Dear Mr. Wessels:
This letter will confirm our conversation regarding a bird
feeder partially constructed in the road right-of-way on Woodhill
Avenue.
City ordinrnces do not allow structures in the right-of-way
unless prior written approval is obtained. Also be advised that
ordinances also regulate size and type of structures on private
property. Therefore the "bird feeder" must be removed.

Re: "Birdhouse"
Dear Mrs. Wessels :
On Wednesday, February 27th, the Zoning Department staff
viewed *he birdhouse structure at the end of your driveway. A
review of the zoning code has concluded that this structure would
be treated similar to entry pillars or monuments that homeowners
often construct on either side of the driveway. Such monuments
or structures are limited to 31' in height, and must be within
the boundaries of the lot, not in the public or private roadway.
Your easterly lot line along Woodhill Avenue is considered
as your front lot line. Any fences or rimilar structures within
50' of your front lot line are considered to be within your
required front yard and are ] imited to a height of 31'. Based on
this, your options would appear to be as follows:
1. Move the birdhouse to a point at least 50' back from
your ...asterly lot line; or
2. Move the birdhouse back inside your property boundaries,
and reduce its height to 31' above grade. In this case,
there would be no required setback. It could be just up to,
but not on the property line.
A third option would be to apply for a height variance,
although the cost of such an application would be $175.00, and
even if it were to be granted, which is not a certainty, you
would still be required to move the ctructure out of the road
right-of-way.
