HomeMy WebLinkAboutRes 5230 - construction trailer N ` V O : CITY of ORONO 1, ‘,\, % ~. ! ioNk� _, G RESOLUTION OF THE CITY COUNCIL ikEsI304� NO. 5 R 3 0 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO WOODHILL COUNTRY CLUB •FOR A TEMPORARY OFFICE MODULE TRAILER FILE #04-3049 WHEREAS, the City of Orono(hereinafter"the City")is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted zoning and other regulations for the orderly, economic and safe development of land within the City; and WHEREAS, Woodhill Country Club(hereinafter"applicant"or"the Club"),a Minnesota non- profit corporation,is owner of the property addressed as 200 Woodhill Road,a portion of which is located within the City of Orono, such portion being legally described in Exhibit A attached and refenned to hereinafter as "the Property"; and WHEREAS, the applicant has made application to the City for an amendment of its 1968 conditional use permit(CUP)per Municipal Zoning Code Section 78-418(4)to allow the temporary placement and use of a modular office trailer for a period of 9 months during remodeling of the main Club facilities in Wayzata. NOW, THEREFORE,BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File No. 04-3049. 2. The property is located within the RR-1B Single Family Rural Residential Zoning District. 3. The Planning Commission reviewed this application at a public hearing held on September 20,2004 and recommended approval of the temporary trailer placement and use based on the following findings: Page 1 of 5 r g ® 1V' (( 0 CITY of ORONO -3*4110- y►� �Av RESOLUTION OF THE CITY COUNCIL ikkSI304V NO. 5230 A) . Within the RR-1B zoning district,golf courses and country clubs are a permitted use via conditional use permit(CUP). Woodhill Country Club operates under a CUP originally granted by the City on September 13, 1968. B) The proposed temporary placement and use of a modular office trailer during remodeling of the Club's main facilities in Wayzata requires an amendment of the Club's umbrella CUP because it temporarily establishes ause not covered under the existing CUP. C) The trailer will be located along the west side of the "tennis barn", a site approximately 450'from the nearest property bound ary and more than 600'from the nearest residence.Only minor grading will be necessary to establish a level pad for the trailer. D) During the club remodeling,club functions are expected to be reduced to relatively low levels,with minimal food services and office activities operating out ofthe tennis barn and temporary office trailer.It is anticipated there will be no new impacts on neighboring properties as a result of the relocated office activity. E) The trailer is intended to be in place for a period not to exceed 9 months,with removal expected by the end of June 2005. F) The trailer will not have plumbing, as the tennis barn provides this necessity. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings,the City Council of Orono,Minnesota hereby grants to Woodhill Country Club an amendment to its 1968 Conditional Use Permit to allow the temporary placement and use of a modular office trailer for a period of 9 months during remodeling ofthe main Club facilities in Wayzata, subject to the following conditions: 1. The trailer will be required to meet any applicable building code and handicap accessibility standards similar to a construction trailer, and shall not be used as a residence. 2. Authorities granted by this conditional use permit run with the property not with the applicant. 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code,shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicant has read,understood and hereby agrees to the terms of this resolution and on behalf of the applicant and the applicant's heirs,successors and assigns,hereby agrees to the recording of this resolution in the chain of title of the property.
