Breitner 2755 Casco Point Rogd Wayzata, Minnesota 55391 Re: Lots 17-18-19, Block 4, Casco Heights Dear Mr. Breitner: Thank you for your letter of February 2 regarding possible purchase of the above noted lots. The City acquired these lots via a tax forfeiture in 1977. They were acquired for park and recreation purposes, according to City Council Resolution #846, but have yet to be developed as a park. The site currently exists as undeveloped open space, just over one-half acre in area. If the City were to conclude it no longer has a need for the property and wanted to dispose of it, it would have to be reconveyed back to Hennepin County for private sale. The normal case would include a stipulation that the land can only be sold for combination with adjoining properties (which would not include your homestead), or the lots would be sold together as a single bulding site. There are a number of factors that suggest it would be in the City's best interest to retain this property. They include, but are not limited to: • A portion of the traveled right-of-way of Casco Point Road is within Lots 17 and 18. • Possible future realignment of Casco Avenue intersection to enter Casco Point Road at a right angle. • Future utility needs. • Future park development. • Maintenance of green space. Public Works Director John Gerhardson has suggested that the City consider a cleanup of the property, and further suggested that you and your neighbors might be interested in an "Adopt a Green Space" program. Breitner February 27, 1995 Page 2 Even if you were able to acquire this property, your proposal to place a garage on it would require a variance, since no accessory structures are allowed on a property that has no principal structure. And, once right-of-way and setbacks are taken into account, that garage would most likely end up on Lot 18, which is across from Putnam's residence rather than yours, making your variance argument weaker. My recommendation at this point is that you contact John Gerhardson directly to discuss methods by which these lots can be maintained in a manner satisfactory to the neighborhood, but it appears they are not available for you to purchase or make use of at this time.
