WHEREAS, Alexander Sohz�ston and Catherine Johnston, (hereinafter "the
applicants } are the owners of the properry located ai 940 Bzown Road South �vithin the City of
Orono (hereinafter "City") and legally described as:
Exhibit A attached, Hennepi.n Counry, Minnesota (hereinafter "pzoperty"); and
WHER�AS, after due published notice ar.d mailed notice in accordance w�ith.
Min.nesota Statutes and the City of Orono Zonizig and PlanniuD Codes, the Orono Planning
Conunission held a public heari.ng o� Vlay :7, 1999, at which times atl persons desiring to be
heard conceming this application were given the opportunity to speak thereon; and
��REA,S,the apglicants have applied to the City for a conditional use permit
to Vlunicipal Zoning Code Section 10.20, Subdivision 3 (G) for a guest house.

1. This application was revietived as Zonin.g File #�248�.
2. The property is located in the RR-1B Zonin.g Dishict, where 2 acres or 87,120 s.f.
� is the minimum lot area. The property eonsists of 9 acres of which 4.55 acres is
dry contiguous.
3. The Planning Cornnussi�n reviewed this application on May 17, 1999 and
recommended approval on a vote of 4 to 0. �

�4. The Plannin� Commission made the following findings of fact:
A. A property is required double the lot area for the zoning district to allow
a guest house. The property is located in the RR-1B, 2 acre zoniug
districi. The subject properly coatains 4.55 acres of dry contiguous
buildable Iand.
g. The use of the barn as a ?uest house w7i1 not exceed the 2 acre per
"dwelling nnit" density.
C. The guest house meets all required principat budtd'zng setbacks.
D. The bazn is 1,664 s.f. quaiifyin� as an oversized accessory structure
requiring a resttictive covenant being recorded on the chain of title.
E. The properry has a noA-confornaing septic system that is scheduled to be
replaced in 1999. Prior to a final plumbing inspection, the septic rnust be
installed and approved by the City.
5. The City Council fmds that granting a condidonal. use permit to allo�v a guest
house wi11 not be detriniental to the health, safety or general weLfaze of the public,
�vould not adversely af�ect Light, air nor pose a fire hazard or other danger to
neigb.boring properties, nor tivill its use depreciate surrounding property values and
that the proposed'level of use of khe property will be in keeging with the intent
and objectives of the Zoning Code aad Comprehensive Plan of the City.
� 6. The City Council has considered this app�ication iacluding the fmdings and
recommendatioas of the Planning Commission, reports by staff a.nd commencs af
the applicant an.d the affect of the pcoposed nse an the health, safety, and �veLfare
of the cornmunity.
C4\`CLUSIONS, ORDE�2. AND CONDITIONS
� Based upon one or more of the flndings noted. above, the Orono City Council
� hereby grants a conditional use pernut per Municipa] Zoning Code Section 10.20, Subdivision
3 (Cr) for a guest house, subject to the following conditions:

1. The property owners file a restrictive covenant on the praperty for an overszzed
acccssozy stcachue and a guest house.
2. The fmal inspection for the plumbing will not be approved before the septic
system has,been replaced and approved. .
3. Authorities granted by this resolution are permissive only and must be exezcised
by application foz a building permit vszthin one year of the date of Council
approval or this conditional use pczmit �rill expire o❑ that,date (May ?4, 200Q).
4. Violation of or non-compliance wit:� any of th�e terms and conditions of this
resolution shall constitute a violation of t�e Zoning Code, shall automatically
terrninate any authority gxanted herein, and shall be punishable as a rnisdemeanor.
5. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby a�ee to the recording of this resolution in the chain of tide of the
property.
