shall be placed, located or constructed, except for driveways, stairways, lifts, landings
and lockboxes as regulated by the Shoreland Overlay District.
DRIVEWAY STANDARDS

SHARED DRIVEWAYS
Where one or more properties (referred to as secondary property) gain its driveway access from an adjacent
property (a primary property) by virtue of a driveway easement, the following shall apply:
(1) The portion of the shared driveway on the primary property that serves both primary and secondary
property shall be considered hardcover for the primary property.
(2) That portion of the driveway on the primary property that serves only secondary property shall not be
considered hardcover for either primary or secondary property.

Wetlands perform important environmental, aesthetic and hydrologic functions. In 2005 the City adopted
regulations to ensure that wetlands continue to perform these functions and to improve their functioning (City
Code Sections 78-1601 through 1614). These regulations require the creation and protection of buffers around
wetlands when certain construction or land alteration activities occur. These activities are:
Construction of a new house
OR
Construction or land alterations when all of these conditions exist:
a. The portion of the property disturbed by construction or land alteration activity drains to the wetland
b. The amount of grading exceeds 50 cubic yards or involves the disturbance of more than 5,000 square
feet.
c. There is a net increase in impervious surfaces that drain to the wetland, new impervious surface is
added closer to the wetland than existing impervious surfaces, or there is a change in drainage
patterns that the City Engineer determines will increase the velocity or rate of runoff to the wetland.
The width of the buffer varies from 50 feet to 16.5 feet. A 20 foot setback from the buffer is required for buildings.
If the wetland is on adjacent property but part of the buffer is on the property where construction activity is
occurring, then the buffer must be provided.
Even if the wetland buffer is not required, the buffer and buffer setbacks must be observed.

Steps for Applying for a Land Use Application or Permit
on a Property with a Wetland or Near a Wetland
BEFORE APPLYING FOR A LAND USE APPLICATION OR PERMIT:
1. If you are uncertain if a wetland exists on or near the property or wish to determine the required buffer width,
you may contact Planning staff at 952-249-4620 or email planninq(cr�ci.orono.mn.us. You may also view maps
online at www.ci.orono.mn.us (click Living In or Working In and scroll down to Maps.)
2. If there is a wetland present, determine if your project meets the threshold for requiring a buffer.
a. If your project doesn't meet the threshold but will possibly place buildings and structures within the buffer
or buffer setback, contact Planning staff to determine if wetland delineation is required.
b. If you project meets the threshold, you must obtain a wetland delineation. A wetland delineation must be
done by certified wetland delineator. The City does not do delineations, nor does it recommend
delineators. The Board of Water and Soil Resources (BWSR) maintains a list at their web site
(http://www.bwsr.state.mn.us). Many Surveyors/Civil Engineering firms employ wetland delineators or
have wetland delineators they work with.
3. Submit the wetland delineation to the Minnehaha Creek Watershed District (MCWD) for approval. The
delineator can provide information on this process. Please leave the delineation flags on the property until the
project is complete.
4. Have the approved delineation mapped onto a survey of the property along with the required buffers and
buffer setbacks and the proposed construction. The surveyor must also provide a metes and bounds legal
description of the wetland and the buffer as well as a digital CAD or GIS file in Hennepin County Coordinates.
5. Submit two (2) copies each of the delineation report, the letter of acceptance from the MCWD, and copies of
the survey (with the legal descriptions and digital file) to Planning staff along with a "Request for Wetland
Buffer Evaluation" form. Planning staff will have the City's wetland consultant review the delineation and
make a site visit to evaluate the current condition of the buffer. You will be provided with a copy of the
consultant's report. If improvements are required the report will indicate the amount of the escrow required to
guarantee the improvements and their initial survival.
6. If buffer improvements are required, prepare a plan for the improvements for review by the City. See City
Code Sections 78-1601 through 1614 for more information.
AT THIS POINT YOU MAY APPLY FOR A LAND USE APPLICATION OR PERMIT.
If improvements to the buffer are required, the additional required submittals are:
a. Three (3) copies of the buffer improvement plan
b. An additional copy of the survey
c. Digital CAD or GIS file of the wetland edge and wetland buffer

Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as
set forth in this section.
Subd. 2. Tennessen warning. An individual asked to supply private or confidential data concerning the
individual shall be informed of: (a) the purpose and intended use of the requested data within the collecting
government entity (b) whether he may refuse or is legally required to supply the requested data; (c) any known
consequence arising from his supplying or refusing to supply private or confidential data; and (d) the identity of other
persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an
individual is asked to supply investigative data, pursuant to section 13.82, subdivision 7, to a law enforcement officer.
Subd. 3. Access to data by individual. Upon request to a responsible authority or designee, an individual
shall be informed whether the individual is the subject of stored data on individuals, and whether it is classified as
public, private or confidential. Upon further request, an individual who is the subject of stored private or public data on
individuals shall be shown the data without any charge and, if desired, shall be informed of the content and meaning
of that data. After an individual has been shown the private data and informed of its meaning, the data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional
data on the individual has been collected or created. The responsible authority or designee shall provide copies of
the private or public data upon request by the individual subject of the data. The responsible authority or designee
may require the requesting person to pay the actual costs of making and certifying the copies.
The responsible authority or designee shall comply immediately, if possible, with any request made pursuant
to this subdivision, or within ten days of the date of the request, excluding Saturdays, Sundays and legal holidays, if
immediate compliance is not possible.
Subd. 4. Procedure when data is not accurate or complete. (a) An individual subject of the data may
contest the accuracy or completeness of public or private data. To exercise this right, an individual shall notify in
writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30
days either: (1) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of
inaccurate or incomplete data, including recipients named by the individual; or (2) notify the individual that the
authority believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of
disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of the
Administrative Procedure Act relating to contested cases. Upon receipt of an appeal by an individual, the
commissioner shall, before issuing the order and notice of the contested case hearing required by chapter 14, try to
resolve the dispute through education, conference, conciliation, or persuasion. If the parties consent, the
commissioner may refer to the matter to medication. Following these efforts, the commissioner shall dismiss the
appeal or issue the order and notice of hearing.
(b) Data on individuals that have been successfully challenged by an individual must be completed, corrected,
or destroyed by a government entity without regard to the requirements of section 138.17.
After completing, correcting, or destroying successfully challenged data, a government entity may retain a
copy of the commissioner of administration's order issued under chapter 14 or, if no order were issued, a summary of
the dispute between the parties that does not contain any particulars of the successfully challenged data.
