Dear Mr. Kellogg:
As discussed, we are sending to you for your review and approval proposed
changes to the newly constructed drainage control and infiltration system at 2687
Wayzata Blvd, Orono as follows:
1. On Thursday, October 12, 2009 we met with our neighbor Morries Auto
to discuss their concerns relating to the drainage of the 2687 property.
In attendance were Morrie Wagener, Peter Johnson (Morrie's Attorney)
Greg Engel (Long Lake Properties, LLC Representative), David
Greening (Long Lake Properties, LLC Attorney), and Roger Anderson
(Long Lake Properties, LLC Engineer).
2. Peter Johnson sent a letter to Long Lake Properties, LLC on September
14, 2009 expressing concern about the recent improvements/changes to
the drainage system on the 2687 property. They noted that some of the
work had been done on Morrie's property without a construction
easement (rip-rap placement) and a drain the had been installed that
provided a direct discharge into their storm sewer.
3. They also indicated that Morrie has spent a significant amount of money
recently to meet the City and Watershed requirements and were
concerned that any storm water could cause him problems. Their feeling
was that all storm water from the 2687 property should drain north to the
Trunk Highway 12 ditch, not to the south or the east.

4. After review of the current improvements, drainage documents going
back to the early 90's, and with considerable discussion, we came to the
following understandings:
a. The established (historic) drainage pattern for a portion of the 2687
property is to the south and east onto Morrie's property.
b. Morrie previously constructed a storm rip-rap ditch and overflow on
the 2687 property to mitigate water issues along the westerly side of
his building. The ditch and part of the rock overflow were constructed
on the 2687 property.
c. Morrie was concerned that the drain tile from the bottom of the rain
garden provided a constant flow directly to their storm sewer during
recent extended rain events.
d. We briefly reviewed our approved plans and drainage calculations to
clarify that, with the new infiltration basin in place, the quantity and
rate of runoff to Morrie's site has been significantly reduced from
historic flows.
e. Of additional concern were the pond overflow elevation, outflow
characteristics and the construction of the rip-rap overflow.
f. We clarified that the drain tile was to provide temporary relief from
flooding conditions in the pond while vegetation became established
and the surface of the peat layer started providing the required
filtering. It also was in place to provide long-term seepage out fall
from the pond for"filtered" storm water to protect the vegetation at
the bottom of the basin.
After further discussion, we proposed the following, which we believe met
everyone's approval, and which will resolve this issue:
1. We agreed to survey the completed pond to confirm design volume was
met as constructed. We completed the as built survey work and the
resulting survey showed the as-built volume to be approximately 15%
above the design volume.
2. We also agreed to review the pond outfall, and to construct a concrete
weir fixed at the approved design elevation. Our survey showed the
current outfall rip-rap weir to be constructed slightly lower than the plan

elevation. The concrete weir (grouted rip-rap)would insure pre and post-
design drainage and flow conditions are met per the drainage analysis
The combined effect of the additional retention volume and the fixed
outlet will further reduce the volume of discharge to the adjacent
property.
3. After the vegetation is established in the basin (the end of June 2010±),
we will cut off the drain tile and provide a cap which will allow only
seepage flow necessary to protect the vegetation at the bottom of the
basin.
4. The new riprap configuration on both the 2687 property& Morrie's
property, which is wider than that previously constructed by Morries, will
remain as is on both properties to provide slope protection in the case of
major storm events.
5. Long Lake Properties, LLC will bear the cost of the improvements
describes above.
6. We are prepared to complete the concrete outfall work this fall, as soon
as approval can be obtained.
Please find enclosed a sketch plan showing these proposed changes.
Upon your review and approval of these proposed modifications we will proceed
with construction of the weir and in time, modification of the drain the per our
agreement with Morrie.
We are copying Morrie's attorney, Peter Johnson, with this information to keep him
appraised of our efforts to resolve this issue.
