Chris please send letter to 975 Wildhurst about the deck. I met with him and told him to have his contractor meet me on
site to take up some deck boards so we could verify size of the deck that was replace, but I have not heard from him.
Give him a couple weeks to apply for the permit and to verify the size of the previous deck and remove the part that
wasn't there before. No rush Thanks.

RE: Alleged Construction without a Permit
Dear Mr. Oman:
I have received your letter of February 21 but have no letter of December 16 nor do I have any
certified letter from you. Needless to say, I would respond to your correspondence immediately.
As I previously explained in a lengthy letter, the"grade-level deck" at my property was approved
many years ago when it was first installed. Both the building official who approved the deck as
well as the contractor who installed it are dead. Whatever was required at the time was filed with
your office and should be available in the records pertaining to my property.
The deck without any stairway to the upper deck has been in place so many years that the timbers
were rotted and the deck posed a hazard to walk on. It was my impression from you, someone in
your office and a telephone receptionist at your office that NO PERMIT was required to repair
and/or replace the existing deck. Since that information came from two different people, I assume
it is correct (but not mentioned in the code provisions you provided).
Although it would not be possible at the moment due to snow cover, I believe a five minute visit
to my property would resolve this. I am not unwilling to do whatever you tell me is necessary, but
all I ask look at the deck yourself, let me show you the staircase, and then you can make an
informed decision. If you see it as an encroachment, I can remove it. But less hard surface is
covered by the stairway than the old deck at ground level. I would appreciate having you look
before deciding.
If it is your position that there never was any deck on the property deteriorated or otherwise, I
will look for a picture and search my records for permits, drawings, etc. But, 20 or 30 years after
a deck is installed, I do not think it is my responsibility to maintain the original records of
construction. Hopefully you will have some record of this because I did meet with Hank and later
Jean when the deck was installed. Rennick Construction built the deck but they did so from a
picture and no blueprints or survey was necessary. I am pretty sure I still have that picture which
came from the newspaper.
Suffice it to say, no construction has taken place since your notice to stop was posted, and no
construction or use will occur without your prior approval. If this can pend until the snow recedes
and if you are willing to take a quick look, I am confident it can be resolved amicably at that time.
