This property is within the service area of the Stubbs Bay Sewer Project. Your property has been determined to be so substandard in area so as to be considered as a nonbuildable lot. The attached resolution, adopted by the Orono City Council on August 10, 1992, determines that sanitary sewer service will 'not be provided to your property, and accordingly you will not be assessed for the sewer project. Planning & Zoning Administrator MPG/ch TELEPHONE-473-7357 FAX-473-0510 t O O O CITY of ORONO RESOLUTION OF THE CITY COUNCIL �j NO. 3169 �kESH0 A RESOLUTION DETERMINING THAT SANITARY SEWER SERVICE WILL NOT BE PROVIDED TO VACANT PROPERTY LOCATED AT '3320' BAYSIDE ROAD KNOWN AS LOT 9, BLOCK 6, BAYSIDE ADDITION TO LAKE MINNETONKA WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the Stubbs Bay Sewer Project was initiated by the City to solve existing on-site sewage treatment problems in the Stubbs Bay area, within which Lot 9, Block 6, Bayside Addition to Lake Minnetonka, is located; and WHEREAS, the aforementioned Lot 9 is described for tax record purposes as PINS number 05-117-23 14 0047, and is under single separate ownership, not owned in common with any other abutting or nearby property; and WHEREAS, all adjacent lots are occupied; and WHEREAS , the total acreage of the parcel is approximately 0.19 acres, of which approximately 0.09 acres is dry land and 0.10 acres is considered as flood plain area and is transected by a creek; and WHEREAS, the total dry land area of 0.09 acre is extremely substandard as compared to the existing regulation of the LR-lA zoning district requiring 2.0 acres per buildable site; and WHEREAS, said parcel is not buildable without many variances from the existing zoning code; and WHEREAS, construction of a single family residence on the parcel could not be done according to all zoning performance standards of the LR-lA zoning district in which said Lot 9 is located, and therefore would be contrary to the intent of the Community Management Plan; and WHEREAS, said Lot 9 has been valued and assessed for tax purposes at a rate reflecting the non-buildability of the property; and Page 1 of 2 A A F O O O CITY of ORONO tiRESOLUTION OF THE CITY COUNCIL NO. 3169 S140 WHEREAS, said property has been tax delinquent since 1988 and if allowed to go tax forfeit, the City would likely allow its sale only to an adjacent property owner for combination with the adjacent property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono, Minnesota that sewer service will not be provided to Lot 9, Block 6, Bayside Addition to Lake Minnetonka, finding that said lot is too substandard in area to be considered as a buildable site.
