Your application is incomplete. The following items must be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Wetland Delineation. A Manage 3 wetland exists in the south portion of your property; according to Orono's City Code Chapter 78 Article XI Wetlands Protection, manage 3 wetlands require 16.5' of vegetative buffer. Construction of a pool triggers the administration of the Wetlands Protection regulations. Please submit a wetland delineation report. The wetland delineation must be approved by the Minnehaha Creek Watershed District (MCWD). The delineated edge of the wetland must be shown on the survey, along with the required buffer of 16.5' and 20' structure setback from the buffer. 2. Certificate of Survey. Once the wetland delineation is approved by the MCWD, please provide an updated survey showing the delineated edge of the wetland, including the 16.5' wetland buffer and a 20' structure setback. 3. Escrow & Escrow Agreement. Building permits for structures and involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is $2,500. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for$2,500. The above information is required in order for the plan review to continue. Sales & Marketing Re: ASTM TESTING FOR COVERSTAR AUTOMATIC POOL COVERS From time to time the question arises as to whether all the Coverstar pool covers meet ASTM Safety standards. The answer is yes. There are various requirements that must be met for a safety cover, with the most critical being the requirements as stated in F 1346-91 section 7.1 which requires "Static Load—In the case of a pool with a width or diameter greater than 8 ft (2.4 m)from the periphery, the cover shall be able to hold a weight of 485 lb (220.0 kg) (2 adults and 1 child) to permit a rescue operation". When one sees photos of more than a half a dozen adults standing on the cover within that radius, it is easy to see that the Coverstar cover easily meets that requirement. Our standard automatic cover, the CS1800 was tested and approved as a safety cover both by UL and an independent testing lab. While the test reports specifically refer to the our model CS1800, the same test results apply to the CS200 (which is virtually identical to the CS1800 except that it is used for spa applications). The CS200 uses all of the same components as the CS1800. The fabric, ropes, webbings, leading edge, tracks and power train are exactly the same. In other words, it is the same unit except that some of the mechanism brackets and the rope reel have been cut down slightly to fit in a smaller space. All warning labels and installation instructions are identical for both models of covers. It should be noted that section 7.1.1 which applies to most spas, the weight requirements are only 275 lb. versus for the standard pool cover. If you have any questions, please feel free to call me. While most of the buffer is currently dominated by native willow shrubs and Canada goldenrod, portions on the west have an abundance of Canada thistle. In a few locations, the buffer is dominated by mowed Kentucky bluegrass and other lawn species. Areas with these weedy and invasive species will be killed using Roundup or an equivalent chemical during the month of September. In spring of 2013,the same area will be retreated with Roundup in May to kill all remaining weeds and lawn grass. Dead sod will be removed if necessary to establish a suitable seed bed. In spring 2013 (after Roundup treatment),the area will be hand broadcast seeded with MnDOT Seed mix 350 or an approved equivalent at a rate of 121bs PLS/acre for grasses and 5 lbs PLS/acre for forbs with no fewer than 5 species of each type. A nurse crop seeded at a rate of 20 lbs/acre will also be utilized to discourage weed growth. Seeds will be raked and packed to provide good contact and ensure successful germination. No fertilizer will be utilized. Following seeding, the area will be covered with anchored clean straw at a rate of 1.5 tons/acre. Required erosion control will be utilized as necessary to protect the wetland and buffer during the pool construction activities. At the discretion of the Nicklows, additional native wildflowers may be hand planted within the buffer area. All additional species will be wildflowers native to the region and compatible with the planted seed mix. The Nicklows will contract with a qualified revegetation company to 26105 Wild Rose Lane, Shorewood, Minnesota 55331, Phone: 952-401-8757, Fax: 952-401-8798 complete the described work. That contract will include management services necessary to ensure successful establishment of the buffer area. I reviewed the wetland boundary in the field on August 14, 2012 and agree with the wetland boundary as marked and surveyed. The survey information will suffice in lieu of a full wetland delineation report. 2. MCWD has already been contacted about this project(as the local government unit)and stated that it does not fall under Wetland Conservation Act(WCA)jurisdiction. 3. Because this wetland is not a"native"wetland, it does not have a management level assigned. It is therefore presumed to be a management level 3 wetland. 4. Construction of a swimming pool has the potential to adversely impact the wetland which will trigger the wetland protection ordinance requirements. Therefore,the following should be considered: a. The wetland will require a 16.5 foot buffer. b. Canada thistle and turf grass were found in the wetland buffer area and are considered to be undesirable plant species. The Owner must remove these species from the buffer. In areas where turf is removed native vegetation will need to be established. MnDOT seed mix 350 is a recommended mix for upland buffer areas. c. A Landscape Plan including methods for removal and control of turf grass and Canada thistle and a schedule of native vegetation establishment should be submitted for review. d. Wetland Buffer markers should be placed at the upland boundary of the buffer edge located at lot lines, changes of buffer edge direction and spaced a maximum 100 feet apart. e.
