Myrtlewood Road Utility Improvements Project A. Award of Contract to Low Bidder • The summary letter regarding contractor work on the lamestown Road and Farview Road sewer projects and his failure to meet completion dates was discussed. The same contractor is the low bidder for the Myrtlewood project. • The Orono projects may not have been completed on time because the contractor didn't have enough manpower with too many other projects on his schedule. While generally his work and piping in ground was acceptable, site restoration was a major issue. • Kellogg spoke with the contractor and indicated that based on his past performance, the City staff isn't supportive of his work on the Myrtlewood project. He suggested the contractor consider withdrawing his bid. • Staff is planning to hold the assessment hearing at the June 22"d Council meeting and award the bid at same meeting. • The best value procurement method couldn't be used on this project because cities the size of Orono could only use this method for one project this year. • If the low bidder withdraws his bid, the second lowest bidder would be awarded the bid. B. Change Order • As part of the Mn/DOT permit, the pipes in the Mn/DOT right-of-way need to be cased, which adds approximately$20,000 to the project costs. Because Wayzata doesn't want the entrance to their Public Works facility disturbed, it isn't feasible to move the location of the pipes. The County hasn't required casing in their right-of-ways. • Kellogg will continue discussing with Mn/DOT and Hennepin County since the roadway will be taken over by the County in the future. C. Assessment Method for 850 and 875 Wayzata Boulevard • The memo from Mike Gaffron regarding options for assessing the Montessori School and Comforts of Home properties was discussed. � Staff recommends the option to base%of the cost of the project on a 50/50 split and %of the cost on the number of SAC units, which results in Comforts of Home responsible for approximately 2/3 of the cost and the Montessori School responsible for 1/3 of the cost. • Gaffron will be meeting with each of the property owners to discuss the costs to provide water to each of the properties. • The Montessori School will also need to pay SAC units; currently at 5 SAC units and would be about 7 units if he reaches his goal of 100 students. The initial costs for sewer and water for this property could be$60,000-$70,000, and may not be feasible for the owner at this time. • Council directed staff to prepare for the assessment hearing on June 22"d with the costs for extending water to 850 and 875 Wayzata Boulevard West to be based on approximately 2/3 of the cost assessed to Comforts of Home and 1/3 of the cost assessed to the Montessori School. Page 1 of 2 D. Other • Sanitary Sewer Re-routing. Bonestroo will continue to work with Kyle Colvin at Met Council. Kellogg will draft a letter to the MCES. E. Roundabout at Wayzata Boulevard • Kellogg distributed a folder of information. • MnDOT asked for a draft copy of Orono's transportation plan and Gaffron provided the information. Mn/DOT indicated a roundabout at the Wayzata Boulevard intersection doesn't meet warrants. • Council expressed concerns for safety with the left turn at Wayzata Boulevard. 2. Hennepin County Department of Transportation—Request for Letter of Support for Bridge Project • Hennepin County is planning to replace Boy Scout Bridge, north of the Maxwell Bay access, and is looking for a letter of support from the City. • While Council would like to see a higher bridge to accommodate bigger boats,they recognized factors to be considered such as LMCD regulations, bridge approaches, social impacts, and environmental impacts because of the depth of lake. • Council directed staff to include in the letter to the County a request to investigate the potential of raising the height of bridge and, at a minimum, to create a better passage for boats that currently use the passage.The bridge design should be wide enough to accommodate both vehicle and pedestrian traffic. 3. Comp Plan Status • Since individual chapters have already been reviewed by Council,they indicated they did not need to review the entire update prior to distribution. • The Comp Plan update will be put on the website for public review and distributed to neighboring cities to begin the 6 month review period. 4. Other • Dean Johnson of Home Time group has purchased 5 of 7 lots in the Creekside development. The City will not issue building permits until improvements have been completed or secured by another method. • Stonebay residents are exploring whether the City will be a partner with them in accomplishing common area maintenance by assessing the maintenance costs to the individual homeowners or to the association. However, a formal homeowners association can't be formed until a certain threshold of development is completed. The City Attorney indicates a variety of issues that suggest the City should not get involved with their site maintenance in this manner. • A property owner on Stubbs Bay Road along new Highway 12 has talked to his neighbors about noise problems. The neighbors have agreed to share in the cost to help build some type of sound wall. He has been directed to Scott Pederson at Mn/DOT and didn't get a favorable response. This area didn't meet warrants for a sound wall. The change in design of the highway because of the bridge may have also affected placement of sound walls. Unless a 20-30' wall is constructed, it probably won't be helpful. Staff will discuss the issue with the property owner. • The reduction in levy limits to less than 1%was briefly discussed.
