Re: Constructing a swimming pool at 4550 Wolverton Place without a variance
In response to your letter of October 8, 2015, a read of Section 78-1404 states that an accessory
structures exceeding 1000 square feet are required to meet the following setbacks:
(1) Front, 30 feet minimum and not within the required front yard nor between the front lot
line and the principal structure on the property.
(2) Side, 30 feet minimum and not within the required side yard area.
(3) Rear, 30 feet minimum and not within the required rear yard area.
Section 78-1434 states a Pool, when the basin structure is greater than 1000 square feet, requires
setbacks outlined in 78-1404. Therefore, the measurement of area is the basin structure area only.
Accessory structures in excess of 750 square feet and less than 1000 square feet must be at least 15
feet from any lot line, per 78-1436. Section 78-1405 (6) requires setbacks of 10 feet for pools less
than 750 square feet. A pool meeting the applicable setbacks may be issued.
