Melanie,
I have reviewed the permit application and will sign the permit, but I have concerns regarding the property:
1. The survey does not address 2 of 3 of my comments from September 14. No erosion control was ever shown on
the survey, and the top and bottom elevations of the propose retaining wall was not shown. It appears the wall
will be under 4' in height, but if the wall exceeds 4' the applicant will need to submit engineered plans and
specifications signed by a registered professional engineer.
2. The survey does not accurately reflect the site conditions. There is an existing patio and fire pit (see attached
photo)which is not shown on the survey). Both of these things need to be included in the as-built survey.
Furthermore the fire pit may be located within the drainage and utility easement or within the wetland
delineation boundary or buffer area for the wetland. There are no records of a permit being pulled for either
the patio or the fire pit, but there is aerial photographic evidence both were installed sometime between 2009
and present.
If a permit was obtained through the City, it would not have been allowed to be installed within the utility and
drainage easement or within the delineated boundary of a wetland. If the fire pit falls within the 2012
delineated wetland boundary, it will be required to be removed from the wetland and relocated outside of the
drainage and utility easement. If it is only located within the drainage and utility easement the City will allow it
to remain in place with the understanding if grading or utility work is needed in this area,the homeowner is
required to remove the fire pit out of the easement area. All costs associated with this work is the responsibility
of the homeowner.
Prior to the release of the escrow,the applicant will need to provide an accurate as-built of the entire site
including the location of the fire pit. If the fire pit is located within the delineated wetland boundary,the fire pit
will need to be removed prior to the release of the escrow amount. If the fire pit is only located within the
drainage and utility easement,the applicant will need to obtain an easement encroachment permit with the City
prior to release of the escrow.

As requested, we have reviewed the Vegetation Management Plan for 950 Willow View Drive. We offer the
following observations, comments and recommendations for your consideration.
1. The Vegetation Management Plan received on September 19, 2012 is acceptable as proposed.
2. The buffer management plan does not indicate a timeline for vegetation establishment. A minimum of
3 years should be anticipated for the proper establishment of the buffer.

Vegetation Management Plan
The following is the proposed vegetation management plan for the wetland buffer at 950
Willow View Drive, Orono,MN
Project Goals & Objectives
The goal of the project is to remove the areas of manicured lawn dominated by Kentucky
blue grass so as to provide a natural wetlands buffer free from invasive plants.
Site Preparation
• Areas of manicured lawn dominated by Kentucky blue grass will be removed
through spray treatment of Roundup Originalmax in specified area. The site will
be prepared by agitating and loosening the soil to a minimum depth of 3 inches
for seeding in the buffer area.
• Areas of invasive or exotic species, such as Canadian thistle will be spot sprayed
using Roundup Originalmax herbicide as per manufacturer's directions.
• Site preparation and seeding to be completed by the end of September 2012.
Seed Mixes and Plant Materials
• MnDOT seed mix 350 will be used to seed the buffer area as this seed mix is
recommended for upland buffer areas.
• Seed will be applied either by drop seeding or broadcast seeding.
Timing of seeding and other planting activities identified Vegetation Maintenance&
Schedule of Activities
• Re-seeding and over-seeding to occur early each spring and late fall until full
sustainable natural buffer has taken root
• Annual removal of invasive plants and spot treatment of invasive species to occur
annually or as more or less frequently as recommended by Prairie Restoration,
Inc. or such other qualified firm.

Our engineer reviewed the survey dated 8-27-12. His comments are included below. We need the survey to be revised
to reflect the wetland edge as determined by Arrowhead Environmental on June 25, 2012. The 16.5' buffer and the 20'
structure setback should be added. The other comments from our engineer should be addressed also. I sent your
vegetative buffer plan to our wetland specialist for approval. We will review your permit request based on the revised
survey with the above information.
Wetland delineation approval from the Minnehaha Creek Watershed District (MCWD) is required before the wetland
buffer escrow is returned, if approval is not received prior to our permit issuance. If the MCWD makes changes to the
delineated edge,the changes will also need to be made on your property and on the survey before the wetland buffer
escrow is returned.

I have reviewed the permit for the proposed sport court and have the following comments:
• The survey shows the wetland edge and buffer area "as shown on grading plan dated 4-7-00". I am fine with the
wetland boundary shown like this, but the buffer edge seems to have changed since 00 and should be reflective

As requested,we have reviewed the wetland boundary and buffer area at 950 Willow View Drive. We offer
the following observations,comments and recommendations for your consideration.
1. I reviewed the wetland delineation report on September 10,2012 and agree with the wetland boundary
as marked. However, final approval of the wetland boundary is the responsibility of Minnehaha Creek
Watershed District(MCWD). A copy of any permits and approvals required from MCWD should be
submitted to the City prior to any land disturbing activities.
2. The proposed construction has the potential to adversely impact the wetland which will trigger the
wetland protection ordinance requirements.Therefore,the following should be considered:
a. This wetland is listed as a"management 3"wetland in the MCWD's Functional Assessment
of Wetlands inventory,which requires a 16.5 foot buffer per City code.
b. The wetland delineation report indicated that the buffer area is"manicured lawn dominated by
Kentucky blue grass." The area of manicured lawn within the buffer area must be removed
and native vegetation will need to be established in its place. MnDOT seed mix 350 is
recommended for upland buffer areas. A Vegetation Management Plan, including methods
for removal and control of any invasive plants and a schedule of native vegetation
establishment, should be submitted for review.
c. Wetland Buffer markers should be placed at the upland boundary of the buffer edge located at
lot lines and changes of buffer edge direction and spaced a maximum 200 feet apart.
d. A $2,000 escrow should be submitted by the Owner to cover the cost of buffer development if
not completed by the applicant.

Hi Alyssa,
Our wetland specialist has reviewed the wetland edge and buffer. I have attached his comments. We know
the MCWD already stated this project doesn't trigger their requirements, so don't worry about that comment.
Please submit a plan for the wetland buffer establishment, see 2b. Once the plan is submitted, I will submit it
to our wetland specialist for approval. I'm continuing to move this application through our other departments
for their review. My hope would be by the time your buffer plan is submitted and approved, the permit will be
ready to issue.
A requirement of the wetland buffer establishment, is a wetland buffer escrow and escrow agreement. Also,
attached is a wetland buffer escrow agreement. Please sign and submit with a $2,000 check. We will deposit
the check and hold the funds until the new buffer area is established. Our wetland specialist will revisit the site
after a growing season to verify it's in compliance with the approved plan you've submitted.
The wetland buffer escrow is held in addition to the building permit escrow you've already submitted. Once the
building permit is finalized and an as-built survey is submitted and approved, send me an email requesting
your building permit escrow to be refunded. The building permit escrow can be refunded after I verify there are
no outstanding, unpaid pass-through engineering bills.
The wetland buffer escrow is also refunded once it's established and approved and I verify there are no
outstanding, unpaid pass-through engineering bills.

The property at 950 Willow View Drive, permit#2012-00424 is proposing a sport court. This project does not
trigger the MCWD requirements so they did not require a wetland delineation. The attached partial copy of
the survey shows the delineation edge and buffer from 2000 when the subdivision was created. The property
owners have also had Arrowhead Environmental Consulting permit a delineation which is not depicted on the
survey.
The wetland edge and buffer are marked on the property. Please visit the site and advise if the buffer meets

As we discussed during our meeting at your property, a wetland delineation was performed throughout the entire
Willow View development for the subdivision permit in 2000(MCWD permit#00-024). The wetland on your property
was expanded and re-graded as part of the developer's wetland replacement plan, and a 16.5' buffer was incorporated
along the wetland boundary (see attached plan). If your current project triggered the need for a MCWD permit, we
would just have you add the original wetland boundary and buffer as required for the development permit onto your
current survey rather than have you perform a new delineation. Even if the wetland boundary changes from when it
was originally delineated,the 16.5' buffer does not move with the boundary, and is shown on the attached plan. While
a field delineation reflects the most accurate and current wetland boundary,for the purposes of consistency throughout
the development (and logistics relating to buffer layout, etc.), this is how we would handle it.

The City is in receipt of your building permit application which was received by this office on May 17, 2012.
Staff has identified a wetland on the property which is classified as a Manage 3 and requires a 16.5' buffer
and a 20' structure setback. After a cursory review your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete
and for the plan review to continue:
1. Wetland Delineation. Please have a wetland delineation performed on the wetland on your
property. The wetland delineation must be submitted to and approved by the Minnehaha Creek
Watershed District (MCWD). After the MCWD approves the delineation, the delineated edge of the
wetland must be shown on the survey, along with the required buffer and structure setback.
2. Certificate of Survey. Once the wetland delineation has been approved by the MCWD please
update the survey with the new information and submit two copies.
3. Plans. Please submit two sets of plans pertaining to the sport court construction.
4. Escrow & Escrow Agreement. Building permits involving grading and/or review by the City's
engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to
guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans.
Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion
control and stormwater. The required escrow amount for this project is $2,500. The escrow
agreement is enclosed. The property owner must sign the escrow agreement and submit a check
for$2,500.
Additionally, the City's wetland regulations and wetland buffer requirements may be triggered by the project.
Please review the enclosed information sheet regarding Construction near a Wetland and following the
instructions provided. The above information is required in order for the plan review to continue. Please feel

Project Overview
On June 7, 2012 Arrowhead Environmental Consulting (AEC) performed a wetland
delineation at the 950 Willow View Drive Property located in Orono, MN.
• One wetland basin was delineated within the parcel bounds; Wetland 1 is a
Shallow Marsh located in the eastern portion of the parcel.
• Wetland 1 is indicated on the NWI map as a PEMC wetland.
• Wetland 1 is not indicated on the Minnesota Department of Natural Resources
Public Water Inventory Map.
• Wetland 1 is mapped in the Cordova and Hamel soil series.
• Wetland 1 is dominated by Canada bluejoint, reed canary grass, sedges, rushes,
and cattail with scattered willow and dogwood shrubs.
• The wetland boundary was generally placed along the vegetative transition from
hydrophytic to non-hydrophytic vegetation (which correlated to a rise in
topography), and the presence or lack of hydrology indicators.
Introduction
On June 7, 2012 Arrowhead Environmental Consulting (AEC) performed a wetland
delineation at the 950 Willow View Drive Property located in Orono, MN. The legal
description of the project location is: A part of the SE '/ of Section 28, T118N, R23W,
Hennepin County, Orono, Minnesota. The parcel is a total of 1.16 acres (according to the
Hennepin County Website).
Methods
AEC utilized the 1987 US Army Corps of Engineers Wetlands Delineation Manual and
Midwest Regional Supplement to perform the wetland delineation. A United States
Geological Survey (USGS) Map (Excelsior Quad) (Figure 1), the Minnesota Department
of Natural Resources (MN DNR) Public Water Inventory (PWI) Map (Figure 2), the
Hennepin County Soil Survey Map (Figure 3), and the National Wetland Inventory
(NWI) Map (Figure 4) were reviewed prior to the site visit and used in the delineation
process. The delineated wetland boundaries (GPS located) are indicated on Figure 5 and
are overlaid on a 2010 aerial image. Figure 6 shows the Minnehaha Creek Watershed
District Functional Assessment Map; the wetland in question is considered a "Manage 3"
wetland under the Districts classification system. AEC used the routine delineation
method.
Wetland classification followed methods described by the USACOE - St. Paul District;
Eggers and Reed "Wetland Plants and Plant Communities of MN and WI". The Circular
39 and Cowardin et al. classifications are given as well. The indicator status of plants
was determined using the National List of Plant Species That Occur in Wetlands —
Region 3 (Sabine 1999). In accordance with the Midwest Regional Supplement, the +
and—have been removed from the vegetation indicator status.
Pink pinflags were used to delineate the wetlands and were numbered sequentially;
flagging was hung from adjacent vegetation to aid in location of the pinflags. Sample
points were taken to document the vegetation, soils, and hydrology indicators within
representative upland and wetland locations.
Results
Office Results
Wetland 1 is indicated on the NWI map as a PEMC wetland. The delineated wetland is
located in the Cordova and Hamel soil series. The Cordova and Hamel soil series are
classified as hydric soils (SCS Hydric Soils of the United States). Wetland 1 is not
indicated on the Minnesota Department of Natural Resources Public Water Inventory
Map(PWI).

Field Results
Wetland 1
AEC classified Wetland 1 as a Shallow Marsh (Type 3, PEMF) wetland. Wetland 1 is
dominated by Canada bluejoint (Calamagrostis canadensis), reed canary grass (Phalaris
arundinacea), sedge (Carex) species, rush (Scirpus) species, path rush (Juncus tenuis)
and narrow-leaved cattail (Typha angustifolia) with scattered willow (Salix) and
dogwood (Cornus) species along the fringe of the basin. The adjacent upland area is
manicured lawn dominated by Kentucky blue grass(Poa pratensis).
The boundary for Wetland 1 exhibited a rather abrupt transition; the wetland boundary
was generally placed along the transition from reed canary grass, path rush, and Canada
bluejoint(hydrophytic vegetation)to the manicured lawn.
The wetland soil boring met the F2 (Loamy Gleyed matrix) hydric soil indicator. Water
was observed within 7" of the soil surface with saturation observed at the soil surface at
the wetland sample point. The upland soil boring did not meet a hydric soil indicator,
non-hydrophytic vegetation was dominant and hydrology indicators were not met. It
appears that several wetlands in the area were excavated and expanded during the
construction of the housing development.
Discussion
One wetland basin was delineated within the parcel bounds. Areas delineated as wetland
met the three criteria required for a wetland delineation; dominance of hydrophytic
vegetation, presence of hydric soil, and (at a minimum) one primary hydrology indicator
or two secondary hydrology indicators under normal conditions.
In order to be official the wetland delineation must be reviewed and approved by the
Local Government Unit (LGU) and potentially other agencies (Local, State, Federal).
Any work within or adjacent to a wetland will require Wetland Conservation Act (WCA)
permits (and potentially other permits). Please consult with AEC if you plan on filling,
draining, excavating wetlands within your project location.
