HomeMy WebLinkAboutReso # 6226 (P7 O O CITY of ORONO A A4 RESOLUTION OF THE CITY COUNCIL NO. 6 22 6 A RESOLUTION APPROVING A SUBDIVISION OF A.LOT LINE REARRANGEMENT FILE NO. 13-3598 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, William Pocock Bowman and Cynthia Joan Bowman, a married couple (hereinafter the "Bowmans") are the owners of the property located at 450 Willow Drive South within the City of Orono (hereinafter"City") and legally described as follows: The East 202.86 feet of the West 279.32 feet of the South 115.50 feet of the North Quarter of the Northwest Quarter of the Southwest Quarter of Section 3, Township 117, Range 23, West of the a Principal Meridian, Hennepin County, Minnesota (attached) (hereinafter"the Bowman Parcel"); and WHEREAS, Sowada Willow Property LLC (hereinafter"Sowada") is the owner of the property within the City located at 2300 Willow Hill Drive and legally described as follows: Lot 2, Block 1, Willow Hill, Hennepin County, Minnesota (hereinafter "the Sowada Parcel"); and WHEREAS, Sowada is also the owner of the property within the City legally described Outlot A, Willow Hill, Hennepin County, Minnesota (hereinafter the"Oudot"); and WHEREAS, Bowmans and Sowada have jointly submitted an application for a lot line rearrangement involving the Outlot, the Bowman Parcel and the Sowada Parcel which' would relocate the lot boundary line between the properties; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on the lot line rearrangement on April 15, 2013 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the Orono City Council reviewed the proposed lot line rearrangement at a regular meeting held on May 13, 2013 and makes the following findings with regards to the proposed lot line rearrangement: Page 1 of 3 y O O O CITY of ORONO At RESOLUTION OF THE CITY COUNCIL NO. 6226 G FINDINGS 1. This application was reviewed as Zoning File#13-3598. 2. The existing Outlot contains 0.08 acre in area; the Bowman Parcel contains 0.54 acre in area; and the Sowada Parcel contains 5.42 acres. The application contemplates a lot line rearrangement to split the Outlot and combine the remaining two 0.04 portions with the Bowman Parcel and the Sowada Parcel. 3. Following the lot line rearrangement the Bowman Parcel will be 0.58 acre in area, and the Sowada Parcel will be 5.46 acres in area. 4. By definition the Outiot cannot be built upon without a future re-plat to make it a Lot. This proposed lot line rearrangement to split the Outiot and attach the pieces to the Bowman Parcel and the Sowada Parcel does not change the unbuildable status of the resulting outiot parcels. 5. Because this is a lot line rearrangement which results in no additional lots, no park fee or stormwater trunk fee will be required. 6. Dedication of drainage and utility easements are not required as this is not a new plat. 7. The proposed lot line rearrangement will not result in making any of the structures on either property non-conforming. CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants the lot line rearrangement of the above referenced properties based on the lot line rearrangement survey dated 11/01/2012 by Gronberg and Associates, Inc., attached as Exhibit A, subject to the following conditions: 1. Bowmans and Sowada shall file the appropriate deeds reflecting the new legal descriptions (subject to City Attorney approval) with the Hennepin County Recorder's Office and/or Registrar of Titles Office on or before May 13, 2014, or the approval granted by this resolution shall expire.
