At that time you stated you were working on a plan to build on the property <br /> and that you would seek approval for the fill with the building permit application. As of this <br /> date, this issue remains unresolved and more fill has been placed illegally. The fill is placed <br /> within 75' of Lake Minnetonka and is a violation of Section 10.03, Subd. 19 and Section 10.56, <br /> Subd. 16 (J-2). <br /> Therefore the City must require you to cease adding fill to the site and submit an acceptable <br /> timetable for removal of the fill or submit an after-the-fact conditional use permit application to <br /> request permission to keep the fill.
