The properties east of the 10-acre parcel are zoned for 1-acre lots and are
within the MUSA and therefore can be served with municipal sewer.
As Hennepin County's website shows, there are platted dedicated rights-of-way separating the various components of
the Morgart property. Whether the City would vacate the rights-of-way will not be determined until a proposal for
development appears before the City. If it is determined that some combination of the rights-of-way provides potential
public access to Lake Minnetonka, a vacation is unlikely. Vacation of certain elements of the right-of-way not related to
lake access might be feasible.
All existing Joint Use Dock lots in Orono were created several decades ago. According to an excerpt from City Code
Section 78-1330(3)within the RPD/PUD Standards...The number of dwelling units or sites which maybe granted lake
access shall not exceed the number of riparian dwelling units or sites which could be created under a standard
subdivision. In this case the zoning district is 1 acre requiring 140' in width. The land that directly abuts the ordinary
high water level (OHWL is approximately 305 feet. Only the two lots that directly abut the lake would be allowed a
dock, none of the other lots would qualify. The City would not approve a joint use dock system for the property in
question.
Please don't hesitate to contact us if you have any questions.
Christine Mattson
Planning Assistant
City of Orono
2750 Kelley Parkway Orono I MN 155356 (physical address)
PO Box 66 I Crystal Bay I MN 155323-0066 (mailing address)
S' 952.249.4620 I 4 952.249.4616
cmattson@ci.orono.mn.us www.ci.orono.mn.us
Office Hours: Monday- Friday 8 am to 4:30 pm
1
