There are some unique circumstances which Orono has taken into account and which Woodhill does appreciate. Let me enumerate them. The bulk of the Woodhill Country Club property is in the City of Orono, but some of the improvements are in the City of Wayzata, including the main clubhouse building. There is presently a lift pump approximately 800 feet east of Orono Orchard Road. The present users of the sewer system have paid for the pump. The intention of Orono is that if this pump has to be upgraded to accommodate new users in addition to Woodhill, then such new users and Woodhill would bear the expense of the upgrade on a fair basis and the old users would not have to pay for the upgrade. Woodhill anticipates that the installation of the private sewer line from the clubhouse to Russell Avenue will cost about $250,000, which Woodhill will pay entirely. The understanding is that if other users come onto the line at any time, whether before or after Orono takes over the line (if Orono ever does), Woodhill will be entitled to fair contribution from such new users. Woodhill agrees that the sewer line will be a private line but that Woodhill will contract with Orono to maintain the line at Woodhill's cost. LINDQUIST &VENNUM April 30, 1991 Page 2 While Orono will not grant Woodhill a lower rate for sewer service (as used to be common in large users), it will charge Woodhill the same rate as charged for others in this sewer service district. Woodhill understands that the Orono Council sets the sewer service rate annually by resolution. We would like to know what the 1991 sewer rate is. Woodhill would also like a copy of the most recent financial statement for the sewer district which shows the financial condition of the district. Is it correct to assume that the district is self- supporting? That is to say that current revenues exceed or equal current expenses. with a portion of the sewer service charge going into a reserve fund for future maintenance repair and replacement? Woodhill is moving promptly to finish the plans and specifications for the sewer line and will naturally have them approved by John Gerhardson and Glen Cook. If there are any major differences of opinion about the foregoing, we should get together to work them out. Thank you for your anticipated cooperation.
