When I received the attached letter I was surprised and disappointed. C�TYO���:��,,�
I strongly disagree with the Appraised Market Value of$893,000 and will gladly sell the property for a
mere$800,000 and make the purchaser$93,000 richer... anybody interested???
I disagree with the appraisal on three issues:
1�IARK�T VALUE
We have lived in this house for more than thirty years and know that our house wouid never sell for
$893,000 even when prices were higher than they are today.
The public meeting of The Local Board of Appeal indicated that Market Value was based on"comparable
sales data." Is"comparable sales data"available to the public? I would like to see how our Market Value
was deternuned based on specific"comparable sales data."
FAIRNESS
The second issue is based on the premise that every property is valued at close to 100%of Market Value
resulring in every property owner paying their Fair Share. If properties are valued at more than ]00%they
pay more than a fair share and if properties are valued at less than 100%they are paying less than a fair
share. Of course it is impossible to value all properties at 100%but the intent is to value all properties
close to 100%.
I downloaded property tax information from Hennepin County, for three properties in my neighborhood
which indicate that my property is overvalued by a great deal.
All three properties are on two acre lots(estimated)while our properiy is only a half acre,or 25%of
theirs.
All three properties have at least 200 feet(estimated)of lakeshore while our property is only 90 feet wide.
All three houses were built in the last 10 years while ours is over 50 years old.
Their houses are at least twice the size(Mac Mansions)of our 2,000 square foot home.
The three properties face North therefore they have sandy beaches while our south facing property has a
soft mucky bottom due to the prevailing Southerly winds.
One of the houses sold for$2,100,000 in October of 2005 but is only valued at$1,709,000. T'he
explanation given to me at the meeting was that"sometimes people pay too much"for a property. In this
instance"actual sales data"was ignored in favor of"comparable sales data."
If"actual sales data"is ignored or found to be unreliable the appraiser must be making subjective
appraisals based on their opinion of Market Value. The appraiser is making subjective decisions as to
which properties should be used or not used to determine"comparable sales data."
In my experience appraisals and estimates are wrong by definition. Appraisals are a guess by an informed
individual based on their experience and interpretation of the available information. The available
information is"comparable sales data"as used and interpreted by the appraiser.
Another Fairness issue may be the desire to encourage new construction by keeping property taxes low
during construction and then for a several years after the house is completed. That policy makes it difficult
to raise taxes all at once on these expensive houses. This policy is unfair to existing homeowners!
Hennepin County Road 51
Our half acre lot is not really lakeshore property because County Road 51 is between our house and the
lake. The Highway diminishes Market Value for the following reasons:
T'he highway is three lanes wide in front of our house and grass will not grow close to the road because of
all the salt used by the County during the winter. I estimate that the lighway-aad the damaged�-ass is at
least 50 feet wide.
It is dangerous for adults,children and grandchildren to cross the highway or play near the highway. The
speed limit is 35 mph but most cars are going faster.
The highway also encourages people from the Maxwell Bay Public Landing to trespass by fishing along
our shoreline or from our docks. Trespassers also use our docks to pick up and drop off friends that have
parked at the landing: it is too far for boats to go to Maxwell Bay through the channels. This trespassing
causes damage to property and diminishes our Market Value.
In addition to the soft and mucky lake bottom caused by the prevailing Southerly winds the Highway
Department used rip-rap to protect the Highway from erosion. This rip-rap is probably 5 feet wide above
the lakeshore and extends another 5-10 feet underwater. The rip-rap,the Southerly winds, and DNR
regulations prevent us from having a sandy beach.
Other Issues
I have looked at several other properties for sale around the lake and although the market is soft right now I
have not seen half acre lots selling for anyway near$893,000. At the height of the market our property
may have sold for$600,000. I would like to see the"comparable sales data"used to value our property if it
is available.
Cur Esti�nated Markei Vaiue has increased irom$64's,�0u in 2u06,to$746,OU0 in 2007 and$893,U00 in
2008,a 38.88%increase. These increases caused us to pay more than our"fair share"and based on the
above information we will continue to pay more than our"fair share"unless our Estimated Market Value is
brought in line with all other properties.
Based on my neighbors Estimated Market Value of$1,709,000 our property should be valued at no more
than$450,000 based on a ratio of 25%. This is enough of a difference to pursue this further.

If the city of Orono would allow me to subdived my property, I would agree with Mr. Davy,
the value of the 110ft of land without lakeshore is $495, 000 .
Unfortunaetly, this land is not subdividble and does not add $495, 000 in value.
Lin, I have received your letter, dated May 6th, and would ask the local board to reivew
this information and make an adjustment to my land value.
If needed, please let me know what further information you will need to make the land
value adjustment.

I 'am aware that you have 100 feet of lakeshore. The land breakdown for land calculation
is as follows:
Your lot is 210 feet wide with 100 feet of lakeshore and 110 feet without lakeshore. The
100 feet of lakeshore is at $7, 500 per front foot, for $750, 000.
The 110 feet without lakeshore is at $4, 500 per front foot, for $495, 000.
The total value is $1,245, 000 . Due to the negative influences of being on the
corner with traffic as well as the walking trail to the rear, there is a minus 30% to the
value of $1, 245, 000 for $871, 500 ($872, 000) rounded. It is my
opinion that we are treating your land value fairly and that the total value for the
property of $1, 032, 000 is correct and will not change.
