I agree with your assessment that it is likely the deck(s) will meet the required rear setback with the addition of the 15 foot portion of Outlot A. However, the new property area and new property line will need to be shown on a survey for clarification and permit issuance. Regarding the south side setback, your house exists at a 25 foot setback with a variance. Any new structure, additions or improvements to the house/property which do not meet the required setbacks cannot be approved administratively, even if they are in line with the existing home. A variance would be necessary. I am still a bit confused though. The addition of 15 ft of outlot A allows space for the rear set back as the deck is only 16' deep. We will have 69 ft which is about 53 ft from deck to the rear lot line. The south side of the deck lines up with the south side of the house and we already had the set back variance approved at 25 ft. I would think that Mark Gronberg should be able to provide you with the survey reflecting only your property for less than $700 — but admittedly I don't know his pricing. And as new structure to be added to the lot, the proposed decks should technically be shown on the survey... I apologize if you were given conflicting information. Further, as I eluded to in my letter, I think that potentially the southern deck will need a variance if proposed in the location where it appears to be proposed from the submitted deck plans. 1 You are correct in that we are still holding the $2500 from the lot line rearrangement. Additional escrow funds would not necessary if we continue to hold that escrow. However once we receive the recorded documents as requested for the lot line rearrangement your current escrow of$2500 would be refunded —or we could do a partial refund. To be honest, the escrow money has the lowest priority for this application; the important part for our review is the updated survey reflecting the current lot configuration/area. Are you kidding that I need to have a survey done? I just spent $800 for a survey for the lot line rearrangement. Did you guys add a room to City Hall for Bowman surveys and not tell me? When I filed for my deck permit I asked if I needed a survey, Monica asked Lyle and he said no. Can I just use the recent survey? Cripes, we aren't made of money. Another survey and $700 escrow and you already have $2,500 of our money in escrow. I won't have any money left to build our deck! Please help! All we want to do is add a simple deck.
