After reiterating that we had a very small and older residence he said he felt even without a structure on our property he felt it was undervalued and said he would not change our vatue nor would he recommend to the Board of Review to change it. I realize that state law requires that values be based on sales in the area. The sale of the property across the street from us was the one that the assessor mentioned during our conversation. I feel there is excessive valuation on the building market value of$95,000. This same issue was raised back in 2002. At that time, appraiser Kevin Wynn toured my house and lowered the building market value from $112,000 to $61,000. This can be seen in a letter dated April 29, 2002 sent to me by Kevin. As I recall he was over 6 feet tall and thankfully he never hit his head on the numerous metal support beams in the basement that are about 5' 9" off the floor. Since 2002, the condition of the house has condition of the house has continued to worsen which would lead to a value of less than $61,000. I talked to one of the inspectors (I do not remember his name), explained the history of the house being overvalued, and invited him to take a tour of the house so I could demonstrate that it is overvalued. He said he did not need to tour the house and the valuation is correct. The following is a list of a few of the problems with the house. This list is larger and conditions have worsened since Kevin toured the house 5 years ago. -Roof Leaks which has caused an area of about 20 square feet of the living room plaster ceiling and walls to fall off(plaster continually falls off throughout the year. -Basement walls and floor continually leak water. This results in the basement floor being wet throughout the year(despite 6 sump pumps). -Entire basement is full of mold and mildew that can be smelled throughout the house. -Red squirrels living in Attic and sometimes getting into the house. -Home foundation moving, causing the bedroom and other walls to crack. -Garage foundation sinking in rear, causing water to run into garage during snowmelt or any rain. -Shed next to house splitting away from house due to foundation moving. -Corner of shed broken off from falling tree limb. -Most of the window frames are rotting. -The Paint is peeling off the exterior of the house. -The shingles are falling off the roof. This property is located in the Stone Bay development where there has been and continues to be major issues which adversely affect the market price of my property including: -- I am in discussions with John Terrence Homes, developer, concerning remediation of wetland violations by JTH that immediately affect my property; -- The subsequent developer, Arnie Zachman, plans to construct a new unit immediately east of my unit, which does not match the initial plans shown to me by JTH. If constructed as proposed by Zachman,the access to my property and the "street appeal" would be substantially diminished; -- Stone Bay as an overall development has, in my view, "stalled"and for purposes of valuation, my unit is in competition with new housing being put on the market by the developer; -- Issues such as the increased water table resulting in a substantial loss of trees in the common areas could adversely affect valuation. In summary, I believe that there should be no increase in valuation this year and that the amount should continue as previously valued at$627,200. As preparation for the Local Board of Review,please find the enclosed data to help you. There is a sumrnary of Local Board duties and responsibilities, a chart listing the amount of assessment growth for Lake Minnetonka communities, and a book of sales with photos and characteristics from a sample of sales throughout the city. Summarv of the 2007 Assessment Each year estimated market values are analyzed along with data from the market. Adjustments, as appropriate for each type of property are made. The results of those adjustments far the 2007 assessment are as fellows: • Residential Lakeshore+ 9.8% • Residential Off Lake + 4.4% There are 3,896 ta�cable parcels in the city with a total market value of approximately $3,060,569,000. This value includes $46,191,000 in new construction improvements. The overall value increase far the City of Orono is 7.2%. LOCAL BOARD OF APPEAL AND EQUALIZATION SUMMARY OF DUTIES AND RESPONSIBILITIES Most of the responsibilities listed under the Local Board of Appeal and Equalization are statutory, primarily found in Minnesota Statutes 274.01. • The first responsibility is attendance. The Local Board of Appeal and Equalization is an official public meeting similar to a City Council meeting and can not convene without a quorum. In addition to the local assessor, the county assessor, or one of his/her assistants is required to attend. • At least one member must be present at each meeting of the Local Board of Appeals and Equalization (beginning in 2006) that has attended an appeals and equalization course as developed and approved by the Commissioner of Revenue. • The valuation notices shall be in writing and be sent by ordinary mail at least ten calendar days before the meeting of the board. The valuation notice will include the . dates, places and times set for the meetings of the Local Board of Appeal and Equalization as well as the Hennepin County Board of Appeal and Equalization. • The meetings must be held between April 1 and May 31 each year. The County Assessor shall fix a day and time when the Local Board of Appeal and Equalization shall meet. The board must complete its work and adjourn within 20 days from the time of convening stated in the notice of the clerk, i.e., calendar days -- original night is day one. • The clerk shall give published and posted notice of the meeting at least ten days before the date of the meeting. • Local Boards of Appeal and Equalization must see that all taxable property is properly assessed, valued, and classified for all current assessments. The board may consider both real and personal property. • If any property has been omitted, the board must correct the assessment by adding it to the list of assessments along with its market value. � The board may not increase or decrease by percentage all assessments in a district of a given class of property. Changes in the aggregate to assessments are by class and are made by the county board of equalization. • Although the Local Board of Appeal and Equalization has the authority to increase or decrease individual assessments, the total of such adjustments must not reduce the aggregate assessment by more than one percent. If the total reductions would lower the aggregate assessments by more than one percent, none of the adjustments may be made. The assessor shall correct any clerical errors or double assessments discovered by the board without regard to the one percent limitation. • The local board does not have the authority to reapen former assessments on which taxes are due and payable. The board only considers assessments in the current year. • The board may find instances of undervalued properties. The board must notify the owner of the property that the value is going to be raised. The property owner may then appear before the board if they so wish. • It is the primary duty of each local board to examine the assessment record to see that all taxable property in the assessment district has been properly placed upon the list and valued by the assessor. The local boards do not have the authority to address exemption issues. Only the county assessor has the authority to exempt property. • A taxpayer may appear in person, by council, or written communication to present his or her objection to the board. The focus of the appeal must center on the factors influencing the estimated market value or classification placed on the property. • All changes will be entered into the assessment books by the county assessor's office. • Before adjourning, the local board should prepare an official list of the changes. The law requires that the changes be listed on a separate form. All assessments that have been increased or decreased should be shown as prescribed on the form along with their market values. The record must be signed and dated by the members of the Local Board of Appeal and Equalization. • The Hennepin County Board of Appeal and Equalization begins meeting on: June 18, 2007 • All appointments must be scheduled no later than Wednesday June 6, 2007 by calling the Hennepin County Taxpayer Services Office at: (612) 348-7050 Alternate Method of Appeal---Open Book Meetinq Open book meetings are an alternative to the Local Board of Appeal and Equalization. During "open book" meetings, the valuation and classification issues are handled by the assessor's staff on a one-on-one basis with the property owner. Typically, open book meetings are held by the county assessor's staff. However, larger cities with an appointed city assessor may hold their own open book meetings. The open book meetings are held in locations that are convenient for property owners. Often open book meetings are held over several days during both day and evening hours. This allows property owners to appeal when it best suits their schedules instead of having to rearrange their schedules to attend a local board meeting held at one place and time. The open book meetings provide a forum for property owners to meet with assessment staff on an informal basis to review information about their property and to ask questions about the assessment. This setting allows the assessor's office to resolve questions and reduce the number of property owners who feel the need to appeal to the County Board of Appeal and Equalization. Property owners do not need to make an appointment to meet with the assessment staff. They can simply show up at the dates and times stated on the Notice of Valuation and Classification, and an appraiser will discuss their assessment. Depending on the jurisdiction, the appraisers may have laptop computers to access information about the taxpayer's property. Some counties may be able to link directly to their computer-assisted mass appraisal (CAMA) system which allows the appraiser to obtain data on sales of comparable properties. When reviewing the details of the property with the owner, the appraiser can verify the accuracy of the county's data and correct any errors. The property owner can also schedule an appointment for the appraiser to view the property if needed. Benefits for the property owner Property owners often find that the open book meeting is less intimidating than presenting their appeal to the Local Board of Appeal and Equalization. They often appreciate the fact that they can have their questions answered in a more private setting, and not have to be apprehensive about making a presen#ation in front of their friends and neighbors. In this one-on-one setting, property owners may spend as much time with the appraiser as they need. They can compare the value of their home with the values of similar homes owned by their neighbors. The process is very efficient because concerns and questions are often resolved immediately. Property owners can see that the appraiser collects the same information on all properties, reassuring them that the process is the same for everyone, and they have not been singled out for a value increase. Property owners who are not satisfied with the "open book" approach may appeal to the County Board of Appeal and Equalization and/or appeal to Tax Court. It is only a recommendation that the property owner attend the open book meeting to discuss concerns prior to the County Board of Appeal and Equalization. In a jurisdiction that does not have a Local Board of Appeal and Equalization, the property owner is not required to attend an open book meeting in order to appeal to the County Board of Appeal and Equalization. Benefits for the local board The benefit for the local board is that an open book meeting saves time for board members. It eliminates the need for the board to become familiar with and educated on the local real estate market. Board members will be able to spend this time concentrating on their other duties as town board or city council members. In addition, board members can avoid confrontational situations with constituents and will no longer be put into difficult situations by having to make decisions about the property values or classifications of property owned by friends and neighbors. Benefits for the county While the number of appeals made at the open book meeting may not be less than the number of appeals to the local board, the benefit for the county is that the open book process allows for immediate consideration of issues, and in many cases, appeals are resolved before the County Board of Appeal and Equalization. The pause will ensure long-term stability and accessibility. Buyer activity finally calmed and Orono ended the year with 115 total closed sales, behind the 2005 figure of Orono by 27.2 percent. Closed sales in the entire Twin Cities region were down 16.3 percent at 47,906 compared to 57,283 in 2005. The decline in sales gave the market a needed breather. Home price appreciation since 1998 has been extraordinarily high and the region was due for a correction. The Twin Cities average sales price in 2006 was $278,462, up 2.2 percent from 2005. In Orono, the 2006 average sales price was $1,037,083, an increase from 2005 by 12.6 percent. The changes in the market during 2006 are often painted in a negative light, but are helping to lay a solid and necessary foundation for the future. A price pause is exactly what our market needs right now ensure continued improvements in housing affordability.An accessible market is a healthy market. Looking at December, home sales in Orono were ahead of last year by 25.0 percent with 10 sales as compared to 8 in 2005. December closed sales were down 17.1 percent in the same period for the entire Twin Cities market. December new listings in Orono were behind December 2005 by 30.0 percent, posting 7 units as compared to 10 units the year previous. The Twin Cities market saw new listings increase by 3.9 percent over last year. At the end of December there were 88 single-family units available on the market in Orono, which should begin to increase in early 2007 as the market remerges from its holiday hibernation. The entire Twin Cities region had 22,834 units available for purchase at the end of the month, considerably from November but still 19.6 percent higher than at the same point in 2005. Homes in Orono took an average of 167 days to reach purchase agreement, while homes in the entire Twin Cities market took 134 days to do the same. Orono had an average sale price in December of$1,691,150, an increase of 164.9 percent from the same time last year. The Twin Cities metropolitan area as a whole saw an average sales price of$285,930 for the month of December, up 2 percent from December 2005. MAAR expects price growth for the entire region to be near 1 percent in 2007. It is important to note that some of the data referenced in this press release is for only one month of activity.As such, the figures can sometimes look extreme due to the relatively small sample size.
