I know Chris has been working with both the property owners and the contractor by phone, mail and email and I can tell you the interactions have been friendly—at least on our end. For a permit of this type we first look at the submitted plans and then recent aerial photos. This property has wetland on it but the home is far enough away (+150 feet) that it isn't an issue or require delineation. It was not explicit in the application materials or the information in the Street File that the proposed porch is to be constructed over an existing deck. It's not clear from the aerial photo; nor do the building plans or the survey reflect a pre-existing deck. If the pre- existing deck had been shown on the existing survey we would have taken a different approach regarding the survey requirement. The standard building permit escrow amount is $2500. If no grading is involved (i.e. deck post footings) we have a reduced escrow amount of$700 in the Fee Schedule which is applied. The $700 escrow was the amount applied to this permit. The requirement for a refund of the escrow in writing is accurate; however it is actually quite informal. We don't have an"alert" in our permitting software that tells us final inspections etc have been completed. Typically with a new home permit we know the end is near because they are communicating with us about as-built surveys and Certificate of Occupancy. This porch project is small and we are not going to require an as-built survey so we reminded the property owner to request their escrow upon completion of the project. Obviously, it is not our goal to keep the escrow funds. We are nearly ready to issue Ms. Delaney's permit, however there are still 2 outstanding issues. They submitted an email PDF copy of the updated survey showing the porch. This survey is not to scale, but we are able to use it to approve the permit. We do still require submittal of scaled paper copies for the permit and today an earlier version of the survey, which does not reflect the surveyor's drawing of the porch, was dropped at the office instead...(?) Lastly in an October 25th letter, we requested confirmation from the MCWD that they do or do not require permits for this project(as we do with all permits); an email from their staff will suffice. We still have not received confirmation either way. Let me know if I've given you enough information on this or if something needs clarifying. But FYI the city is treating me I'm trying to commit a crime for trying to improve our property! I'm replacing a crummy old deck with a 3 season porch. They asked for a new survey (even though there's an old one on file) fine. $1300 later I provided that. Now they are requiring an escrow account agreement and $700 from me before the permit? Builder(Precision Decks) has never heard of such a thing. They are shocked at what hoops Orono is making me jump through for this. And I have to request "in writing" to get that money back later. So they will keep my money if I don't? Geez. Pretty unfriendly and costly process. I understand that some want to push the limits or break rules. But this is a relatively small project that is replacing an already permitted structure. Shocking. No reply is necessary. I just want you to know how this looks from a(well meaning)taxpayer/homeowner's point of view.
