LOCAL GOVERNMENT UNIT DECISION Date of Decision: 11/29/12 �Approved ❑Approved with conditions(include below) ❑Denied �I LGU Findings and Conclusions(attach additional sheets as necessary): A wetland delineation at 1000 Brown Road South in Orono(PID#1011723130001)was performed by Jacobson Environmental on June 13-14,2012. The delineation was reviewed in the field on November 9, 2012 by Minnehaha Creek Watershed District(MCWD)staff. Two wetlands were identified on the property(Wetland 1 and Wetland 3). An area designated Wetland 2 was originally included with the delineation but was determined to be off of the property(just north of the driveway). Both Wetland 1 and Wetland 3 were identified as Type 3 shallow marsh. Wetland 1 is also classified as DNR P�iblic Water Wetland#865W. The boundary&type determinations described above and in the delineation report dated September 29, 2012 are approved by the MCWD. This decision is valid for five years. A project on this property may require a permit from the MCWD. For Replacement Plans using credits from the State Wetland Bank: BWSR Forms 7-1-10 Page 1 of 3 Bank Account# Bank Service Area County Credits Approved for Wifhdrawal(sq.ft.or nearest.O1 acre) Replacement Plan Approval Conditions. In addition to any conditions specified by the LGU, the approval of a Wetland Replacement Plan is conditional upon the following: ❑ Financial Assurance: For project-specific replacement that is not in-advance, a financial ! assurance specif'ied by the LGU must be submitted to the LGU in accordance with MN Rule 8420.0522,Subp. 9(List amount and type in LGU Findings). ❑ Deed Recording: For project-specific replacement, evidence must be provided to the LGU that the BWSR "Declaration of Restrictions and Covenants" and "Consent to Replacement Wetland" forms have been filed with the county recorder's office in which the replacement wetland is located, ❑ Credit Withdrawal: For replacement consisting of wetland bank credits, confirmation that BWSR has withdrawn the credits from the state wetland bank as specified in the approved �replacement plan. . Wetlands may not be impacted until all applicable conditions have been met! LGU Authorized Si ature: Signing and mailing of this completed form to the appropriate recipients in accordance with 8420.0255, Subp. 5 provides notice that a decision was made by the LGU under the Wetland Conservation Act as specified above. Hydric Soi� Indicators for the Midwest Region were noted as presented in the National Technical Committee for Hydric Soils Field lndicators of Hydric Soils in the United States version 7.0(USDA NRCS 2010) if present at each sample point. Also, upper soil profiles were compared to the mapped or inclusionary soi�series found in the sampfe area for soil identification purposes. , Cautions used in applvinq the Field Indicators of Hydric Soils There are hydric soils with morphofogies that are difficult to interpret. These include soils with black, gray, or red parent material; soils with high pH; soils high or low in content of organic matter; recently developed hydric soils, and soils high in iron inputs. In some cases we do not currently have indicafors to assist in the identification of hydric soils in these situations. As long as the soil meets the definition of a hydric soil, the(ack of an indicator does not preclude the soil from being hydric. The indicators were developed mostly to identify the boundary of hydric soil areas and generally work best on the margins. Not all of the obviously wetter hydric soils will be ideniified by the indicators. Redoximorphic features are most likely to occur in soils that cycle between anaerobic{reduced}and aerobic(oxidized)condifians. Morphological features of hydric soils indicate that saturatian and anaerobic conditions have existed under either contemporary or former hydrologic regimes. ' Organic soil materials have organic-carbon contents by weight of 12 to 18 percent or more, depending on the clay content of the soil. These materials include muck(sapric soil material), mucky peat(hemic soil material), and peat(fibric soil material). A2 Histic Epipedon. A histic epipedon underlain by mineral soil material with chroma 2 or less. User Notes: Most histic epipedons are surface horizons 8 inches or more thick of organic soil material. Aquic conditions or artifical drainage is required. A3 Black Histic. At least one of the layers has value of 3 or less and chroma of 1 ar less,or it is muck,mucky peaf, or a mucky modified minerai texture. The remaining layers have chroma of 2 or less. For any sandy material ihat constitutes the layer with value of 3 or less and chroma of 1 or less, at least 70 percent of the visible soil particles must be masked with organic soil material, viewed through a 10x or 95x hand lens. �bserved without a hand lens, fhe particles appear to be close to 100 percent masked. User Notes: Use of this indicator may require assistance from a trained soil scientist with local experience. The minimum organic carbon content of at least one layer of this indicator is slightly less than is required for indicator A7. An undisturbed sample must be observed. Individual strata are dominantly less than 1 inch thick. A hand lens is an excellent tool to aid in the identification of this indicator. Many alluvial soils have stratified iayers at greater depths; these soils do not meet the requirements of this indicator. Observed without a hand lens, the particles appear to be close to 100 percent masked. i User Notes: This indicator often occurs in Mollisols but also applies to soils with umbric epipedons and dark colored ochric epipedons. An example is mucky fine sand, which has at least 5 percent but not more than about 12 percent organic carbon. S3 5 cm Mucky Peat or Peat. A layer of mucky peat or peat 2 inches or more thick with value of 3 or less and chroma of 2 or less, starting within 6 inches of the soil surface, and underlain by sandy soil material. User Notes: Mucky peat(hemic soil material)and peat(fibric soil rnaterial) have a minimum organic carbon content of 12 to 18 percent, depending on the content of clay. Organic soil material is called peat if virtually all of the plant remains are sufficiently intact to permit identification of pfant remains. A layer starting within 6 inches of the soil surface that is at least 4 inches thicEc and has a matrix with 60 percent or more�hroma of 2 or less and 2 percent or more distinct or prominent redox concentrations occurring as soft masses and/or pore linings. lJser Notes:"Distinct"is defined as readily seen but contrasl only moderately with the color to which campared. "ProminenY' is defined as contrasting strongly in color. Redox concentrations include iron and manganese masses(reddish mottles)and pore linings(Vepraskas, 1994). Included within the concept or redox concentrations are iron-manganese bodies occurring as soft masses with diffuse boundaries. This may be a difiicult pattern to recognize and is more evident�vf�en a horizontal slice is observed. F9 Loamy Mucky Mineral. A layer of mucky modified loamy or clayey soil material 4 inches or more thick starfing within 6 inches of the soil surtace. User Notes:"Mucky"is a USDA texture modifier for mineral soils. The content of organic carbon is at least 8 percent bu#can range to as high as 18 percent. The percentage required depends on the clay content of the soil; the higher the clay content,the higher the content of arganic carbon required. An example is mucky sandy loam,which has at least 8 percent organic carbon but not more than about 14 percent. F2 Loamy Gleyed Matrix. A gleyed matrix that occupies 60 percent or more of a fayer starting within 12 inches of the soil surface. User Notes Gley colors are not synonymous with gray colors. They are the colors on the gley colar pages of the MunseJl color book. They have a hue of N, 10Y, 5GY, 10GY, 5C, 10G, 5BG, 10BG, 5B, 106, or 5P6 and value of 4 or more. The gleyed matrix only has to be present within 12 inches of the soil surtace. Soils with gleyed matrices are saturated for periods of a significant duration;as a result, there is no thickness requirement for the layer. F3 Depleted Matrix. A layer that has a depleted matrix with 60 percent or more of chroma 2 or less and that has a minimum thickness of either: • a, 2 inches if the 2 inches is entirely w'rthin the upper 6 'rnches of the soif, or b. 6 inches, starting within 10 inches of the soil surface. User Notes; A depleted matrix requires a value of 4 or more and chroma of 2 or less. Redox concentrations, including soft iron-manganese masses and/or pore linings, are required in soils with matrix c�lors of 4/1, 4/2, or 5/2. A, E, and calcic horizons may have low chromas and high values and may therefore be mistaken for a depleted matrix; however, they are excluded from the concept of depletecf matrix unless the soi! has common or many distinct or prominent redox concentrations occurring as soft masses or pore linings. The low chroma matrix must be the result of wetness and not a weathering or parent material feature. ' User Notes:This is a very common indicator used to delineate wetland soils that have a dark surface layer. f2edox concentrations in mineral soils with a high content of organic matter and a dark surface layer commanly are small and difficu}t to see. The organic matter masks some or all of the concentrations that may be present. Careful examination is required to see what are commonfy brownish redox cancentrations in the darkened materials. If the soil is saturated at the time of sampling, it may be necessary to let it dry to at least a moist condition for redox features to become visible. Soils that are wet because of ponding or have a shallow, perched layer of saturation may have any color below the dark surface. It is recommended that delineakors evaluate the hydrologic source and examine and describe the layer below the dark colored epipedon when applying this indicator. F7 Depleted Dark Surface. Redox depletians with value of 5 or more and chroma of 2 or less in a layer that is at least 4 inches thick, is entireiy within the upper 12 inches of the mineral soil and has: a. matrix value of 3 or less and chroma of 1 or less and 10 percent or more redox depletions, or b. matrix value of 3 or less and chroma of 2 or less and 20 percent or more redox depletions. User Notes: Care should be taken not to mistake mixing of an E or calcic horizon into the surface layer for depletions. The"pieces"of E and calcic horizons are not redox depletions. Knowledge of local conditions is required in areas where E andlor calcic horizons may be present, In soils that are wet because of subsurface saturation, the layer directfy below the dark surface layer should have a depleted or g(eyed matrix. Redox depletions should have associated microsite redox concentrations that occur as Iron pore linings or masses within the depletion(s)or surrounding the depletion(s). F8 Redox Depressions. In closed depressions subjec#to ponding, 5 percent or more distinct or prominent redox concentrations occurring as soft masses or pore linings in a layer that is 2 inches or more thick and is entirefy within the upper 6 inches of the soil. User Notes:This indicator occurs on depressional landforms, such as vernal pools, playa lakes, rainwater basins, "Grady"ponds, and potholes. Wetland Classification � Wetland ciassifications discussed in the fext are set forth in Wetlands and Deepwater Habifats of the I United States(FWS/OBS Publication 79131. Cowardin et al. 1979)and Weflands of the United States (USFWS Circular 39, Shaw and Fredine, 1971.)Addifionafly, plant communify types as named by Eggers and Reed (1998) are given. Topographic maps, National Wetlands Inventory maps, the Web Soif Survey,Aeriai Photographs, and ' DNR Protected Waters maps were consulted to locate potential wetland habitats. The Routine On-site Determination Method was used on this site. In this method, the following procedures were used: 1) The vegetative community was sampled in all present strata to determine whether 50%of the dominant plant species were hydrophytic using the 50120 method. These transects consist of an upland sample point, and a ; wet{and sarr�ple point. Other sample points may be located in areas which have one or more of the ; wetland vegetation, soils, or hydrologic characteristics present, or where questionable conditions exist. � Sample points are marked with orange pin flags with a pink ribbon tied on them. Sample data sheets a�e found in Appendix B. , t Results ; Basin 1 Basin 1 is a PEMC Type 3 shallow marsh comprised of 70% broadleaf cattail, 20%narrowieaf cattail, 5% ' reed canarygrass, 2% lake sedge, and 1%giant goldenrod, along with a few other species. The wetland boundary was typically a transition from common buckthom to broadleai cattail with a topographic break. ' The soils changed from dry Lester soil to saturated Muskego sail in the wetland. Soi!saturation was present in the wetland, and hydrology disappeared in the upland. Basin 1 is DNR Public Water#27- 965W. Basin 3 Basin 3 is a PEMCd Type 3 ditched shallow marsh comprised of 90%narrowleaf cattail, 7% reed canarygrass,and 1°/o giant goldenrod with a few other species. The wetland boundary was typica(ly a transition from Kentucky bluegrass to narrowleaf cattail with a topographic break. The soils changed irom Lester upland soil to Muskega soil in the wetland, Soil saturatian was present in the wetland, and hydrology disappeared in the upland. The National Wetland Inventory Map(NWI)(Figure 2) identifies the large Basin 1 wetland flagged on the subject site. According to the DNR Protected Waters Map (PWI) {Figure 4)of Hennepin County the site has Basin 1 as DNR Public Water#27-965W on the site. Figure S shows the wettands present on-site. Figure 6 is a parcel map of the area. According to the Web Soil Survey(Figure 3)the following hydric soils existed on the parcel: Muskego-Blue Earth-Houghfon soils Phofographs were taken of the site and some are included in Appendix C.
