We received a zoning permit application for a minor land alteration and driveway relocation at
the above referenced address. This application is incomplete. Please submit 2 copies of a
revised certificate of survey meeting the enclosed survey standards which should also include
your proposed grading plan in order for our review to continue. The existing and proposed
hardcover and the amount of cut/fill should be calculated by the surveyor as well.
We were recently contacted by the property owner at 3025 Casco Point Road, Scott Standa,
regarding potential modifications to his driveway. In light of the work proposed on or near the
common lot line and relating to the common driveway staff feels it would be more efficient and
appropriate to coordinate the review of both of the applications. However, the Standas have not
submitted an application and I do not know if an application is forthcoming.
Once the revised survey, earthwork calculations and hardcover calculations are submitted we
will proceed with our zoning and engineering department review of the application. If you have

I have reviewed the submitted survey for the removal of existing bituminous and the installation of a berm and have the
following comments:
• The proposed berm will impact the natural drainage of the land but the application does show a 4" pipe to allow
for water to drain through. I have concerns a 4" pipe may not be sufficient to handle the required flow of a 100
yr event or when this pipe is frozen in the spring, if there was enough thought given to where the water will go.
The installation of a berm cannot adversely impact the neighboring property.
• A registered engineer needs to evaluate whether a 4" pipe can sufficiently handle the resulting runoff from a
100yr event and determine if by installing a berm and the pipe is frozen, whether there will be any impact to the
neighboring property.
• What are the top and bottom elevations for the proposed retaining wall?
Without a registered engineer reviewing and signing off that the proposed berm will not result in impacts to the
neighboring property, I will not approve it. It would be my recommendation to grade this area to allow for the water to
pass through it did prior to the removal of the existing bituminous. This area can still be planted as long as the plantings
do not raise the grade which results in the blockage of the existing drainage pattern.

Re: Drainage Evaluation &Recommendations, Hulbert Residence, Orono, MN
As you requested, Vickery Engineering&Consulting, LLC (VEC) has performed an evaluation
of the proposed drainage through the proposed berm being constructed at 3035 Casco Point Road
in Orono, Minnesota. You indicated the City of Orono had requested the proposed berm and
modified drainage paths be evaluated to determine if it is viable or will cause drainage issues
with the neighboring property.
Background Information
A proposed berm is to be constructed between the driveways of 3025 and 3035 Casco Point
Road in Orono,Minnesota. A boulder wall is also going to be constructed on the 3035 side of
the berm Drainage through the berm is proposed by placing a 4-inch solid PVC pipe from the
"upstream" side to the "downstream" side of the berm.
You provided two surveys of the properties that showed the existing conditions on one and the
proposed conditions (new wall and berm) on the other one. The elevation difference between the
two sides of the berm is approximately 1 foot in 9 lineal feet, or 11 percent,based on the
contours shown.
Conclusions and Recommendations
Based on the contributing area of the driveway adjacent to the berm area, the size of the
proposed pipes, and the proposed elevation difference from one side of the berm to another, it is
recommended that a minimum of three of the 4-inch PVC pipes be placed in the berm to allow
drainage. Approximate suggested locations are shown on the attached sketch.
It is recommended that draintile covers be placed over the ends of the pipes to reduce the
potential for animals creating nests in the pipes or other items clogging the pipes. In addition,
the ends of the pipe should be periodically maintained to ensure they are cleared of leaves and
other debris. This maintenance should be performed on an as-needed basis.

should be aware that while the pipes are designed to handle the amount of water from a 100 yr event, they also need to
be maintained to ensure the pipes free of debris, snow, and ice to allow the pipes to maintain the drainage.

Thanks for the update. It is noted on your permit that you must submit an as-built survey showing conformance with the
approved permit plans for final approval. Upon receipt of the as-built survey our engineer will perform a site inspection.

AGREEMENT made this cW day of PC bV'LCR.r , 20j_�), by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Jay Hulbert("Ow ers").
Recitals
1. A zoning permit application has been filed for the property located at 3035 Casco Point Road the
("Subject Property"), legally described as all of Tract A, Registered Land Survey No. 394, Hennepin County
Minnesota, except that part lying Northerly of the following described line: Beginning at the Southeasterly corner
of Tract B in said Registered Land Survey; thence Southwesterly along a line drawn through a point on the Base
line shown on said Registered Land Survey 80 feet Northwesterly from its intersection with the Southeasterly line
of said Tract A to the shore of Lake Minnetonka and there terminating.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,000 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application. The escrow will also guarantee reimbursement to the City for all out-of-
pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be
used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to
public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant
review) associated with permit#2012-01024 if compliance with the approved zoning permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject. y pursuant to Minn. Stat. §§415.01 and 366.012.
