GRANT OF PERMANENT EASEMENT
FOR PUBLIC DRAINAGE AND UTILITY PURPOSES
WOLVERTON PLACE,LLC,a Minnesota limited liability company,hereinafter referred
to as"Grantor",in consideration of One Dollar($1.00)and other good and valuable consideration,
the receipt and sufficiency of which is hereby acknowledged,does hereby grant unto the CITY OF
ORONO,a municipal corporation organised under the laws of the State of Minnesota,the Grantee,
hereinafter referred to as the"City",its successors and assigns,forever, a permanent easement for
public drainage and utility purposes over,across,on,under,and through land situated within the
County of Hennepin,State of Minnesota,as described on the attached Exhibit"A"and depicted on
the attached Exhibit"B".
INCLUDING the rights of the City,its contractors,agents, servants,and assigns,to enter
upon the easement premises at all reasonable times to construct,reconstruct,inspect,repair,and
maintain said public drainage and utility systems over, across,on,under, and through the easement
premises,together with the right to grade,level,fill,drain and excavate the easement premises,and
the further right to remove trees,bushes,undergrowth, and other obstructions interfering with the
location,construction,and maintenance of said public drainage and utility systems.

The above named Grantor,its successors and assigns,does covenant with the City,its
successors and assigns,that it is well seized in fee title of the above described easement premises;
that it has the sole right to grant and convey the easement to the City;that there are no unrecorded
interests in the easement premises;and that it will indemnify and hold the City harmless for any
breach of the foregoing covenants.
IN TESTIMONY WHEREOF,the Grantor hereto has signed this easement this

GRANT OF PERMANENT EASEMENT
A 10.00 foot wide permanent easement for public drainage and utility purposes over,under and
across that part of Lot 1, Block 1,FOXFYRE ESTATES, according to the recorded plat thereof,
Hennepin County,Minnesota,the centerline of said easement is described as follows:
Commencing at the northeast corner of the Southwest Quarter of Section 31,Township
118 North,Range 23 West,Hennepin County,Minnesota;thence on an assumed bearing
of South 89 degrees 56 minutes 10 seconds West, along the north line of said Southwest
Quarter, a distance of 538.00 feet to the northeast corner of Lot 1,Block 1, FOXFYRE
ESTATES;thence South 0 degrees 28 minutes 40 seconds West,along the east line of
said Lot 1, a distance of 125.42 feet to the point of beginning of the centerline to be
described;thence South 89 degrees 56 minutes 10 seconds West a distance of 344.07
feet;thence South 0 degrees 28 minutes 40 seconds West a distance of 216.56 feet;
thence South 21 degrees 40 minutes 14 seconds West a distance of 294.49 feet to the
southwesterly line of said Lot 1, and said line there terminating.
The sidelines of said easement are to be prolonged or shortened to terminate at the east line of
said Lot 1 and at the southwesterly line of said Lot 1.
