Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 November 15, 1999 Nancy Chadwick 9747 Hall Avenue NE Monticello, MN 55362 Re: Lot 4, Block 1, Wildhurst Estates (PINS #07-117-23 24 0046) - Sewer Easement Dear Nancy: As we discussed,the City constructed a municipal sewer line(gravity main and parallel force-main) on the above-referenced property in approximately 1970. The legal description of the property in 1970 was "Lot 4, Tonkaview Gardens". We need to know whether there is an easement of record for this sewer line. When the property was replatted into "Wildhurst Estates" in ca. 1991,the subdivider's surveyor did not show this existing sewer line, the City did not catch the fact that it was not shown, and its existence was not re- discovered until a few years later. This has now become an issue because the current owner wishes to construct a home in the location of the sewer lines, which may have to be moved. Please research County records to determine whether an easement for this sewer exists. Enclosed is a copy of a portion of the plat of Wildhurst Estates; a copy of the as-built sewer maps from 1970, and a portion of the survey submitted for the 1991 subdivision. Box 66 Crystal Bay, MN 55323 Re: Lot 4, Block 1, Wildhurst Estates - Sewer Easement Our File No. 752031 Dear Mike: As you requested, I reviewed the record title of the above-referenced property at the office of the Hennepin County Registrar of Titles to determine whether there is an easement of record for the sewer line that crosses through Lot 4, Block 1, Wildhurst Estates (the "Property"). I found that the title to the Property is registered as evidenced by Certificates of Title Nos. 1014256 and 1014257, copies of which are enclosed. The fee owners of the Property are R& I Construction of Bloomington, Inc., a Minnesota corporation, as to an undivided 50% and Cheryl Wetherbe and James Wetherbe, as joint tenants, as to an undivided 50%. The certificates disclose that the only easement of record in favor of the City of Orono against the Property, other than the platted drainage and drainage and utility easements, is a Flowage and Conservation Easement and Waiver of Damages recorded December 9, 1991, as Document No. 2221015. A copy of this easement is enclosed for your reference. Any easements effectively recorded against the Property would have to be shown on the Certificates of Title because the property has been registered since 1946. In the event you determine that the City would have had its easement prior to 1946, please let me know and I will examine the prior title and the registration file, if necessary, to insure that the City received proper notice of the title registration. This letter is to advise you of existing municipal sewer facilities that exist on the property by prescriptive easement. These facilities include a sewer lift station,manholes,and main lines as shown on the attached drawings. These facilities have been in place since 1970. We wanted to make sure you were aware of these facilities, and the limitations they may place on your building site, before you were too far along in any potential site planning. Any construction on the property must maintain a 10' setback from these facilities to ensure continued operation and the City's ability to maintain the system. These facilities serve the entire neighborhood and would also serve any new residence constructed on your property Attachment 'A' is a copy of the record plat of Wildhurst Estates,indicating no easement for the existing sewer line. We believe the lack of a dedicated easement was an oversight,as the developer's survey did not indicate the entire extent of sewer facilities that existed on the property at the time it was subdivided. Attachment'B' is a copy of the 1970 "as-built" sewer map, showing the location and extent of sewer facilities on the site. Attachment 'C' is a copy of the developer's preliminary plat and grading plan, to which I have drawn in the actual sewer lines based on the as-built maps. As you can see,the existing sewer line cuts across the`buildable envelope' (the area of the lot that can be built upon after setbacks from lot lines,wetlands and lakes are excluded)making it relatively constricted for placement of a home.
