Re: Illegal Fill/1( 0 Wildhurst Trail
Dear R``o6ErT: ------
On September 9, 1993 this office notified you of illegal filling done on your property at 1070
Wildhurst Trail. At that time you stated you were working on a plan to build on the property
and that you would seek approval for the fill with the building permit application. As of this
date, this issue remains unresolved and more fill has been placed illegally. The fill is placed
within 75' of Lake Minnetonka and is a violation of Section 10.03, Subd. 19 and Section 10.56,
Subd. 16 (J-2).
Therefore the City must require you to cease adding fill to the site and submit an acceptable
timetable for removal of the fill or submit an after-the-fact conditional use permit application to
request permission to keep the fill. Please response with your intentions within the next two
weeks. Questions regarding the conditional use permit should be directed to Jeanne A. Mabusth.

Re: Illegal Fill - 1074 Wildhurst Trail
Dear Bob:
On September 9, 1993 the City notified you of illegal fill placed on your property at 1074
Wildhurst Trail. You first stated you were working on a proposed home on that lot and you
would deal with the fill when the house was built. Apparently that fell through. Then on
February 6, 1995 you wrote the City a letter stating you would remove the fill when the frost
was out in the spring.
As of this date, the fill has not been removed. This letter is to notify you that this violation
cannot be left unresolved. Therefore the City must require you to remove the fill, return the
area to original grade and provide erosion control until ground cover is established. A deadline
of August 14, 1995 has been established. If this deadline is not met, the City will initiate legal
action. If you have any questions, feel free to contact me at my office.

RE: Wildhurst Estates - Fill 1074 Wildhurst Trail
Dear Bob:
This letter is to confirm our conversation of September 21. As Jeanne Mabusth and I discussed
with you previously, fill was approved on the building pads with the subdivision approval.
However, filling is not allowed until a permit is issued for that particular piece of property, either
a building permit or a land alteration permit.
You agreed to stop filling on lots with no permits and to grade out the fill that has been placed so
far. This area should be seeded to establish ground cover until the lot is developed. If you have
any questions or if you disagree with any statement in this letter, please feel free to contact me at
