Melanie&Tom, I have been advised that the City approved the revisions proposed for the rain garden outflow by
Anderson Engineering in the drawings dated Nov 16,2009. WJM Properties has accepted the proposed revisions as an
adequate response to issues raised in my earlier letters. I have advised Mr. Engel that completion of the additional work
will settle the matter. A copy of my letter is attached.

Dear Mr. Engel:
The engineering design drawings provided by your engineer dated November 16, 2009 have
been reviewed and by this letter I am confirming that completion of the work described by
Anderson Engineering will be considered a satisfactory response to the issues raised in my
previous letters. You've indicated to me that the grouting of the riprap will be completed this fall
if possible. That work will establish and achieve the design overflow elevation of 1021.2. The
removal of a five foot section of existing drain tile will be performed next summer after plant
growth in the rain garden is well established.
At our meeting there were discussions about constructing a concrete weir as a more permanent
way to ensure that the design overflow elevation was maintained in the long term. While my
client has no objection to the use of grouting for that purpose, it does raise the question of
whether the outflow elevation will be maintained in the future. This letter confirms that you have
agreed that the grouted riprap will receive maintenance in the future as necessary to maintain
the design outflow elevation.
I'm closing my file at this time subject only to verification next summer that the proposed work
has been completed as proposed. If you have any questions regarding the this letter call me.
