Dear Chief Farniok:
The City of Long Lake is currently seeking Request for Proposal (RFP) responses from
several local police agency service providers for the provision of law enforcement
services in the City of Long Lake beginning January 1, 2011. The City is currently
receiving such services from the City of Orono Police Department. The cities of Long
Lake and Orono have been unable to resolve future police contract funding issues.
Because of this impasse, the Long Lake City Council has unanimously directed staff to
seek other options.
"I'he City of Long Lake is .9 square miles, is surrounded by the City of Orono on all
borders, has an estimated Metropolitan Council population of 1,723, and has a low crime
rate.
The RFP customer requirements include a request for an all-inclusive fixed fee basic
service level in addition to a per patrol hourly fee for supplemental dedicated monthly
patrol hours within the City boundaries. In addition to providing this information,
respondents should also be available to be interviewed by the Long Lake City Council
and staff to describe in detail how policing from your department is operationally planned
to be provided.

LAW ENFORCEMENT SER�'ICES REQUEST FOR PROPOSAL (RFP)
T1�e City� of Lon� Lake desires to eilter into a law enforcement and traffic law enforcement
services Agreement with a police services provider commencing January 1, ?011. The following
customer requirements are requested to be addressed in provider's written response:
1. The initial term of such agreeinent shall be for a period commencing on January 1,
201 l and terminating December 31, 2013. Such three-year term will be"rolling" in
nature in that either party must communicate to the other by August 1�t�' of the current
contract year if tl�ey wish to term inate the agreement by the end of the last(third j year
of the aQreement.
2. The initial provision of services for the years 201 l and 2012 will contain no price
escalators and be fixed in nature. BeQinning in the year 2013, the contracting agency
will specify which price escalator metric wili be utilized. Such metric must be adopted
for followin�year pricing by July 31 s` of the current contract year.
3. The City of Long Lake desires price quotations for two very different types of
services. The first level of service is a fixed priced all-inclusive "basic" level that
would encompass the full ranae of enforcement and administrative support services
excludin� dedicated patrol hours within the City's corporate boundaries. Examples of,
but not a complete listing, of administrative services include pre-employment
background checks, special events, nuisance dogs, animal impounds, liquor and
tobacco license applications, alcohol and tobacco compliance checks, parking
enforcement, and seasonal road restrictions. The City is still evaluating the need for
supplemental dedicated patrol services within the City's corporate boundaries beyond
a basic level of service. Providers should indicate wl�at the hourlti� rate for dedicated
supplemental services would be.
4. Provider sl�all propose a servicin, strateg��that, in their opinion, optimizes public
safet�� services for residents and businesses. This discussion sbould include targeted
response times, achieving a I�eaithy patrol preseuce, and establishing aood public
relations.
�. Discussion of current pro��ider staffing levels and coverage area. Would capacih� to
service Lon� Lake come from existing staff, or would new staff be required?
6. Discussion of current coverage area and how the addition of Long Lake would be
inteQrated into patrolling.
7. The City requests that montlily presentations be made to the City Council regarding
the previous month's activity and any trends or concerns the community should be
aw�are of going for��ard.
8. The City realizes tl�at eacl� a�enc}�responding to this RFP may have its own legal
services a�reement format. Modifications to and changes to the format are anticipated
and will require recommendation for approval from the City Attorney. However, the
customer requirements indicated above�vill be represented in tl�e final aQreement
format.

Staff recommends the following motion:
Move to approve the Request for Praposal (RFP) for Law Enforcement Services and to direct
staff to issue said RrP to selected municipal and county service providers.
Overview / Background
The cities of Long Lake and Orono have been in discussions for most of the past year
concerning changes the Cfty of Orono would like to institute to a Law Enforcement Agreement
that was last formally adopted in 20D3. The changes basically involve both the way police
services are delivered (i.e, from a '�basic and suppiemental"approach to a "service district"
approach); and the way the cost of services are aliocated out to contract cities (i.e, from an
equal weighting of population and market value factors to the addition of calls as a factor
coupled with a reduction in the weighting of the market value factor). While the City of Long
Lake has been supportive of a service district policing approach, the cost implications �f the
proposed change in allocation factors has not been supported by the �ity of Long Lake. These
cost allocation factor changes would have seen Long Lake allocated costs increase (after Orono
'�subsidy'� from a baseline of$302,177 in 2009 to $356,000 in 2012. This would represent a
three-year, $53,8Z3 or 17.8% increase.
Both cities agreed that if contract agreement cost allocation issues could not be mutuaily
resolved by June 1, 2010, that other alternatives would be pursued. It appears unlikely that
outstanding issues will be resolved by June 1, 2010.
Staff recommends approval or"the attached Request for Proposal for Law Enforcement Services.
Staff intends to issue RFP's to the municipal Police Departments of Medina, Orono, and
Wayzata, in addition to the Hennepin County Sheriff's Department. Proposals wiil be accepted
through Friday, June 18, 2010, to be reviewed immediately thereafter. Each law enforcernent
agency responding to the RFP will als� be required to make an interview presentation to the
Long Lake City Council to be conducted prior to July 16, 2010. It is anticipated that the
selection of a law enforcement agency to begin delivery of law enforcement services on January
l, 2011 could be chosen by the first regular City of Long Lake Council meeting in August.

RE: Willowfire Utility Agreement
I drafted a letter to be sent to the Mr. Post and the Long Lake City Council prior to their
meeting on May 18, 2010. The letter identified and refuted the issues raised by Mr.
Post and stated we would be in attendance to further clarify these issues.
However, on Friday morning I received a message from Jessica Loftus saying that
Mayor White had a conversation with Mayor Gilbert and they agreed that Orono
representatives not attend that meeting. Instead, I understand the two mayors arranged
a meeting later in the month to address the water capacity issue.
I then redrafted the letter as a discussion item. The letter has not been sent to Long
Lake officials at this time.

Dear Mr. Post:
This office represents the City of Orono as conflicts counsel with respect to the
negotiation of the Police Services Contract, and I have been asked to review several
questions regarding the above agreement as well. These questions arise both from
your written comments regarding the Orono Comprehensive Plan on April 26, 2010, and
from information which you provided orally to Amanda Novak of CommonBond
Communities. My inquiries are not interposed to take a position for or against the
CommonBond project, but to recognize that this is the first occasion in which the
Willowfire Utility Agreement may be put to use and to further recognize that the
interpretations given to it at this time could have long-lasting implications far beyond this
particular project.
I would like to clarify or discuss the following items:
1. Utility Aqreement Validity. In discussions with Ms Novak of
CommonBond, apparently you have suggested that the Utility Agreement is no longer
enforceable because the members of the City Council have changed since 2002,the
implication being that a subsequent city council may safely decline to honor contract
provisions. While this theory (a current city council cannot bind future city councils) has
some validity on internal city matters such as zoning or special assessment policy,
when the rights of third parties are involved, the concept no longer applies. Contracts,
whether they involved purchasing a squad car or providing sewer capacity, are binding
agreements and require the consent of all parties to make changes.

2. Capacitv in the Water Svstem. You have indicated in your comments
regarding Orono's Comprehensive Plan (your letter of April 26, 2010), that providing
water service to Orono is contingent upon the City of Long Lake determining that it has
sufficient capacity in its water system. First, this contingency on capacity only applies to
selected properties as set forth in Paragraph 5 of the Utility Agreement. Those
properties include the East side of Willow Drive between Watertown Road and the new
Highway 12, the properties in the Hackberry neighborhood and the properties on
Woodhaven Drive. Second, with respect to Outlot A, Willowfire Addition, Paragraph 5 of
the Utility Agreement, provides that the water line constructed by MnDot is available to
serve Outlot A. The Utility Agreement further states that Long Lake agrees to provide
water service to Outlot A. Therefore, it appears that the capacity issue is not relevant to
the providing of water service to Outlot A, Willowfire Addition.
It is true that prov�din� water service to the other selected properties mentioned
in the preceding paragraph is contingent upon sufficient capacity in the Long Lake water
system. However, the Utility Agreement is silent on the question of how the decision is
made on the question of capacity. In the event there is future development in any of the
selected areas, and a request for water services made, the two cities would have to
come to agreement that capacity is lacking. Since this is largely a technical and
engineering matter, a release of the pertinent information by both cities would be a step
in the right direction.
3. Sewer Connection Charqes. The Utility Agreement is straight forward in
that it provides a sewer connection charge of $3,450.00 which includes the metro SAC
charge of $1,200.00. There is no escalator clause for the 350 units of sewer capacity
covered by the Agreement. Any change in the connection charge of $3,450.00 would
require further negotiations between the two Cities.
4. Water Connection Charqe. Paragraph 5 of the Utility Agreement
provides that the connection charge for properties in Outlot A, Willowfire Addition is set
at $2,700.00 per residential property. Again, there is no escalator clause and any
change in that fee would be subject to further negotiations between the two Cities.
The water connection charge provisions for the several selected prcperti�s
outside of Outlot A mentioned in Paragraph 5 of the Agreement for water service,
contain an escalator clause in that the water connection charge for those properties
would be the charge in effect at the time the water connection is made.
Certainly, CommonBond Communities and the City of Long Lake have the right to
negotiate agreements for water and sewer availability for the current proposed project, if
they wish to do so. However, to the extent such agreements vary from the terms of the
Utility Agreement between Long Lake and Orono, they do not set a precedent for future
development of land which may benefit from the Utility Agreement.

• Attached is a summary of permit data from 2007 through Apri127, 2010. The information compares
the number of permits, valuation of projects, and city revenue for all types of permits. There is a
separate section listing only new structure information. Note: Not all permits are based on valuation.
• In February, Orono was awarded$9200 from the Hennepin County 2010 Waste Abatement Incentive
Fund Program to be used for organics recycling. The Organics Committee developed an online
survey to obtain information that will be helpful in determining effective methods to promote
participation in organics recycling. A city-wide postcard mailing announcing the survey was sent on
Thursday. Attached are copies of the Postcard and Organics Survey.
• Ron Steffenhagen received his "return to wark" authorization as of 5/4/10 and is back to work at the
golf course, working in the office.
• The City received the attached letter from Joann Anderson,Mayor of Minnetonka Beach,regarding e-
bikes on the Dakota Rail Regional TraiL Minnetonka Beach plans to coordinate a joint meeting with
neighboring cities and the Three Rivers Park District in the near future.
• The City received the attached letter from the North Tonka Crime Prevention Coalition announcing
their intent to dissolve the organization and donate the remaining funds to the Orono Police
Department. Action to accept the donation will be scheduled for a future Council meeting.
• The City was contacted as a courtesy by the City of Maple Plain recently regarding a request for
temparary signage. Maple Plain has requested permission from MNDoT to place a semi-trailer with a
large sign on the side along the new Highway 12 within the MNDoT right-of-way. The purpose for
the sign would be to let travelers know that Maple Plain businesses are open during the road
construction. As this sign would be in the MNDoT right-of-way, City rules would not apply.
Additionally, we recently observed a similarly warded sign along the westbound(north) side of
Highway 12 just west of the Hwy 12/CR6 interchange. As we are unable to determine if this sign is
located on private property or within MNDoT right-of-way we contacted Maple Plain for more
information. (MC)
• Attached far your information is the May newsletter for the DNR's Shoreland Rules Update Project.
Planning staff is following this process. (MC)
• Gabriel has advised that the Big Island Docks have been installed. (MPG)
• Willie has been warking with property owners on North Farm Road(south of CR 6 east of Brown
Road)toward gaining support for a neighborhood sewer project to serve 8 existing homes. The
neighborhood is in the MUSA, most homes are pre-1985 vintage, and some do not have alternate
septic sites available. Expect more info on this in the next few months. (MPG)
Information Update
May 7, 2010
• The City received notification that it is a recipient of a federal Election Assistance for Individuals
with Disabilities grant in the amount of$9,808. Staff submitted the grant application for automatic
doors at City Hall and the Council Chambers as polling place improvements. Action to accept the
grant and execute the grant contract will be scheduled for a future Council meeting. (RO)
• Mike is warking with Tom Crosby to complete the filing with Hennepin County of the Spring Hill
Golf Club plat and�nal documents, dating back to 1999-2000. The short version of a long story is
that the plat and associated documents were never filed,pending completion of construction of the
golf course and final survey work for the wetland mitigation areas. In the interim, the plat mylars
were on hiatus at the City of Medina for a number of years waiting for signatures (the plat is partly in
Medina) and then sat here waiting for final assembly of filing documents. In now completing that
assembly, it has been determined that certain items were never fully signed by all parties, and Soren
indicates the cleanest way to resolve this is to create new documents,have Council reaffirm them, and
have the current Mayor, Clerk and Spring Hill representatives sign them. Therefore, as a last-minute
addition to Monday's agenda, Mike will be presenting for reaffirmation a Guest House CUP
Resolution adopted by Council in 1999, a Trail Easement Agreement approved in 1999/2000, and a
quit-claim deed to extinguish prior wetland easements that will be re-dedicated via new easements as
part of the plat. We didn't reach the conclusion that reaffirmation was necessary until after the
packets went out today, so you will see these documents Monday night. (MPG)

• Website Update—Following Council approval of the GovOffice software for website redevelopment,
staff worked with the web designer in January and February to prepare the site for redevelopment.
Staff has completed training and is working on updating and rebuilding pages from the current
website to the new website for testing. The existing website has over 40 sections,most of which have
sub-sections within them, consisting of approximately 200 pages. Approximately 20°/o of the
Administration pages have been rebuilt. Planning and Zoning and the Police Departments are also
warking on their sections. The goal is to have the new website "live"in early September.
• Planning Staff inet with Terry Schneider who represents the Klinglehutz property at 2535 &2545
Shadywood Road to discuss a Memory Care facility project for the site. We expect to see an
application fairly soon for a 20-unit building. The site is zoned B-4 (Office)in which nursing homes
are an allowed conditional use.
• Staff(Mike, Melanie, Evelyn, Scott and Tom Kellogg)met with Bob Erickson (Welsh Co), Steve
Johnston and representatives of Ecumen to discuss a Senior Care Project at 875 Wayzata Blvd. It was
a productive meeting and the City should be expecting an application(RPUD rezoning&Concept
Plan approval)by the deadline for the June PC meeting. (MC)

Attorney Dick Shieffer, conflict counsel for Orono, attended the work session. Discussion ensued
regarding the financing alternatives for purchase of the city property for the proposed
CommonBond project and concerns, including utilities, raised by the Long Lake Council regarding the
project.
2. Comments Regarding Information Updates
There were no comments.
3. Other Issues of Current Interest
Status of the Police Services Contract with Long Lake was discussed. It was noted Long Lake intends
to send out Requests for Proposal.
Updating the City logo is moving forward and a local resident will be assisting with the art work.

By means of this letter communication, the City of Long Lake wishes to communicate to
the City of Orono that there is not sufficient capacity in the City of Long Lake water

water connections as well as fire flow safety requirements to development projects within
the City of Orono that would be served by the Long Lake water system.
While previous City of Long Lake comments on this subject were more general in the
context of the City of Orono's 2030 Comprehensive Plan Update and not specific to any
development project. However, although a process for communicating infrastructure
requirements between the two cities for the current CommonBond proposal has not been
evident; there appears to be an assumption on the part of the City of Orono that there is
capacity from the City of Long Lake water system to accommodate this proposed
development. Such an assumption would not be a correct one.

1. CommonBond Discussion
Attorney Dick Shieffer, conflict counsel for Orono, attended the work session. Discussion ensued
regarding the financing alternatives for purchase of the city property for the proposed
CommonBond project and concerns, including utilities, raised by the Long Lake Council regarding the
project.
2. Comments Regarding Information Updates
There were no comments.
3. Other Issues of Current Interest
Status of the Police Services Contract with Long Lake was discussed. It was noted Long Lake intends
to send out Requests for Proposal.
Updating the City logo is moving forward and a focal resident will be assisting with the art work.
