A RESOLUTION GRANTING PRELIMINARY
APPROVAL OF A CLASS II SUBDIVISION FOR
PROPERTY LOCATED AT X505 WILLOW DRIVE SOUTH'
FILE NO. 08-3374
WHEREAS, William G. Robinson, a single person, (hereinafter the "Subdivider") on
August 11, 2008, filed a formal subdivision application with the City for approval of a two lot
residential plat of property legally described as Lot 8, Auditor's Subdivision No. 229,
Hennepin County, Minnesota, except road, (hereinafter "the Property"); and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono
Planning Commission held a public hearing on August 18, 2008, at which time all persons
desiring to be heard concerning this application were given the opportunity to speak thereon;
and
WHEREAS, at their regular meeting held on September 22, 2008 the Orono City
Council considered the application of the Subdivider noting the following findings of fact:
1. The property is located within the RR-1B One Family Rural Residential zoning
district requiring a minimum of 2.0 acres of contiguous dry buildable land within each
newly created building lot.
2. The property contains a total of approximately 12.36 acres of land; approximately 3.7
acres of which are delineated wetlands.
3. The proposed plat consists of two residential lots, each meeting the minimum lot
standard requirements of the RR-1B, One Family Rural Residential zoning district.
4. A single family residence currently exists within proposed Lot 2. The subdivision of
the property would not create any violations of zoning code regulations for this house.
The other lot is vacant.
5. Proposed Lot 1 will be served with a septic system and private well. Primary and
alternate septic sites meeting all pertinent standards have been identified for this lot.

6. Lot 2 will continue to be served by a septic system and a private well. The existing
septic system is non-conforming. Primary and alternative septic system sites meeting
all pertinent standards have been identified for this lot.
7. Lot 2 will access from Willow Drive.
8. Lot 1 will access from Fox Street, generally as shown on the grading plan.
NOW, THEREFORE, BE IT RESOLVED, that based on the findings noted above,
the City Council of the City of Orono hereby approves the preliminary plat application of
William G. Robinson per preliminary plat drawings attached as Exhibit A, subject to the
following conditions:
1. The final plat shall include 10 foot drainage and utility easements along perimeter
property boundaries and 5 foot drainage and utility easements along all interior
property boundaries, outside of wetlands.
2. The final plan shall include right of way for Fox Street rather than the easement shown
on the preliminary plat.
3. Subdivider shall execute a Flowage And Conservation Easement And Restrictive
Covenant For Wetland And Wetland Buffer for the wetlands in Lots 1 and 2.
4. Payment of the standard park dedication fee for Lot 1 per the fee schedule in effect at
the time of final plat approval.
5. Payment of standard storm water and drainage trunk fee for the entire plat per the fee
schedule in effect at the time of final plat approval.
6. Subdivider is hereby advised that preliminary subdivision approval will expire on
September 22, 2009, one year from the date of City Council approval. Should the
Subdivider fail to complete the filing of the final plat application within the year
deadline, it shall be necessary for the Subdivider to file a new preliminary subdivision
application with the City.

Final Plat Submittals:
The following list of final submittals must be submitted to the City at least four weeks
prior to the regularly scheduled City Council meeting on the second and fourth Mondays of
the month. These submittals are as follows:
1. Application for Final Plat Approval.
2. Three prints of the proposed final plat,to include:
a. The name of plat.
b. Lot lines platted per the preliminary plat attached as Exhibit A.
c. Drainage and utility easements 10 feet wide along the exterior boundaries of
the plat and 5 feet wide along the internal lot lines, outside the wetlands.
d. Right of way for Fox Street, 33 feet from centerline of traveled road.
e. Drainage easements over the delineated wetlands.
3. Regarding Lot 2:
a. A buffer improvement plan acceptable to the City's wetland consultant.
b. An escrow to guarantee implementation of the plan, amount to be determined
by the City's wetland consultant, to be paid before the plat is filed.
c. An executed buffer escrow agreement.
d. An executed septic system replacement agreement.
4. Legal documents required:
a. Title opinion addressed to the City.
b. Certified copies of all recorded easements currently affecting the property.

c. Signed and executed restrictive covenant for protection of sewage treatment
sites.
d. Signed and executed Flowage and Conservation Easement over the wetlands
and buffer.
5. Fees to be paid:
a. Final plat fee: $250.00,to be paid with application.
b. Legal review and filing fees for subdivision and associated documents:
$280.00,to be paid with application.
c. Park fee: Amount to be determined at time of final plat application, to be paid
before plat is filed.
d. Storm water and drainage truck fee: Amount to be determined at time of final
plat application, to be paid before plat is filed.
6. Stormwater permit or conditional plan approval from the Minnehaha Creek Watershed
District.
To be submitted to the City after plat has been approved by the County Surveyor and
reviewed by the City Engineer but at least one week prior to the City Council meeting:
Record plat drawings in the form of two (2) mylar copies (one copy for the City's
records and one for filing with Hennepin County) and one (1) copy reduced to 1" _
