A RESOLUTION
APPROVING THE PLAT OF
MAJESTIC SPRUCE ADDITION
FILE NO. 08-3395
WHEREAS,the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter"City Council")
has adopted subdivision and land development regulations for the orderly, economic and safe
development of land within the City;and
WHEREAS, the City Council has considered the application by William G.
Robinson (hereinafter the"Subdivider") for subdivision of property located at 505 Willow Drive
South and legally described as:Lot 8 Auditor's Subdivision No.229,Hennepin County,Minnesota
(hereinafter"the Property");and -
WHEREAS, on September 22, 2008, the City Council adopted Resolution No.
5771 granting preliminary plat approval for the proposed two lot residential subdivision; and
WHEREAS, the Subdivider has completed the following requirements of the
platting regulations of the City:
1. Payment to the City of final plat review fees and legal review and filing fees.
2. Provision to the City of a title opinion for the Property and certified copies of all recorded
easements currently affecting the Property.

3. Inclusion on the plat of Drainage,and Drainage and Utility Easements and right of way for
Fox Street as required in Resolution No.5771.

WHEREAS,the Subdivider has a
greed to complete the following requirements of �
the platting regulations of the City:

1. Payment of a park dedication fee of$5,550.

2. Payment of a Storm Water Trunk and Drainage fee of$25,600.
3. Execution of a Flowage and Conservation Easement and Restrictive Covenant and
Wetland Buffer for the wetland and wetland buffer within.
4. Providing an escrow agreement and $6,000 escrow to guarantee improvement of the
wetland buffer areas on Lot 2.
5. Execution of a Protective Covenant for Drainfield Sites.
6. Providing an escrow agreement and an escrow equal to 150%of the estimated cost or 1100/0
of the contracted cost to guarantee replacement of the septic system on Lot 2.

7. Completion of any other platting requirements.

NOW, THEREFORE, BE IT RESOLVED that based on the findings of
Resolution No. 5771, the City Council of the City of Orono does hereby approve the plat of
Majestic Spruce Addition, a copy of which is attached as Exhibit A, subject to the following
.conditions:
1. The City Clerk shall release the plat documents for filing only upon certification by the City
! Attorney, City Planner and City Engineer that all requirements of the platting regulations ,
have been satisfied and that the Minnehaha Creek Watershed District has granted
conditional approval of any required permit(s).
2. The aforesaid plat shall be filed with Hennepin County on or before April 20,2009 together !
with a certified original copy of this resolution and executed copies of the easement and
covenants pertinent thereto.
The approval granted by this Resolution shall expire if the conditions of this
Resolution have not been met or the plat has not been filed by the date specified above. In that
event,it will be necessary to file a new application with the City of Orono for subdivision review.
Adopted by the City Council of Orono this 27th day of October,2008.
