RELEASE OF RESOLUTION
The City of Orono, a Minnesota municipal corporation, (the
"City") hereby releases Lot 1, Block 1, and Outlots A, B, C and
D, Woodhill Ridge 2nd Addition, according to the recorded plat
thereof, Hennepin County, Minnesota, from the obligations
contained in that certain Resolution No. 2263 by the City filed
with the Hennepin County (Minnesota) Recorder on November 19 ,
1987 as Document No. 5348784 .

A RESOLUTION APPROVING THE PLAT OF
WOODHILL RIDGE
ZONING FILE $1163
WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development of
land within the City; and
WHEREAS, the City Council has considered the application for a
plat by John D. McDowell and Woodhill Country Club, a Minnesota Non-profit
Corporation, the subdividers; and
WHEREAS, the subdivision has been found to meet all standards of
the RR-1B zoning district except for Lot 2 which does not meet the required
lot width such hardships, reviewed and approved by the Orono Council in
Orono Resolution 2219 but finding that each lot is of a size and
configuration that will allow its use as a single family residence to be
fully developed without the need of any future variances, and
WHEREAS, the subdivider has completed all requirements of the
platting regulations of the City, including:
1. Completion of all the requirements of Resolution No. 2219.
2. Dedication on the plat of additional right-of-way for a public
road shown as Woodhill Avenue.
3. Creation of a new private road shown on the plat as Outlot A to be
known henceforth as Woodhill Avenue.
4. Concurrent with the creation of this private road, the Subdivider
has dedicated to the City a Road and Utilities Easement granting to
the City permanent access, improvement and utility easements over said
Outlot; the Subdivider has created non-exclusive ingress, egress,
drainage and utility easements over said Outlot in favor of all
abutting and/or benefiting lots including a declaration of certain
maintenance covenants wherein each of the abutting and/or benefiting
lot owners covenants to share in ownership and agrees to permanently
maintain and pay the cost of maintenance for said private road.
5. Dedication to the City of a Flowage and Conservation Easement
providing for limitations on the use of wetlands and a drainageway
described therein and shown on the plat as "drainage easements".

6. xecution of a Subdivider's Agreement providing for installation
of certain improvements as a condition of subdivision approval and the
posting of a letter of credit that will insure completion of these
improvements.
7. Payment to the City of a Park Dedication Fee in the amount of
$1, 000 . 00.
8. Payment to the City for the legal review and filing of the plat
easements and covenants in the amount of $150.00.
9. Payment to the City for the filing fee of the final plat in the
amount of $150.00.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City
of Orono hereby approves the plat of Woodhill Ridge, Hennepin County,
Minnesota, and further grants a variance to the standard that would require
all lots have frontage on a public road with the creation of the private
road and use of a private easement and per Section 10.02, Definition 77,
grants a width variance to Lot 2, subject to the following conditions:
1 . Prior to the issuance of building permits for the new
construction, the gravel road base of the private road must be
installed and approved by the city.
2. Prior to any land alterations, septic test areas on all five lots
must be fenced and protected from any distrubance. Applicant shall
call for an inspection to confirm that fence installation has been
completed.
3. The private road portion of Woodhill Avenue shall be constructed
at a 22 feet minimum paved width providing retaining walls within the
right-of-way where steep topography and sharp cuts into existing banks
require structural support. The applicant and future owners of this
property are advised that if at some future date the City is asked to
maintain this private section of roadway, that such road would have to
be brought up to current City standards; specifically, the use of
retaining walls within public road right-of-way is not acceptable.
4. Woodhill Country Club shall combine Outlot B, Woodhill Ridge with
contiguous properties owned by Woodhill Country Club.
5. Prior to filing the aforesaid plat, the applicant shall complete
the execution of an agreement with the City of Orono that stipulates
applicant's share in the improvement costs for the upgrading of
Woodhill Avenue, that section of road designated as the public road.
( 6. The aforesaid plat shall be filed by the City of Orono with the
Hennepin County Recorder's Office and/or the Registrar of Titles
Office on or before March 28, 1988 together with a certified original
copy of this Resolution and executed copies of specific documents
noted above.

The approval granted by this Resolution shall expire if the plat
has not been filed by the date specified above. In that event, it will be
necessary to file a new application with the City of Orono for subdivision
review.
