On May 16 , 1990 , the Zoning, Building and Septic Code reviews were completed. The contractor has informed me that this project is not proceeding and that revised plans may be submitted. This letter is to inform you that since the reviews have been completed, you are liable for the plan review fee of $70.20. Please submit this fee within two (2) weeks. A review of the proposal finds certain zoning code issues which require revision to your plan, in order for a permit to be issued. Municipal Zoning Code Section 10.03, Subdivision 12 reads as follows: Subdivision 12. Crowding Principal Building. No accessory building or structure, unless an integral part of the principal building, shall be erected, altered or moved within 10' of the principal building, nor within 10' of another accessory structure. Your proposed entryway addition and detached garage are proposed to be 4' apart. A 10' separation is required. Simply moving the garage 6' further away from the house would leave a setback of only 7' from the garage to the lot line, where a 10' side setback is required. Moving the garage 6' south and about 16' forward parallel with the house, would eliminate the side setback encroachment, but would place the detached structure in front of the front line of the house, requiring a variance to another zoning code standard which allows no accessory structures between the street and the front line of the house. Angling of the garage away from the house by pivoting it at the northwest corner, still yields a side setback encroachment if the 10 ' garage to entryway setback is maintained. Mr. and Mrs. Nelson's had applied for and received a variance in 1988 to construct an attached garage that would be 21' from the side lot line, where an attached garage would normally have to be 30' from the line. That variance expired in May of 1989. To do the plan as approved at that time would require a variance renewal application. BUILDING&ZONING-473-7357 • ADMINISTRATION&FINANCE-473-7358 • PUBLIC WORKS-473-7359 ASSESSING FAX-473-0510 r - Page 2 Bart Roeglin May 7,1990 I will reiterate that the following requirements apply to a detached garage: 1) must be at least 10 ' from any other structures. 2 ) must be at least 10 ' from the side lot line. 3) must be at least 3 ' from the well. 4 ) must be no closer to the street lot line than the existing house. The standards for an attached garage at this location are significantly different: 1 ) 30 ' side setback required. 2) 3 ' setback from the well. 3 ) 50 ' setback from front and rear lot lines. In either case, no structure, driveways or sidewalks, etc. are allowed within 20 ' of a septic system drain field. The septic system information you submitted is somewhat confusing. The report from Mark Gronberg dated March 29, 1990 suggests that you intend to install the septic system designed in 1989 which crosses the existing driveway and which is not as good a site as that which was tested in 1984. Then, the septic site plan submitted indicates you propose to use the 1984 site. From your Phase I and II site plans, and your proposed garage at the south side of the house, I can only surmise that you intend to not significantly change the driveways. I would note that your building permit application proposes installation of the new septic system. The septic system permit application is a separate permit form, and must be submitted by a licensed septic system contractor. A licensed contractor must obtain the septic system permit and install the system. The City has a list of licensed contractors available. I would recommend that you and the property owners make an appointment to meet with me to discuss the options for your proposed improvements.
