Dear Mr. Barker,
As requested, Svoboda Ecological Resources (SER) personnel visited the above referenced property on
Oct 13, 2003, to examine the site for the presence of areas meeting wetland criteria. Criteria for
determining jurisdictional wetlands are as described in the 1987 U.S. Army Corps of Engineers
Wetlands Delineation Manual(1987 Manual) as required by the Minnesota Wetland Conservation Act.
The project site is located in a residential area that is moderately forested with the exception of a
wetland basin that exists in the southwest central portion of the property. The topography of the site
contains a steep gradient sloping toward the wetland basin from the east and a moderate gradient
sloping toward the wetland from the west. The wetland basin itself has a relatively flat topography and
continues north and south onto adjacent properties. The project site is bordered by Woodhill Avenue to
the north and east, and private property to the south and vest. The property lies within the NE1/4 of the
SE1/4 of Section 2, Township 117N, Range 23W, City of Orono, Hennepin County, Minnesota
(Figure 1).
METHODS
National Wetland Inventory(NWI)maps, Minnesota Department of Natural Resources (DNR)Public
Waters maps, Soil Survey of Hennepin County, and aerial photographs were reviewed prior to the site
visit to identify areas of concern. Areas illustrating evidence of wetland conditions were examined in
greater detail during the field survey. Vegetation, soils and hydrology were examined (as outlined in the
1987 Manual) and used to characterize wetland types and determine wetland boundaries.
The wetland boundary was marked at the site by blaze-orange"wetland boundary" flagging attached to
4-foot wooden lath. The wetland boundary is considered to be the topographically highest extent of the

wetland basin. It is normally a requirement that areas below the staked boundary meet the three wetland
criteria while areas above should lack one or more of these criteria, however the hydrology of this
wetland has been eliminated due to factors that will be explained in the Results and Discussion section
below. Wetland classification followed methods described by Cowardin et al. (1979) and used in the
NWI completed by the U.S. Fish and Wildlife Service. The Circular 39 classification(Shaw and Fredine
1956) is also given. The indicator status of plants was determined using the National List of Plant
Species That Occur in Wetlands-Minnesota(Reed 1988). Explanation of the plant indicator categories
is provided in Appendix B.
RESULTS AND DISCUSSION
The NWI map (Excelsior Quadrangle) illustrates one wetland complex across much of the southwest
central portion of the subject property (Figure 2). The NWI identified the wetland complex to be of a
Type 3 (PEMC)wetland. The Soil Survey of Hennepin County indicates 2 soil types on the subject
property(Figure 3). These soil types include Hayden loam(Hb C and E), and Marsh(Ma). Of these soil
types, the Marsh is classified as a hydric soil (Hydric Soils of the United States). The DNR Public
Waters Map of Stearns County, Figure 4, does not illustrate any public or protected waters on the
subject.property. Figure 5 illustrates the approximate location of the wetland boundary of Basin 1 on
the subject property.
SER obtained climatological data from the Midwestern Regional Climate Center website for the
N inneapolis/St. Paul International Airport weather station located approximately 19 miles west-
northwest of the project site. Precipitation for the month of October, to the day prior to the site visit
(October 12th), was 0.48 inches, or 0.33 inches below the 30-year(1971-2000) average of 0.81 inches
for the 12-day period. Total precipitation amount that was measured for the year was 21.16 inches at
the time of the site visit, 4.01 inches below the 30-year average(25.17 inches) for the same time period,

Figure 6 illustrates the monthly precipitation for the 12-month period prior to the site visit (October
2002 — September 2003) compared to average monthly precipitation and the WETS 30% upper and
lower limits. WETS is a method of determining the normal range for monthly precipitation required to
assess the climatic characteristics for a geographic area over a representative time period. According to
Figure 6 the St. Minneapolis/St. Paul International Airport weather station recorded 17% of the months
(October 2002 and May 2003) above the WETS Upper 30%Limit, 42% exhibited average precipitation
amounts (February through March, June and September) and 42% of the months (November and
December 2002, January, July and August 2003) exhibited precipitation amounts below the WETS
Lower 30%Limit. Figure 7 illustrates the precipitation deviations from a thirty-year average(1971 —
2001) of 29.41 inches per year. This graph illustrates that precipitation has been below average for two
of the past ten years.
SER personnel examined the subject property for areas meeting jurisdictional wetland criteria during the
site visit and delineated one area as being jurisdictional wetland. Detailed vegetation, soils, and
hydrology data for the wetland are provided in the data sheets of Appendix A. The photo log in
Appendix B further illustrates the conditions present at the site during the time of the site visit.
SER delineated basin 1 as a Palustrine (P-)type wetland exhibiting emergent wetland vegetation
(-EM-)with a seasonally flooded (-C) moisture regime or a Type 3 (PEMCd)wetland.
Upon initial inspection of basin 1 SER determined that wetland hydrology did not exist due to a 10-nch
inside diameter drain tile that was installed by previous property owners(Figure 8). The drain tile itself
was constructed of clay material, which would indicate it was installed possibly 80 to 90 years ago. The
abnormally dry months of July and August may have further contributed to the lack of hydrology. SER
personnel traced the drain tile in an east-west direction(Photos 1 and 2) along the northern edge of the
basin on the subject property. A junction point was found that extends south through the center of the
wetland and north under Woodhill Avenue onto the adjacent property(Photos 3 and 4). The drain tile
was traced further on the adjoining property and was found to extend briefly north and continues
northwest toward the Orono Public Golf Course where it empties into a drainage ditch(Photo 5).
While having the wetland criteria of the soils and vegetation, it presently lacks hydrology due to the
drain tile, which is currently functional. With hydrology lacking due to the presence of the large drain
tile, one of the parameters is missing, thereby creating a non jurisdictional wetland. Local observations
earlier this year indicated that the drain tile suddenly became operational, discharging a large volume of
water downstream causing flooding of the Orono Public Golf Course. This sudden discharge was
reported to the city of Orono and the Minnehaha Creek Watershed District who both sent field staff to
observe the situation. Neither party stated that they had the authority to complete a repair. Therefore
based on the wetlands current conditions as confirmed by the sudden downstream water surge earlier
this year, it is SER's opinion and conclusion, given the lack of hydrology that the,wetland is effectively
drained and is a non-jurisdictional wetland. The presence of hydric soil and hydrophytic vegetation
would indicate that hydrology existed at one time in the recent past and that during a year with normal
rainfall, hydrology would likely return if the drain tile system was removed or closed.

CONCLUSIONS
SER examined the subject property and delineated one wetland, which exhibited a dominance of
hydrophytic vegetation, and hydric soils but lacked wetland hydrology. SER determined that wetland
hydrology existed recently but was eliminated due to the discovered drain tile and the below normal
precipitation conditions that existed this year. Based on this information Basin 1 was determined to be a
non jurisdictional wetland. Although Basin 1 is not a jurisdictional wetland it was still classified as a
Type 3 (PEMCd) wetland due to conditions that existed previously.

conditions in wetlands.
Facultative Wetland (FACW) —Usually occur in wetlands (estimated probability 67% - 99%), but
occasionally found in non-wetlands.
