I have attached the declaration from the subdivision and larger plan showing the 25' buffers that are declared to the property more clearly. I told the applicant, David Marquis,that a level 1 delineation would be adequate to determine if the wetland has moved. After review, MCWD staff have determined that the delineation submitted on July 25th, 2016 is consistent with the delineation conducted for MCWD permit 00-024:Willow View Subdivision. 2 I will be sending out the NOA on Monday if your rule/ordinance requires a NOD, I just wanted to gain clarity. The property currently has 16' buffers(please note I previously stated they were 25' buffers)declared to the parcel. I did not forget about you. I believe I can get the proper information from the MCWD regarding the delineation that we discussed. The new delineation line will have to be shown on the revised survey or the site plan. Let's resolve the below to determine how to proceed. I pulled the existing information from the file for 885 Willow View Dr. There is a survey showing the"proposed"house from 2000 in the file. We subsequently issued a permit for the pool in 2003 using that proposed survey and a sketch of the pool location. Our permitting site plan/survey submittal requirements have evolved to be a bit more stringent since 2003. We may be able to use the 2000 survey if the current project meets the following: The certification of the plan by a licensed professional may be exempted by the city engineer if the project meets all of the following (my notes are in bold): 1. An existing survey accurately describes existing property conditions; (this may be met but is tentative at this point.) 2. Proposed project exceeds the setback requirements by 150%; (will need to be determined) 3. Proposed project footprint does not exceed 200 square feet; (will need to be determined—how large is the new portion of the deck,etc to be constructed?) 4. Evidence that the Average Lake Shore setback is met is provided, and (Not applicable) 5. Information necessary to ensure the project conforms to city codes and ordinances, including hardcover, grading, and landscaping requirements is provided. This Level 1 delineation was requested by the Minnehaha Creek Watershed District (MCWD) and will be reviewed internally in accordance with the MCWD Wetland Protection Rule. Off-Site Review The Level 1 review consisted of an initial examination of the following mapping resources and data to determine the potential presence and location of aquatic resources (see attached Figure 2): • Topography(2-foot LiDAR derived contours) • Soils Map • National Wetlands Inventory • Public Waters Inventory • Current&Historic Aerial Photographs Field Visit Following the office review, a field visit was completed and the approximate boundaries of two wetlands were identified and delineated in the field, as depicted in detail on the attached Figure 3 and summarized in the below table. The approximate boundaries were marked in the field with pink pin flags and located utilizing a Trimble Geo XH sub-meter GPS unit.
