Re: 2005 Wetland Buffer&Grading Violation at 1006 Wildhurst Trail
The property owner submitted the MCWD wetland buffer declaration recorded against the property
in 2005. The City was under a moratorium for wetland development projects and City permits could
not be issued. The grading conducted within the 0-75'setback required a conditional use permit from
the City. The grading conducted may have been an extension of the temporary grading permit issued
to the property in October of 2003 (Permit#P06829). Because the documentation of this violation is
unclear, staff feels it would be counterproductive to review this grading project after the fact as the
site is currently undisturbed and is stable.
Staff is considering the violation for unpermitted work on this property closed based on the degree of
work done and the site's stable condition.The site will be considered as-is for purposes of compliance
with the aforementioned violation. Please note, any subsequent requests for permits on this
property will require submittal of a certificate survey meeting the City's requirements under City Code
Section 86-68 and the list of standards on file at City offices.
